SUBMISSION APPROVAL FOR THE BOOHER SUBDIVISION/PUD

RECITALS
1. Ed and Cherie Booher("Applicant') has applied to the Pitkin County Board of County
Commissioners ("BOCC") to grant a three month extension of the Conceptual Submission
approval for the Booher Subdivision/PUD to give the Applicant additional time to prepare the Final
Plat application.
2. The BOCC granted Conceptual Submission approval on January 26, 2000, pursuant to
Resolution No. 010-2000.
3. A Conceptual Subdivision approval is valid for one year from the date of approval. The
Land Use Code("Code")requires that the Final Plat application be submitted within that time.
Section 4-110-020 of the Code allows the BOCC to grant a one-time extension of the Conceptual
Submission approval,for a period of time not to exceed one year,if the Applicant demonstrates to
the BOCC that substantial action has been taken in reliance of the conceptual subdivision approval.
4. The property is more specifically described in Exhibit A.
5. The BOCC considered the request at its regularly scheduled meeting on March 14, 2001,
at which time evidence and testimony were presented with respect to this application.
6. The BOCC determined that the requested extension meets the criteria established in the
Code, and, therefore, found the extension to be appropriate.
NOW,THEREFORE,BE IT RESOLVED by the Pitkin County Board of County
Commissioners that it hereby grants an extension of the Conceptual Subdivision approval for the
Booher Subdivision/PUD until June 14, 2001, subject to the following conditions which shall run
with the land and be binding on all successors in interest:

1. The Applicant shall adhere to all material representations made in the application and
public meetings.
2. All conditions of Resolution No. 010-2000 shall remain in full force and effect.
3. The Final Plat application shall be submitted prior to June 14, 2001.
