Pitkin County July 10, 1991 .Board of Adjustment 506 East Main Street Aspen, CO 81611 Dear Sirs, As homeowners of a house and property at 0140 West Sopris Creek Road in Emma, we are planning an addition of approximately 600 square feet to our house. This addition will be to add a bedroom, a sunroom, a computer room, and to expand our existing narrow living room and dining room. We are requesting a 30 foot setback variance for the front (east) side of the house. We were granted a setback variance for this property in 1985. We will not he expanding outside of the existing 30 foot front yard setback variance approved at that time. According to the 30 PUD. Setbacks has the following East (front) West South North ?lanning and Zoning Office, require 80' on the front, setbacks: Approximately 80' Approximately 65' Approximately 275' Approximately 50' the zoning on our property is RS and 50' on the sides. The house We are planning to put on a 600 square foot addition to the south of the existing house, using current rooflines. The first 8' to the south is to expand the living and dining room, which are-very small. To the east, using rooflines of the existing front porch, we wish to put on a bedroom. (currently we have 3 bedrooms) and a computer room, which will be small. We will also be replacing the south wall of windows that were badly installed when the house was built, improving the energy efficiency. Because of the Wanner in which the existing .house was placed on our land we cannot expand the structure in any way without being in violation of one of the setbacks. The area was downzoned since the original hcuse was built and therefore we are forced to request a variance for any improvements. We feel the addition is desperately needed and will continue to improve the neighborhood. The house is currently approximately 1764 square feet, and the expansion will make the house approximately 2400 square feet, not a large house by any standards. The variance in question will still make the house over 70 feet from the property line, and at least 300 feet from the nearest house to the east. Discussions with the adjacent property owners show no problems tiaith the addition. Yarber stated that the deck is still within the approved building envelope. Shaffran asked if there was any public comment and there was none. After further discussion, Neiley moved to grant a 70 foot front yard setback variance and a 10 foot north side yard setback variance, for construction of a deck to a single-family residence, due to topographical hardships and downzoning, as on the plans submitted. Shaffran seconded the motion. All were in favor. Steve Swanson was present to request a 32 foot front yard setback variance, where 100 feet is required in the RS-30 zone district, for construction of an addition to a single-family residence. Neiley asked Swanson if he received any variances when the house was originally built. Swanson did not originally build the house and is not aware of any variances granted. Swanson stated that the house is about a football field away from houses on either side. Gull stated that the proposed addition would have the least impact on the setbacks and would have no problem with this request. Shaffran asked for public comment and there was none. After further discussion, Gull made a motion to grant a 32 foot front yard setback variance, where 100 feet is required, for construction of an addition to a single-family residence, due to downzoning, as per the plans submitted. Gull stated that the same guidelines should be used as in the previous case, Case No. 91-33, as the lot is about the same size. Shaffran asked for public comment and there was none. The minutes of the July 2, 1991 meeting were approved as written. Christensen and Schaffner asked the Board if they still wanted to receive the same information in their packets. After a brief discussion, it was decided that everything is still needed in the packet, but that three sets of building plans instead of eight would be requested of the applicant and brought to the meeting. Schaffner brought up the setback limitations that the. Board has been abiding by for additions to trailers. It was decided to use 1o feet side to side as a standard. It was also agreed that with trailer parks, a plat needs to be brought in (not necessarily a certified survey), but some type of survey to show the distance from trailer to trailer. Christensen brought up the fact that everyone's termination date is the same, March 1, 1994. Temple Glassier, Administrative Assistant for the Board of County Commissioners, has stated that according to Article II of the Pitkin County Home Rule Charter, terms for all citizen boards shall be for two years. It was decided by the Board that Rick Neiley's and Evan Gull's terms will expire March 1, 1992, with Kandi Shaffran's, Stan Mathis' and Ted Guy's expiring March 1, 1993. John Wheeler and Rod Dyer, our new alternates, terms will expire July 1, 1993. The date of the September meeting was discussed since it would be the day after Labor Day.
