Colombo stated that the, applicant has received approval from the Board of County ' ' , n this lot after a iTmonth process. The Commtssioners (BOCC) to construct a restdence. o , property is located within a wetlands azea, and the applicant went througTt the 1041 process .and a takings hearing in order to establish a building envelope. The approval requires that the front of the edue o e located outside of the wetland azea He added that there is a 20 shoulder between g f the road and the roe line, so the residence wiTI~be vistYal`ly set back 36' from the ~~ road. The applicant is claiming a hardship based on the topography of the lot anc~ the requirements of the 1041 approval. Neiley stated that the BOCC should have granted the necessary variances as part of the takings procedure,. rather than forwarding an application that the Board of Adjustment is "ot~liged" to approve because the residence has been, situated, in the only possible location. Schaffner noted that onlythe Board of Adjustment has the authority to grant variances. Dyer moved to grant a 13.5' front yard setback variance for asingle-family residence and a 23.5' frontyazd setback variance fora driveway retaining wall, due to topographical hardship. Cooper seconded the motion, and all were in favor, Cooper disclosed that he lives. in Brush„Creek, Village, and offered not to vote on this case.. Stan Mathis was present, representing the applicant, to request a 9' east side yard setback vaziance, where 20' is re uired for a 2.6 acre lot in the AFR-TO zone district, for consfniction of q an addition to asingle-family residence, Mathis explained that the sign was not posted on the property for the required number of days. The Board agreed to consider the application at this rrieeting, but will not vote, and the case will- have to be fully renotced for the December meeting Mathis stated that the applicant proposes. to construct a 1500, squaze foot addition between the existing garage and residence because other locations are constrained by the leach field and'a mudslide area. He added that„a hardship is created by the original location of the residence itI the corner of the lot and. the complicated design of the roof. He added that the addition will not impact the neighbors.
