Snu Paulo This request is for consideration for granting a variance from the Pitkin County Land Use Code relative to the definition of "square footage" ,specifically; the measurement of signage text vs. background areas. The Land Use Code allows for a total of 6 square feet of signage, which can be distributed on up to two sides. The Pitkin County Community Development Department has determined at a staff level, without confirmation by the Board of County Commissioners, that the entire background area of a sign shall be counted, as opposed to the definition of measurement indicated in Section 3-110.130.F.1 of the Code> thereby creating a hardship for the Applicant. Using the definifion indicated in the Code, the Applicant's proposed sign with squaze footage of 2.04 falls well within the allowed limits. Therefore, the Applicant is requesting a hearing before the Board of Adjustments to request a variance from the Code for a sign of 52 square feet, where 6 squaze feet is allowed. For reference, the sign is located on Lot 50 of the Maroon Creek Cluh PUD, outside of the 100 foot setback of Highway 82 and outside of the public right-of--way of Stage Road. Through a sepazate application to the Community Development Department, the Applicant is requesting an administrative approval of a Minor PUD Amendment for locating the proposed sign within the front yazd setback of LQtS_Q.. He stated that the 1~oazd was concerned at the previous meeting with three issues: the square footage ~of the sign, .the word "private" on the si n and e reque the following adjusted setback variances. In response to these concerns, the applicants propose stments: The sign will comply with the. required IO'side yard setback, and will, therefore, be located ` farther from the AABC irarl. Schaffner stated that staff determined that this, sign is adjacent to the highway because of its proximity to the highway. If the Board deems that the, sign is not adjacent to the highway, then the applicant is allowed 10 square feet for the sign. The PUD approval did not address signs. The proposed sign would comply if only the text aiazea,was measured. According to Hazzazd this policy went into effect after the building permit was submitted for the sign. Schaffner disagreed, noting that the policy change occurred prior to submission of the permit. Also, Hazzard noted that the, PUD approval required a berm so the club house and the town house parcel would be not be visible from the highway. If the sign complied'with the setback requirements, then it would be located on the berm and would not„ comply with the requirement that a sign be only 8' above the height of the highway grade. Schaffner noted that staff expressed concern that it is not clear that the word "private" on the sign only refers to the parcel of land on which the sign is located.. It does. not refer to the road, which is public: She also noted that the townhouses which will be located on this parcel may request an identification sign in the future, but this sign will use up the total amount of squaze footage available for signs on the pazcel. Hazzard responded to questions from the Board members as to the purpose of the sign. He noted that all roads within the PUD are public, and thatthe sign is intended to identify Lot 50 as a private parcel. This location was chosen to identify the entire Mazoon Creek project; this is the first sign people will see when they turn off of the highway. The logo used on this sign will be 1'itldn County Board of Adjusnt Minutes of October 3;1995 3 common to'all signs. He added that the sign was already erected because they could not find another way to represent the sign to staff. Staff was notified that the sign would be erected at the applicant's risk. He also added that the applicant would agree to remove the word "private" from the sign. Schaffner noted that 32 of the 120 notices that were mailed to adjacent property owners were returned as undeliverable. Dan Kinney, a member of the public, stated that the word "private" is misleading because it does not appear to relate to what is actually private. Rudnick stated that. a hardship has not been shown, and that this sign does not seem to be necessary, and that neither the club nor the public will "suffer" if the sign is not there, therefore, the variances should not be granted. He added that he thought it was the role of the Board to grant variances only in exceptional circumstances. Wheeler stated that the PUD requirement for the berm could be considered a hazdship. Lukes stated that the location of the sign is confusing because it does not relate to any defined parcel of land and is too close to the intersection and the trail. He suggested moving the sign farther from the highway, but maintaining the same distance from Stage Road as currently proposed. He noted that a conforming sign might have more visual impact, and that the Boazd can review and grant vaziances based on "specific circumstances unique to an application". If the purpose of the sign was only to convey "private", then the sign should comply with the setback requirements. He added that he likes the sign and appreciates that they' have used natural material with low impact graphics. He also added that he agrees with staff's determination that the whole sign azea'should be counted. Cooper moved to grant a 28' front yard setback variance, a 5' south side yard setback variance and a 46 squaze foot size variance to erect a sign along highway 82, as per the plans submitted and subject to the removal of the word "private" from the sign Motion died due to lack of a second. Wheeler stated that,the Board grants the minimum variance necessary, and that he would like the applicant to move the sign so a side yard setback variance was not necessary and to determine if the sign could also be moved a few more feet back from Stage Road. He added that he thinks the sign is too lazge, and should be buried more. Hazzard requested that the Boazd table the application to allow_them to explore alternative locations. Pitlsin County Board of Adjus'~ nt Wayne Ethridge addressed the Boazd and thanked the Board for its input on the airport sign and its candidness in approaching the Commissioners, and added that the County has a better sign as a result. Lukes stated that he would like to send a letter to Stan Berryman thanking him for his cooperation and good work. Schaffner presented a new policy to the Boazd concerning mobile home parks. AlI of the legal mobile home pazks in the County are currently non-conforming and theBoard of County Commissioners has adopted a policy to limit development in the parks until the parks have been rezoned to Mobile Home Pak/PUD. The only development that will be allowed within the Roaring Fork, Woody Creek, Lazy Glen, Aspen Village and Phillips trailer parks will be: Replacement of an existing trailer with a trailer of equal size or smaller. Accessory structures which do not exceed 120 square feet in size.. Decks. Schaffner then noted that Dan Kinney was present to discuss with the Board whether they would be willing to review an application to replace his mobile home in the Woody Creek mobile home pazk with a lazger trailer. Schaffner stated that only 6" would separate the overhang of the new mobile home from the neighbor's storage shed. They met with a Building Inspector and the Fire Marshal, who required a minimum 3' sepazation if one of the structures, either the trailer or the shed, complies with the one hour fire rating and is non-combustible. Schaffner agreed fo bring this request to the Boazd of Adjustment because Kinney purcfiased the new mobile horrie°after "someone" in Community Development represented that he would be able to replace the existing mobile hortie. Lukes stated that he would be willing to hear the application if the applicant provides a letter from the Fire Mazshal but added that tftere may not be enough space to put in a lazger trailer.
