APPLICATION FOR VARIANCE
The Applicant Gerd M Zeller requests a 10-foot rear-yard
set-back. variance. The parcel in question is 4.467 acres and is
located within the..Fk-3"6~ Zone District.

The subject real property is located across from the
Aspen Municipal Golf Course between the. Maroon Creek traffic light
and the Tennis Club Subdivision. The,,,lot ,split was originally
platted in 138$. As part of the lot split review process, a
considerable amount of ,attention was given to minimizing impacts on
the view plain from Highway $2'toward Pyramid Peak. `As a result of
these cohcerns, the building envelopes for both lots were located
at the extreme edges of the property.
The building envelope for Lot 2 has as its front envelope
line the 200-foot set-back from_Iiighway 82. The real envelope line
was established 20 feet from.the rear ;property line, in accordance
with then existing set-backs. The 1994 changes' to the 'Ptkn
County Lind Use Code render the., platted set-back 10 feet less than
that which is currently required. The building envelope is deter-
mined to,be smaller than desired for the Applicant's development of
his residence, and business office..
The Applicant seeks a variance on, the., basis of down-
zoning and administrative hardship. To relocate the building
envelope to create a 30-foot .rear-yard set-back would require a 2-
step land use',„review process, a minimum of 6 months processing time
and an inability to proceed with construction.. of the residence in
1995.
The lot is significantly impacted by the 200-foot Highway
82 set-back. While it might be feasible to relocate the building
envelope, to the west to create the 30-foot rear-yard set-back, such
relocation would have a tendency to move the residence into the
view plain. Furthermore, the building envelope as presently
located,is well screened_by a heavy barrier of cottonwood trees, as
depicted on the survey. Moving the building envelope to the west
would reduce 'the effectiveness of this screen.
The, building envelope is modest in size. The property
immediately adjoining the rear property line is deed restricted
open space. The granting of a 10-foot set-back variance will not
have any negative impact on any adjoining property. `
The Applicant respectfully requests that the Board of
Adjustment grant a 10-foot rear-yard set-back variance so that the
residence may be constructed within the platted building envelope
on the property.

1. The zone is AFR-2, not R-30. I have attached a copy of
the zoning map. Notice that the arrow next to R-30
points to the adjacent "subdivisioh, and' that the

AFR-2 zone district.
2. Please call me regarding the footprint of the proposed

BOARD OF ADJUSTMENT
GRANTING SETBACK RELIEF FOR GERD ZELLER
RESOLUTION NO. 95-31
WHEREAS, Gerd Zeller, owner of 39600 Highway 82, is requesting
approval for a 10 foot rear yard setback variance, for construction
of a single-family residence; and
WHEREAS, 30 feet is required in the AFR-2 zone district; and
WHEREAS, the subject property is described as Lot 2 of the Golf
Course Properties Lot Split; and,
WHEREAS, the Board of Adjustment is vested with the power to grant
or deny such variances by virtue of Title II, Section 16-1.3,
Pitkin County Code (Land Use Code) and Colorado Revised Statutes,
1973, 30-28-118(2) (C); and,
WHEREAS, based on the evidence presented, the Board of Adjustment
makes the following findings:
1. Proper notice procedures, including the
notification of all adjoining property owners,
has been shown by the applicant.
2. The required hardship or practical difficulty
has been established.
3. Granting such relief will not cause substan-
tial detriment to the public welfare and will
not substantially impair the intent and
purpose of the Zoning Resolutions and the
zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment, that a
10 foot rear yard setback variance be granted for construction of
a single-family residenc, as shown on the attached plans (Exhibit
"A'") , due to downzoning.
WARNING: Any violation of the terms of this resolution may

Minutes of September 12, 1995
Johns stated that the existing residence is located entirely within the 100 foot setback. The
owners propose to remove a shed and bedroom on the back of the house and to build a new
addition. There is a steep slope located behind the house.
Neiley noted that the lot is constrained, and the least impactive location for the addition has been
chosen.
Brickham moved to grant a 25 foot front yard setback variance for construction of an addition,
due to existing conditions and topography, as per the plans submitted. Dyer seconded the motion,
and all were in favor.

Neiley did not vote on this case, as he is representing the applicant.
Gerd Zeller, Rick Neiley and Richard Klein were present to request approval of a 10' rear yard
setback variance, where 30' is required in the R-30 zone district, for construction of a single
family residence.
Neiley noted that the lot was created by a lot split in 1981, at which time the property was
reviewed far scenic impacts. The building envelopes were placed at the farthest extremes of the
property to minimize any impact on the view of Pyramid Peak from Highway 82. The envelope
on this lot was also required to be placed behind the stand of cottonwood trees, and was placed as
far back on the lot as possible, which coincided with the required 20 foot rear yard setback.
When the new Code was adopted in 1994, the rear yard setback increased to 30 feet, so the
building envelope is now located within the setback. Also, all development is now required to be
located within the building envelope, including parking areas, decks, etc. To accommodate the
proposed development, the owner must either amend the, plat to move the building envelope or
obtain a variance to build within the setback. Applying to amend the building envelope would be
contrary to the intent of the original approval to protect the viewplane. The Moore Open Space
parcel is adjacent to the rear property line of this lot, so would not be impacted by the granting of
the variance.
There was no public comment.
Dyer moved to grant a 10 foot rear yard setback variance for construction of asingle-family
residence, due to downzoning, as per the plans submitted. Brickham seconded the motion, and all
were in favor.
Approval of the minutes of August 1, 1995 was tabled to the October 3, 1995 meetine.
The meeting was adjourned at 7:45 PM.
