To the Pitkin County Board of Adjustment:
On behalf of Mr. William Ziff, the record title holder of a
parcel of approximately 73.6 acres located adjacent to the Stanwood
Subdivision, this application is filed to request approval by the
Pitkin County Board of Adjustment of a variance of 45 feet in the
front yard setback requirement of 100 feet in the RS-20 (PUD) zone
district, in order to permit the construction of a barn on the
parcel.
The present property line between the 73.6 acre parcel and Lot
R-53-A (of which Mr. Ziff is also the record title owner) passes
through the proposed barn site.
On January 25, 1991, a separate application was filed by Mr.
Ziff which includes a request for approval of a lot split for the
73.6 acre parcel and for a insubstantial change in the recorded
plat to shift the boundary between Lot R-53-A and the lot split
parcel to a location between the barn site and the existing
residence on Lot R-53-A. That application is pending.
A 45 foot variance from the 100 foot front yard setback
requirement for the 73.6 acre parcel is requested because there is
inadequate distance between the proposed barn site and the existing
residence on Lot R-53-A to provide for a 50 foot side yard setback
for the house and a 100 foot front yard setback for the barn.
The location of the barn has been chosen to assure easy access
utilizing existing roads while minimizing encroachments into areas
in excess of 30$ slope. Mr. Ziff proposes to initially utilize the
existing driveway serving the residence on Lot R-53-A to access the
barn. Ultimately, the existing jeep road which accesses the two
lot split sites (resulting from the split of the 73.6 acres) will
be upgraded and will then be used to access to the barn.
In order to have a consistent interpretation regarding yards
and setbacks, County staff has established that the front yard of
a parcel is determined by the property line across which the
property is accessed. While a consistent interpretation is
desirable, this interpretation nonetheless occasionally creates a
hardship in a case such as this, where access really is being
provided across what should otherwise be considered the side yard
of the parcel.

DIRECTIONS TO THE SITE
To visit the site it will be necessary to schedule an
appointment with Mr. Rocky Tschappat, the Ziff's property manager
to meet at the Stanwood entry gate on Trentaz Drive. From the
entry gate, proceed 0.5 miles on Stanwood Drive to Carroll Drive.
Turn left onto Carroll Drive and proceed 0.3 miles to the second
gravel driveway on the right. Turn right onto the driveway on Lot
R-53-A to the barn site, which is staked.
The notification sign to be posted on the property will be
placed adjacent to the Carroll Driv2 right-of-way on the 73.6 acre
parcel near the driveway to Lot R-53-A.

The proposed barn site is well removed from the_Carroll Drive;
._.. ,
there is over 200 foot separationlbetween the property and the road
right-of-way. There are no potential building sites on neighboring
property owned by others. Mr. Ziff also owns the adjacent land -
Lot R-53-A of Starwood Subdivision; in the event t1~at Lot R-53-A is
sold to another party, the buyer would be aware of the barn's
location. These circumstances virtually eliminate any adverse
consequences of the variance requested on other property owners.
The site consists of„ a parcel which was held out by Edgar
Stern when he subdivided the adjacent property between 1964 .and
1967, 'retaining ownership of the 73.6 acre parcel. The subject

hereafter erected on the land, or prohibiting a separation in ownership or a reduction in the dimensions or area of the land, or the effect
of any violation of any such law, ordtoance or governmental regulation. ''
2. Rights of eminent domain or governmental rights of police power unless notice of the exercise of wch rights appears in the public
records at Date of Policy.
3. Defects, liens, encumbrances, adverse claims, or other matters lal created, suffered, assumed or agreed to by the insured claimant; (b) not
known to the Company and not shown by the public records but~knawn to the insured claimant either at Date of Policy or at the date

CONDITIONS AND Sl"IPULAT(bNS -
1. DEFINITION OF TERMS
The following terms when used in this policy mean:
(a) "insured": the insured named in Schedule A, and,
subject to any rights or defenses the Company may have
against the named insured, those who succeed to the
interest of such insured by operation of law as distinguished
from purchase including, but not limited to, heirs, dis-
tributees, devisees, survivors, personal representatives, next
of kin, or corporate or fiduciary successors.
(bl "insured claimant": an insured claiming loss or
damage hereunder.
(c) "knowledge": actual knowledge, not constructive
knowledge or 'notice which may be imputed to eninwred
by reason of any public records.
Idl "'land": the land described, specifically or by
reference in Schedule A, and improvements affixed thereto
which by law constitute real property; provided, however,
the term "land" does not include any property beyond the
lines of'the area specifically described or referred td In
Schedule A, nor any right, title, interest, estate or easement
in abutting streets, roads, avenues, alleys, lanes, ways or
waterways, but nothing herein shall modify or limit the
extent to which a right of access to and from the land is
insured by this policy.
(e) "mortgage": mortgage, deed of trust, trust deed, or
other security instrument.
(f) "public records": those records which by law
impart constructive notice of matters relating to said land.
2. CONTINUATION OF INSURANCE AFTER CON-
VEYANCE OF TITLE
The coverage of this policy shall continue in force as pf
Date of Polidy in favor of an insured so long as such insured
retains an estate or interest in the land, or holds an
iniiebtedness'secured by a'purchase money mortgage given
by a purchaser from such insured, or so Idng as such insured
shall have liability by reason of covenants of warranty made
by such insured in any transfer or conveyance of wch
estate or interest; provided, however, this policy shall not
continue in force in favor of any purchaser from such
insured 'of either said estate or interest or the indebtedness
secured by a purchase money mortgage given to such
insured.
3. DEFENSE AND PROSECUTION OF ACTIONS -
NOTICEOF CLAIM TO BE GIVEN BY ANINSURED
CLAIMANT __ _ _. _..
(al The Company, at its own cost and without undue
delay, shall provide fdr the defense of an insured in all
litigation consisting of actions or proceedings commenced
against such insured, ora defense interpdsedagainst an
insured'in an action to enforce a contract for a sale of its
estate or interest in said land, to the extent that such
litigation is ' founded upon an alleged defect, lien,
encumbrance, or' other matter insured against by this
policy.
(b) The insured shall notify the Company promptly in
writing (i) in case any action or proceeding is begun or
defense is interposed as set forth in (a) above, (ii) in case
knowledge sFiall come to an insured hereunder of any claim
of title or interest which is adverse to the title tb the estate
or interest as insured, and which might cause loss or damage
for which the Company may be liable by virtue of this
policy or, (iii) if title to the estate or interest, as insured, is
rejected as unmarketable. If such prompt notice shall not
be given to the Cgmpany, then as to such insured all
liability of the Company shall cease and terminate in regard
to the matter or matters for which such prompt notice is
required; provided, however, that failure ~td notify snail in
no case prejudice the rights of any such insured under this
policy unless the Company shall be prejudiced by such
failure and tt?en only to the extent of such prejudice.
(cl The Company shall have the right at its own cost tc
institute and withqut undue delay prosecute any action of
proceeding dr td do any other act which in its opinion may
be necessary or desirable to establjsh the title to the estate
orinterest as insured, and the Company may take any
appropriate action under the terms of this policy, whether
or not it shall 6e liable thereunder, and shall not thereby
concede liability or waive any provision of this policy.
(d) Whenever the Company shall have brought any
action or interposed a defense as required or permitted by
the prdvisions of this policy, the Company may pursue any
such litigation to'final determination by a court of
competent jurisdiction and expressly reserves the right, in
its sole discretion, tb appeal from any adverse judgment or
order.
(e1 In all cases where this policy permits or requires
the Company to prosecute or provide for the defense pf
any action or proceeding, the insured hereunder shall secure
to the Company the right to so prosecute or provide
defense in wch action or proceeding, and all appeals
therein, and permitthe Company to use, at its option, the
name of such inwred for such purpose. Whenever requested
by the Company, wch insuredshall give the`Company all
reasonable aid in any such adtipnot proceeding, in effecting
settlement, 5ecuting evidence, obtaining witnesses, or pros-
ecuting or defending such action or proceeding, and the
Company shall reimburse such inwred for any expense so
incurred.
4. NOTICE OF LOSS - LIMITATION OF ACTION
In addition to the notices required under paragraph
3(b) of these Conditions and Stipulations, a statement in
writing df any Ibss or damage for which it is claimed th'e'
Company is liable under this policy shall be furnished tb
the Company within 90 days after such loss or damage shall
have been determined and no right of action shall accrue to
an insured claimant until 30 days after such statement shall
have been fumished. Failure to furnish such statement of
loss or damage shalfterminate any liability df the Company
under this policy as to such loss or damage.
5. OPTIONS TO PAY OR OTHERWISE SETTLE
CLAIMS
The Company shall have the option to pay or otherwise
settle for or in the name of an insured claimant any claim
insured against or io terminate all Liability and obligations
of the CompanyFit:reundt:r by paying or tendering payment
of the amount of inwrance under this policy together with
any costs, attorneys' fees and expenses incurred up to the
time of such payment or tender of payment, by the inwred
claimant and authorized by the Company.

6.. DETERMINATION AND PAYMENT OF LOSS,,,
(a) The liability of the Company under this policy
shall in no case exceed the least of:
(i) the actual loss of the insured claimant; or
(ii) the amount of inwrance stated in Schedule A

insured in litigation carried on by the Company for such

11. SUBROGATION UPON PAYMENT OR SETTLE-

authorization of the Company.
(cl When liability has been definitely fixed in accord-
ance with the conditions of this policy, the loss or damage
shall be payable within 30 days thereafter.
7. LIMITATION OF LIABILITY
No claim shall arise or be maintainable under This
policy (a) if the Company, after having received notice ~of
an alleged defect, lien or encumbrance inwred against
hereunder, by litigation or otherwise, removes such defect,
lien or encumbrance or establishes .the title, as inwred,
within a reasonable time after receipt of such notice; (b) in
the event of litigation until there has been a final
determination by a court of competent jurisdiction, and
disposition df all appeals therefrom, adverse to the title, as
insured, as provided in paragraph 3 hereof; or (c) for
liability voluntarily assumed by an insured in settling any
claim dr suit without prior written consent of the Com-
pany. '
8. REDUCTION OF LIABILITY
All payments under this policy, except payments made
for costs, attorneys' fees and expenses, shall reduce the
amount of the insurance pro tantd. No payment shall be
made without producing this policy for endorsement of
wch payment unless the policy be lost or destroyed, in
which case proof of such loss or destruction shall be
furnished to the satisfaction of the Company.
9. LIABILITY NONCUMULATIVE
It is expressly understood that the amount of insurance
under this policy shall be reduced by any amount the
Company may pay under any policy insuring either (a) a
mortgage shown or referred to in Schedule B hereof which
is a lien on the estate or interest covered by this policy, or
(bl a mortgage hereafter executed by an insured which is a
charge or ties on the estate qr interest desgribed qr referred
to in Schedule A, and the amount so paid shall be deemed a
payment under this policy. The Company shall have the
option to apply to the payment of any such mortgages any
amount that otherwise would be payable hereunderto the
insured owner of the estate or interest covered by this
policy and the amount sq paid shall he deemed a payment
under this policy to said inwred owner.
10. APPORTIONMENT
If the land described in Schedule A consists of two or
more parcels which are not used as a single site, and a loss is
established affecting one or moredf said parcels but not all,
the loss shall be computed and settled on a pro rata basis as
Valid Only If Schedules A and B are Attached.
Whenever the Company shall have settled a claim under
this policy, all right of subrogation shall vest in the
Company unaffected by any act of the insured claimant.
The Company shall be subrogated to and be entitled to all
rights and remedies which wch insured claimant would
have had against any person or property in respect to suctj
claim had this policy not been issued, and if requested by
the Company, such insured claimant shall transfer to the
Company all rights and remedies against any person or
property necessary in order to perfect such right of
subrogation and shall permit the Company to use the name
of such insured claimant in any transaction or litigation
involving such rights or remedies. If the payment does not
cover the loss of such insured claimant, the Company shall
be subrogated io such rights and remedies in the proportion
which said payment bears to the amount of said loss. If loss
should rewlt from any act of such insured claimant, such
act shall not void this policy, but the Company, in that
event, shall be required to pay only that part of any losses
insured against hereunder which shall exceed the amount, if
any, lost to the Company by reason of the impairment of
the right of subrogation.
12. LIABILITY LIMITED TOTHI5 POLICY
This instrument together with all endorsements and
other instruments, if any, attached hereto by the Company
is the entire policy and contract between the insured and
the Company.
Any claim of Igss or damage, whether or not based on
negligence, and which arises out of the status of the title tq
the estate or interest covered hereby or any action asserting
such claim, shall be restrigted to the provisions and
conditions and stipulations of this policy.
No amendment of or endorsement to this policy can be
made except by writing endorsed hereon or attached hereto
signed by either the President, a Vice President, the
Secretary, an Assistant Secretary, or validating officer or
authorized signatory of the Company.
13. NOTICES, WHERE SENT
All notices required to be given the Company and any
statement in writing required to be furnished the Company
shall be addressed to it at its main office, P. 0. Boz 2029,
Houston, Texas 77252.
14. The premium specified in Schedule A is the entire.
charge for acceptance of risk. It includes charges for
title search and examination if same is custgmary or
required td be shown in the state in which the policy is
issued.

WHEREAS, William Ziff, owner of a tract of land situated at
Lot R-53-A, Stanwood Seven_Subdivision, request`s a 45 foot 'fiont
yard setback gariance, in the RS-20-zone district, for construction
of a barn; and
WHEREAS, the subject property is within the unincorporated area of
Pitkin County, Colorado, (as described in, Exhibit,"A", attached);
and,
WHEREAS, the Board of Adjustment is vested with the power to grant
or deny' such variances by virtue of Title IT`Section 16-1.3,
Pitkin County Code (Land Use. Code) and Colorado Revised Statutes,
1973, 30-28-118(2) (C); and,
WHEREAS, based on the evidence presented, the Board of Adjustment
makes the following findings:
1. Proper notice procedures, including the
notification of all adjoining property owners,
has been shown by the applicant.
2. The required hardship or practical difficulty

Nicki Lee, a neighbor across the river from the Grenko's, supports
this request stating that this would be nicely done, and be
consistent with the look of the area.
Ostwald stated that he passes the property everyday and you would
not be able to see this structure from the highway during the
summer months.
After further discussion, Neiley moved to grant a 7 foot height
variance, due to topographic hardships, per the plans submitted,
as recommended in the letter from Jerome Gamba and Associates.
Shaffran seconded the motion and all were in favor.
Case #91-30 Miller, Gordon, Newfoundland Lode Minina Claim,
U.S.M.S. 5190
Shaffran stated that she has a oonflict with this case, so will not
be voting. Neiley was acting chairman. Randy Wedum was present,
representing Gordon Miller, to request a 90 foot front yard setback
variance, for construction of a single-family residence. Wedum
briefed the Board as to the location of the property and the
proposed location of the barn. Wedum stated that Miller wants to
use the existing road that is already cut and services two
properties. Wedum stated that the proposed site is the only
buildable site, therefore, the request for the setback.
Wedum showed the Board the actual site plan, with the building
envelope and the proposed location of the house. This site has
received a 1041 approval for the building envelope.
Neiley asked if there was any public comment and there was none.
After further discussion, Mathis moved to grant a 90 foot front
yard setback variance, for construction of a single-family
residence, due to topographical hardship, as on the plans
submitted. Guy seconded the motion. All were in favor.
Joe Wells was present, representing Mr. Ziff, to request a 45 foot
front yard setback variance, in the RS-20 zone district, for
construction of a barn, on a 73.6-acre tract, adjacent to the
Starwood Subdivision.
Mr. Ziff owns both sites that this variance would affect. Wells
also mentioned that an approval was just received from the Planning
and Zoning Commission for a lot line adjustment. Wells further
showed the Board what type of topography surrounds the proposed
barn location. This area is surrounded by 30~ or greater slopes
and they are trying to minimize the impact on these slopes. Wells
stated that Mr. Ziff raises native plants, which he uses on his own
property. These plants are grown in the area of the proposed barn

location, therefore, the proposed barn would be located near the,.

Guy further clarified that Section 16 1 3 states, "Whereby reason

Mayer's had an easement through the adjoining property for the
driveway and McCloud stated that they did.
Shaffran asked if there was any public comment and there was none.
After further discussion, Guy made a motion to grant a 21 foot west
sideyard setback variance, where 30 feet is required, for
construction of a garage, due to a nonconforming lot and a
topographic hardship. Ostwald seconded the motion and all were in
favor.
Raymond Pojman was present to request a 30 foot front yard setback
variance, where 100 feet is required in the RS-30 zone district,
for construction of a single-family residence.
Pojman stated that the lot is only 165 square feet, therefore,
believes this to be a nonconforming lot. Pojman also stated the
Architectural Review Committee at the Crystal River Country Estates
has signed off on his proposed plans. There is a hole already dug
on this property which Pojman wants to utilize for the foundation
of his proposed house.
Shaffran stated that the proposed house would be centered on the
lot. Shaffran asked for public comment and there was none.

where 100 feet is required, for construction of a single-family

construction of a proposed shed has been withdrawn per the
applicant.
The residents have just purchased the mobile home park. Guy asked
what the future plans were for the park. Guy Gervae, president of
the Homeowners Association, stated that they plan to go for a PUB
approval and change the zoning so that more permanent changes can
be made to the park. Gervae mentioned that the Homeowner's
Association reviewed Donze's plans and had no problem with what he
is requesting.
Schaffner mentioned that the zoning for that area is for lots of
15,000 square feet or greater. None of the lots located at Lazy
Glen fall within these guidelines, therefore, everything being
added not meeting the setbacks will have to be reviewed.
Shaffran stated that she would have no problem with the shed as it
is a better alternative to having equipment and items spread over
the property.
Shaffran asked for public comment and there was none.
For the first variance request, Guy moved to grant a 30 foot front
yard setback variance for an existing storage shed, where 30 feet
is required, due to nonconforming lot size. Shaffran seconded the
motion and four were in favor with Neiley abstaining.
The second request was discussed. Neiley stated that he had a
problem with this request since it would cause a zero lot line
along open space which should be available to the residents of the
park. Neiley believes that a homeowner should be able to access
the perimeter of their building on their property, not in open
space.
Donze mentioned that along the back lot line is an elevated berm
and is a totally unusable area. After further discussion it was
realized that there would be approximately four feet from the
addition to the lot line.
After further discussion, Guy made a motion to grant a 7 foot west
side yard setback variance and a 7 foot rear yard setback variance,
due to nonconforming lot size, for construction of an addition, as
per the plans submitted. Shaffran seconded the motion with four
approvals and Neiley denying the request.
Mary Kenney was present to request a 7 foot side yard setback
variance in the SR zone district, for construction of a proposed
addition to a mobile home.
