amended, a Public Hearinq will be held in City Council Chambers,
City Hall, First Floor, Aspen, Colorado (or at such other place as

Dear Joanna and Board of Adjustment Members:
Attached is the required documents for submission to modify a previously approved
variance request to change the location of the proposed residence. In addition to those
documents that are required for submission I have included a copy of the original site
plan and an overlay to show where the new location is proposed. Also included is a copy
of the original letter explaining the basis for this request the contents of which are still
completely applicable and are the basis for this modification.
The new building location rotated the building in such a manner so as to have three
points of the building which extend across the 50' setback line and into the setback area.
Two of these points extend into the setback area approximately 15' and the third location
at the garage extends into the setback area approximately 20'. This compares to the
original design where a significant part of the building extended into the setback area by
30'. We have also slid the building to the northwest to better utilize the existing
vegetation as a natural screen from the adjacent property owners and the road below as
we indicated in the original submission.
Although there are more locations where the building crosses the setback line, each one
is smaller in magnitude, both in bulk and in distance. I believe that this solution produces
less of an impact on the adjacent properties.
I consider this revised solution a significant improvement from the original and I trust that
you will find the same. If there is any additional material you need to complete this
review, please do not hesitate to call.

The special conditions of this lot have created a:sltuatlon where

We believe that this request, if approved, wilt not adversely
impact any adjoining property owners.. It is consistent with
intent of the zoning regulations and is in the best interest of
Pitkin County as well as the Hoff's.

RESOLUTION NO. 91-53
WHEREAS, Dave and Ruth Hoff, owners of a tract.of land situated at
e.
portions of Lots 19 and 20, Section 9, Township 9 South, Range 85
West, requests a 20 foot rear yard setback variance, where 50 feet
is required in the R$-20 zone district, for construction, of a
proposed single-family residence; and
WHEREAS, the subject property is within the unincorporated area of
Pitkin County, Colorado (as described in Exhibit'""A", attached);
and, , :.
WHEREAS, the Board of Adjustment is vested with the power to grant
or deny such variances by virtue of Title II, Section 16-1.3,
Pitkin County Code (Land Use Code) and Colorado Revised Statutes,
1973, 30-28-518(2) (C); and,
WHEREAS, based on the evidence presented, the Board of Adjustment
makes the following findings:
1. Proper notice procedures, including the
notification of all adjoining property owners',
has been shown by the applicant.
2. The required hardship or practical difficulty
has been established.
3. Granting such relief will not cause„substan-
tial detriment to the ,public welfare and will
not substantially impair the intent and
purpose of the Zoning Resolutions and the
zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment, that a
20 foot rear yard setback variance, for construction of a proposed
single-family residence, be granted due to exceptional
characteristics of the lot, as per the plans submitted (Exhibit

Manchester, to request a 20 foot rear jra~d setback dar`iance, where
50 feet is required in the RS-20 zone district, for construction
of a proposed single-family residence.
Manchester stated that they were in front of the Board previously
in March of 19'9'6 `to'request a variance to save three large spruce '
trees. After this. original variance request was granted, they
found that the orientation of the building did not maximize the use
of those trees and wanted to slide the prbpo"hed single-family
residence back to utilize the trees to hide this home.
There was no public comment and all the adjacent property owners
have submitted letters into the file approving this request. This
change has made the proposed residence less visible.
After further discussion, Gull moved to grant a 20 foot rear yard
setback variance, where 50 feet is required in the RS-20 zone
district, due to exceptional characteristics of the lot. Mathis
seconded the motion and all were in favor.

Chuck and Marilyn Frias were'"ptesent to request a 12-1/2 foot west
side yard setback variance, where 15 feet is required in the R-30
zone district, for construction of a proposed residential garage.
Paul Patterson, president of the Meadowood Homeowners Association,
was also present.
Frias explained his existing house is attached to an historic cabin
which predates the subdivision's lot lines. Therefore, his house
already lies 'within the setback. He noted, however; that an

approximate 25 foot buffer exists between his lot line and the road
which reduces the visual impact from the right-of-way.
Shaffran read into the record a letter from Tom Lake, Aspen Valley
Hospital, stating that the Hospital has no objections to the
request made by the Frias'.
Gull stated that Frias is a client of his company and would prefer
to abstain from this case.
The other letters that were submitted from the neighbors all were
in favor of the request being made, stating that they prefer an
attached garage. Patterson stated that the Meadowood Homeowners
Association was unanimous on the plans submitted by the Frias' as
the proposed residential garage was less obtrusive.
There was no public comment.
After further discussion, Shaffran made a motion to grant a 12-
1/2 foot west side yard setback variance, where 15 feet is
required, for construction of a proposed attached residential
garage, due to downzonng, as per the plans submitted. Dyer
seconded the motion and all were in favor. Motion passed.

Shaffran moved to approve the minutes of the October 1, 1991,
meeting. Wheeler seconded the motion and all were in favor.
The meeting was adjourned at 5:45 p.m.
