Because the lot is only 100 feet square, a variance from the front yard setback is necessary to make it buildable. Virtually every other lot that has been built on in the subdivision has been granted such a variance. If the new proposed zoning code were in effect, the setbacks for this lot would be; - 30 foot front yazd setback - 10 foot side yard setback - 10 foot rear yard setback. Under the current zoning code, the setbacks for the lot are: - 100 foot front yard - 30 foot side yazd. We are proposing - 24.5 foot front yard setback - 12.5 foot side yazd setbacks - 25 foot rear yard setback. The existing house on Lot 3 is set back approximately 15 feet from the street and also from the property line between Lots 3 and 2. We also have records of a variance granted 8 or 10 years ago for Lots' l and 2 which allowed a 15 foot front yard setback. We are proposing 24.5 feet this time rather than 15 feet to allow parking in the driveway; because parking is in short supply on Chair Mountain Drive. The Crystal River Park Homeowners Association covenants require a 30 foot front yard setback measured from the building wall rather than the roof overhang, but they have the ability to reduce that to 25 feet. We will be asking them to approve a setback of 26.5 feet to the front wall of the garage, as shown on the site plan before you, at their meeting on April 16. The site plan we are asking you to approve shows the house 3.5 feet deeper from front fo back than it will be in reality, which gives us 3.5 feet to play with in case the Homeowners. refuse to grant us relief from the 30 foot front setback requirement. RESOLUTION OF THE PITKIN COUNTY, COLORADO BOARD OF ADJUSTMENT GRANTING SETBACK RELIEF FOR LAWRENCE BONE RESOLUTION NO. 94-07 WHEREAS, Lawrence Bone, owner of 0044 Chair Mountain Drive, is requesting approval for a 76' front yazd setback variance, a 5' rear yazd setback variance, an 18' east side yazd setback variance, and a 17' west side yard setback variance, for construction of a single family residence; and WHEREAS, 100', 30', 30' and 30', respectively, were previously required in the AF-l zone district; and WHEREAS, a new Pitkin County Land Use Code was adopted by the Board of County Commissioners on April 26, 1994; and WHEREAS, the setback requirements fora 10,000 square foot lot in the AFR-10 zone district have been reduced to 30' in the front, and 10' in the rear and on each side; and WHEREAS, the applicant is, therefore, requesting approval fora 6' front yard setback variance; and WHEREAS, the subject property is within the unincorporated area of Pitkin County, Colorado, (as described in Exhibit"A", attached); and; WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by virtue of Title II, Section 16-1.3, Pitkin County Code (Land Use Code) and Colorado Revtsed Statutes, 1973, 30-28-118(2) (C); and,' WHEREAS, based on the evidence presented, the Board of Adjustment makes the following findings: 1. Schaffner stated that the new Land Use Code was adopted by the Board of County Commissioners on April 26, 1994, and that the setback requirements have changed. The applicant is, therefore, requesting a 6' front yard setback variance, where 30' is required for a ,10,000 square foot .lot; the side and rear setbacks are in compliance with the new Code requirements. She added that she spoke with the President of the Homeowners Association, and that they have no objections to the request. There was no public comment. Lukes noted that the new setbacks seem to be very reasonable now that they are consistent with lot size, and asked why the house could not be adjusted 6' to comply. Smith replied that the house cannot be moved because the requirements for the leach field limit the buildable space on the lot. The leach field is 8.5' wide, the minimum requirement for a leach field for a 3 bedroom house, and is required to be 10' from the .property line and 20' from the foundation of the house. Therefore, 38° is required from the property line to the rear of the house, which determines the location of the house. The depth of the 'house, wa'sreduced,by 3.5' to accommodate the leach field.
