Neiley added that setbacks are now determined by the size of the lot. ' Luker noted that the addition could be modified, to be located outside of the setback.. Neiley stated that the application does not address khe exact location of the: mudslide area, so the Boazd is unable to consider the geologic hazazd as',a hazdship. He noted tharthe proposed addition iS driven by design, and that the applicant: needs to provide a more compelling argument to justify granting a variance. Geller agreed. Mathis decided to withdraw the appTicatiori. Case #95-37. Daniel Kinney. 109 Woody Creek Plaza Cooper did not vote on this case. Daniel Kinney was present to request a T side yard setback variance for a mobile home and a, 1'6" side yard setback variance for a shed, where 10' is the distance required between structures, to replace a mobile home. Schaffner noted that the new mobile home is 4' wider than the existing one, and a telephone pole on the space limits. where the home can be located. Kinney stated that he has agreed to remodel the neighbor's shed to maintain a 3' separation between the shed and the trailer and to add drywall to the shed to comply with the Fire Marshal's requirements. Kinney's shed will be moved to leave an 8.5' separation between that shed and'the trailer. The whole parcel will be in compliance with the fire codes once these modifications are completed:; There was no public comment.
