Bloomquist, 818 Seventeenth Street, No. 420, Denver, Colorado 80202 LOCATION OF PROPERTY: Lot 15A, Block 2, Gateway Snowmass Mesa Subdivision, Filing No. 2, Pitkin County, Colorado ` DESCRIPTION OF PROPOSED VARIANCE AND JUSTIFICATION: The above-described real property is Iocated in an RS30-PUD zone which requires a 100-foot front yard setback for str etures. 'Applicants are proposing a reduction of the front yard setback re uiremenf to thirty feet. Such reductions have been routinely granted in th Gateway' of Snowmass Mesa Subdivision in the past. Although the County' oning'maps designate the Gateway of Snowmass Mesa Subdivision as RS30-PUD, because of the size of the lots and nature of the subdivision an R-30 designation would be more appropriate. The variance is requested by the Walshes as contract purchasers of the property. Miller seconded the motion. Pearson; Miller and Shaff'r'an were in favor. Dobrovolny abstained because he was notyat the meeting. Lacking a quorum for approval of the minutes, it was tabled until the next meeting. Shaffran checked with both applicants as to whether their signs had been posted. They both had posted their 'signs. Rick Neilley was present representing the Walshes with the permission of the owner, Charles W. Bloomquist, in accordance with a contract to purchase the lot, dated 6/18/87. The applicant was requesting a 70 ft. frontyard setback variance due to topographical problems. The lot slopes very steeply to the north downward to Gateway Road making it very difficult to build within the setback requirements. If they did place the house back 100 ft. they would effectively eliminate any solar energy benefit. He continued that ,he thought it was a common request for that area. He added that they did not have plans, they wanted an assurance that if they did purchase the lot that they could place the house up on the ridge, rather that down in the valley. He had no objections to the Board stipulating that the variance would be contingent upon the closing of the sale of the property. Dobrovolny moved to approve a 70 ft. frontyard setback variance, contingent upon the closing of the r_ontract between the Walshes and Bloomquist, due to topography. Pearson seconded the motion. The motion carried 4 - 0. Case # 87-32 - Margaret and Hillary Raab - 0289 Conundrum Road Gary A. Wright was present representing Robert Brown. He had entered into a contract with the Raabs to purchase: the hpme at 0289 Conundrum Creek. Douglas Allen was also present repre- senting the Raabs. In 1968 the property was sold to the Raabs. Wright submitted to the Board a copy of the survey that the Raabs had received when they bought the house. They had a survey 'done at a later date and found that their house was right on the lot ' line. The closest property owner was Ti'ttne Potthurst. Wright had spoken to her and her concern was that any construction should be on the northerly portion of the house. Wright had no objection to that, he felt it was the most likely location to add on and that it `should be a condition of the variance. Peter Carb~lly, a neighbor was present and concerned about the size of the addition and how it would affect his property. His property was along the left bank of Castle Creek. To make the house usable, it would need to be enlarged. He felt that the impact on Carbelly would be the same wherever the house ~ were located.
