The sign Will be located in the front yard of the building. p ~v Y5 b,~:~.~P,' ~ b MEMORANDIIM TO: Amy Margerum, Planning Director FROM: Mary Lackner, Planner RE: Reichel Minor 1041 Hazard Review DATE: August 2, 1991 G ~ e,h vl ,~o ~ v~ ~r Issue: The applicant, Kirk Reichel, has submitted a request for a 1041'Minor Hazard review for a substantial addition to a single- family residence on a~lot approximately 22,500 square feet in size, zoned AF-1. The property is a metes and bounds tract, in Section 9, Township 9 South, Range 85 West and is also known as Little Texas Subdivision Lot 5, an unapproved subdivision. Access to the property is from Upper River Road to a private road easement serving the Little Texas lots: There is an existing driveway on the property to the building ,envelope. After reviewing the 1041 Hazard Maps, staff finds no 1041 Hazards within the building envelope and driveway, except .for Elk Winter Range. The property has slopes in excess of 30$ and floodplain hazards, which are not being encroached upon. The applicant has submitted an engineering report dated June 18, 1991 by Banner Associates which addresses the,. septic system steep slopes on the property. The recommendations'of these reports shall be adhered to by the applicant. If the applicant locates the addition within the building envelope as shown an'the site plan development will be outside of mapped hazard areas, except for Elk winter Range. Due to the existing residence on the parcel and the'"vicinity to other residences the Planning office recommends standard wildlife conditions. The applicant has sited the proposed building envelope so that it does not. encroach down the hilTs:de beyond the elevation of the neighboring properties. Attached is the site plan. Findings: 1) The building envelope and driveway access are located in an area which will not effect the floodplain. or steep slopes hazards on site. 2) The building envelope is within mapped Elk Winter Range. The ap'plicarit will need to meei~ the standard conditions of the Division of Wildlife. -,. _ ~~~ , _, , 3) The building envelope does not encroach down the hillside into slopes of more than 30$, or'beyond the elevation of the neighboring properties. 4) The County Attorney has reviewed the chain of title and ownership information for the subject lots and adjoining lots and has determined that merger has hot taken place. Recommendation: Sections 5-400.3(b) and 5-400.5(b) of the Land Use Code provide that the Planning Director is authorized to approve a site plan and application for a Minor 1041 Hazard Review. Based on the findings, Planning staff recommerids approval of the Reichel Minor 1041 Hazard Review and that the planning Director sign the site plan with the conditions of approval noted on the site plan. CONbITIONB OF APPROVAL: 1. All dogs shall be kenneled or leashed. 2. Native vegetation shall be maintained outside of the building envelope. 3. Fencing shall be 42" or less in height, 4 strand or less. 4. Utility extensions shall be placed under the existing road and driveway. 5. No development is permitted outside of the building envelope. 6. The recommendations of the Powell geologic report dated June 13, 1991 (Exhibit "A") and the Banner engineering. report dated June 18, ].991 (Exhibit "B") ' shall be adhered to by the applicant. ''Two riew'inembers were introduced -- John Wheeler and Rod Dyer.. Reichel were also present. Th'e Reichel's are requesting a 92 foot front yard setback variance, where 100 feet,',_is,required in the AF-i zone district for construction of a detached. re"sidential garage; and an 89 foot front yard setback variance and a 17 foot rear yard setback variance for construction of an addition to a single-family residence. Shaffran asked if the Reichel's had to go through a Minor 1041 Hazard Review. This was completed and a memo was submitted by Horn to the record dated August. 2, 1991, approving the bzl.ding envelope. ,.. ,. Horn briefed the Board on the area and the lay bf the land and how the rear of the house is near very steep slopes. Shaffran asked for. public comment and there was none. Gull and Neley both would prefer the Reichel's stay 10 feet from the front yard prop2rty line. The ]3eichel's stated that they would 'not have a problem moving the garage back 2 feety. After further discussion, Gu12 moved to grant a 90 foot front yard setback variance for construction of a detached garage, and an 89 foot front yard setback variance and a 17 foot rear yard setback variance for construction of an addition 'to a single-family residence, due to downzoning, per the plans submitted. Neley seconded the motion and all were in favor. Larry Yarber was present to request a 70 foot front yard setback variance and a 10 foot rear yard setback variance, where 100 feet and 10 feet, respectively, are required in the AF=1 zone,distrct; for construction of a deck to a single-family residence. 1 __ ._~ -- Schaffner stated that when the Yarbers previously came before the Board and were granted their request, Resolution No. 91-02, they were under the assumption that decks were not needed to be included in the setback requirement. Therefore, the Yarbers are requesting additional setbacks for the deck. Shaffran read the minutes of the January 8, 1991 meeting. Yarber stated that the deck is still within the approved building envelope. Shaffran asked if there was any public comment and there was none. After further discussion, Neiley moved to grant a 70 foot front yard setback variance and a 10 foot north side yard setback variance, for construction of a deck to a single-family residence, due to topographical hardships and downzoning, as on the plans submitted. Shaffran seconded the motion. All were in favor. Steve Swanson was present to request a 32 foot front yard setback variance, where 100 feet is required in the RS-30 zone district, for construction of an addition to a single-family residence. Neiley asked Swanson if he received any variances when the house was originally built. Swanson did not originally build the house and is not aware of any variances granted. Swanson stated that the house is about a football field away from houses on either side. Gull stated that the proposed addition would have the least impact on the setbacks and would have no problem with this request. Shaffran asked for public comment and there was none. After further discussion, Gull made a motion to grant a 32 foot front yard setback variance, where 100 feet is required, for construction of an addition to a single-family residence, due to downzoning, as per the plans submitted. Wheeler seconded the motion and all were in favor. Case #91-36, Powell, J. Dan, Lot "M", Little Texas Subdivision Dan Powell was present to request a 72 foot front yard setback variance and a 16 foot rear yard setback variance, where 100 feet and 30 feet, respectively, are required in the AF-1 zone district for construction of an addition to a single-family residence. Gull had a question as to how the numbers were calculated. The front yard was established by the access. Gull stated that the same guidelines should be used as in the previous case, Case No. 91-33, as the lot is about the same size. Shaffran asked for public comment and there was none. After a brief discussion, Shaffran made a motion to grant a 72 foot front yard setback variance and a 16 foot rear yard setback variance due to 2 w- down2oning and topographical hardships, as per the plans submitted. Neiley seconded the motion with all in favor. Philip Eastley was' present to request a 20 foot east side yara setbacx variance, where 20 feet is required in the AF-2 zone district, for construction of an additon,to,a single-family residence. Eastley submitted a picture of the lot and a letter to_the file, from, the Homeowners'Association approving his request. Neiley had the same concern .• Eastley. again told the_Board of the water surface problem 'in the area they want to build. Gull stated that he has no problem with the proposed location but with the zero lot line and the utility easement from which the Board cannot provide an relief. Neiley stated that he does not like ion zero lot line as he believes you should. be able to work on your structure without leaving your property. Neiley asked Eastley if he would have a problem moving. the addition 10 feet off the property line and Easley stated that "he could work with that. Wheeler stated that he does not see a'hardship to make it less than 20 feet from the property line. Shaffran asked for public comment and there was none.. Eastley inquired as to how a utility easement is provided. Gull stated that the utility easement is recorded by the subdivision and all-the deeds utilit ea eyed with this easement. Neiley stated that to change the are e ~ um cement, you would have to do a plat amendment. Neiley seconded the motion and it was approved four to one with Wheeler opposing. The minutes of the July 2, 1991 meeting were approved as written. Christensen and Schaffner asked the Board if they still wanted to receive the same information in their packets. After a brief discussion, it was decided that everything is still needed in the packet, but that three sets of building plans instead of eight would be requested of the applicant and brought to the meeting. Schaffner brought up the setback limitations that the Board has been abiding by for additions to trailers. It was decided to use 10 feet side to side as a standard. It was also agreed that with trailer parks, a plat needs to be brought in (not necessarily a certified survey), but some type of survey to show the distance from trailer to trailer. Christensen brought up the fact that everyone's termination date is the same, March 1, 1994. Temple Glassier, Administrative Assistant for the Board of County Commissioners, has stated that according to Article II of the Pitkin County Home Rule Charter, terms for all citizen boards shall be for two years. It was decided by the Board that Rick Neiley's and Evan Gull's terms will expire March 1, 1992, with Kandi Shaffran's, Stan Mathis' and Ted Guy's expiring March 1, 1993. John Wheeler and Rod Dyer, our new alternates, terms will expire July 1, 1993. The date of the September meeting was discussed since it would be the day after Labor Day. It was decided by the Board to keep it on September 3, 1991.
