On behave of the Wildcat Ranch I am requesting a variance for the building height of the Wildcat Boathouse located on the Ranch Cehter Parcel within the ~Idcat Ranch. I would like to give you a brief history of the Wildcat Boathduse as it relates to the approval of the Wildcat Ranch. The Wildcat Ranch was originally submitted for apprdval under the PUD guidelines. Upon receiving general approval from the Board of County Commissioner design work was started on the Nlildcat Boathouse. The building was to serve as a primary structure for the Wildcat Lake parcel. The building was designed in the same regional vocabulary used throughout the history of the ranch and the surrounding region. These buildings incorporated sloping roofs with attached porches or enclosed area. The roofs were designed steep to shed snow and rain. The Boathouse is a new addition to the historic buildings of the ranch, but wants to be a part of the ranch. It is therefore designed using this regiohal vocabulary to fit architectural character of the area. Duririg the approval process it was decided td change the application from a PUD to an Exempt Subdivision. The change in the application was made so the property would be more harmonious with the community. The change required the combining of the lake functions with the ranch functions into one long extruded parcel of lahd known as the Ranch Center ce heCountrfrCommi'v t esta'Dur~g thel entire alpproval process 9 was rppresry ted to tnsnter and Board y ssioners the Wildcat Ranch will contain these two rima functio The Pitkin County Code does not provide a use category for boathouses. Because of this lack of definition in the code the planning officials gave the boathouse an accessory building classification. This accessory building classification allows a maximum building height to the .mid point of the roof of 12 feet. Our building with its primary functions and historic architectural character has a maximum height of 18 feet to the roof midpoint. This is dver the height allowed for accessory buildings and under the maximum height of 28 feet for the primary building. The Wildcat boathouse functions classify it as a primary building should be allowed the higher height limit. The inclusion of electrical services, bathroom facilities, a kitchen and habitable space classifies the building as a primary function. The Wildcat Boathouse has always been represented as a primary functiohing building and as part of the property. We therefore respectively request you grant a variance for the building height of the Wildcat Boathouse. Shaffran asked if the sign itself was in conformance with the Code. Hedrick stated that it was. Hedrick showed the Board where the sign will be placed on the property. Hedrick stated that they have done extensive landscaping on the property and want to; include the sign into this"Alandscaping. Mathis asked if the sign was going to be lit. Height variances are i ~~'. !^~ also being requested at this time for this barn and another historic structure which is being relocated. They are being relocated on the Jefferies' parcel. Currently, they are within the 100 foot setback and are proposed to be relocated within the 100 foot setback. When buildings are being relocated, a new building permit is required and need to go through the same review procedure as a new building. These are accessory structures which exceed the 12 foot height limit. Mayer explained how the barns are being moved and where on the property. Shaffran asked for public comment and there was none. After further discussion, Shaffran made a motion to grant a 64 foot front yard setback variance, where 100 feet is required, for placement of a round barn and height variances as needed to maintain the integrity of the historic structure of the structures, as per the plans submitted. Mathis seconded the motion and all were in favor. Robert Smith was present representing the owner to request an 11 foot east side yard setback variance, where 50 feet is required in the RS-20 zone district for construction of a second floor addition to a single-family residence. Andy Hecht, attorney for the applicant, was also present representing the owner. Schaffner briefed the Board on the history of this case. Back when this house was first built, there was confusion as to what zone district this lot was located. Patsy Newberry confirmed for the applicant that it was an AF-1 zone and the house was designed to be 30 feet from the lot line. When it came in for actual review, Chris Conrad reviewed it and determined that this lot was RS-20, which has 50 foot requirements. The previous owner went to the Board of Adjustment (Case #88-28, under Lukins) and received a 20 foot variance which put them 30 feet from the lot line. The request before the Board now is for a second story above the existing footprint. There is no additional setback encroachment, just an increase in development within the setback. Valerie Byrnes, adjacent neighbor, was present to comment on this case, opposing this variance request. She submitted a letter to the Board stating the reason why she opposes this request. The letter was added to the file for record. Shaffran asked what the current square footage of the house was and Smith stated 5,500 square feet with a proposed addition to be 800 square feet, with a total 6,300 square foot house. Byrnes stated that she agreed'on the original setback because of a guarantee that no further development would be done and feels it is out of character with the other homes in the area. Byrnes stated tfiat she does not have a problem with them'expandng, but with them expanding up to a second` floor; even though there is presently a second story o21 part of the house. Byrnes stated that at the time of the original variance request, she was given the assurance that there would be no further development and that this was just three years ago. Neiley stated that there is a very limited area on this ,property that can be built upon with the letters from the two engineers clarifying this issue. Neiley also stated that he does not know what else an individual owner can do in a situation as this other than abandon their right to build because of the constraints on the property. Gull stated that the variance being requested is consistent with the way the Board has granted them in the past with the acreage of the lot matching the zone district. After further discussion, Mathis made a motion to grant an it foot east side yard setback variance, where 50 feet is required in the RS-20 zone district, "due to topographical hardships and the site drainage considerations on the site, as shown on the plans subiaitted. Gull seconded the motion and it past with four in favor and Neiley opposing. Bruce Hazard, from'Design Workshop, and Doug Graybill, from Hagman Yaw, were pressnt representing wildcat Ranch to request a 6 foot height variance, 'where 12 feet is required for an accessory structure per the Pitkin County Land Use Code, for construction of a boathouse. Hazard reviewed the request with the Board stating that this' height variance is for the boathouse to be built on the Wildcat Ranch. This boathouse is to be placed on the ranch manager's parcel and`is not the primary structure but an accessory structure. This structure was approved to include a certain amount of `habitable space for a common meeting area, a bathroom, and a small kitchen; and also to be used as a storage area for management of the lake. Shaffran asked for public comment and there was none. After further discussion, Gull moved to grant a 6 foot height variance, where 12 feet is required per the Pitkin County Land Use Code, per the plans submitted, due to unique conditions of the property not created by the applicant. Dyer seconded the motion and all were in favor. Shaffran moved to approve the minutes of the August 6, 1991 meeting. Gull seconded the motion and all were in favor. Schaffner asked the Board how they would feel doing a blanket resolution which approving development in Starwood building envelopes approved by the County and which lie within the front yard .setback. The Stanwood Homeowners Association would be making the application for this change and only for those lots where the building envelope lies within the setback. Schaffner talked this over with Tim Whitsitt, County Attorney, and he thought it would be a good idea. Every homeowner in Stanwood would be notified. The Board, after a brief discussion, stated that they would have no objection to reviewing such an application.
