Patsy Newbury was present with staff recommendations. Gull
called the meeting to order. 5haffran moved to accept the
minutes of 10/27/87 and 11/24/87 meetings as submitted. Pearson
seconded the motion. The motion carried 5 - 0. (Dobrovolny had
not arrived at this point in the meeting)
Gull explained to the Board that this case had been tabled from
the last meeting due to lack of a quorum. Gull explained the
options available to the Board. They could table the case to the
next meeting, discuss the case and then vote on it, listen to
tape of the last meeting and vote. Zanin explained to the Board
that he was familiar with the house. Pearson had been present at
the meeting so she quickly went over what the discussion had
been. They had thought the original zoning had required a 75 ft.
frontyard, although the current zoning requires 100 ft. They
also thought. that they since the garage would still be 75 ft.
away and it was the only appropriate place for a garage without
blocking the view. Zanin showed the Board where the road is and
thought that garage would be 100 ft. from the road. Shaf£ran
repeated that what had impressed her was that the proposed
addition had the approval of the Starwood Homeowners Association.
Pearson moved approve a 25 ft. frontyard setback variance due to
the possibility of downzoning and the .topographical hardship.
Dobrovolny seconded the motion. The motion passed 5 - 0.
Dobrovolny was the alternate voting.
Case # 87-47 - Grizzl Landsca in Robert Jensen 21901 W. Hw
82.
Robert Jensen was present. He .was requesting to place a 2-1/2
ft. X 9 ft. sign, larger than allowed by code. The justification
was that many signs in the 200 ft. setback are larger than
allowed. Jensen explained that he wanted to place a sign of a
reasonable size to identify his business. He felt the smaller

;~' signs were dangerous and stated that he frequently heard people
slamming on their brakes 'trying to read the Boise Cascade sigh'.
Gull read into the record a letter from John Mc&ride re uestin

The Board felt that was a significant safety issue.' Gull"didn't
think that was true of Grizzly Landscaping. Zanin pointed out
that Boise Cascade had wanted a larger sign and had been"`'turned
down. Lynn Hancock was present representing the"Arpor"t 'Busine'ss
Center and John McBride. He said that McBride had no specific
comments other than he felt the sign code was good as it was
written and should be adhered to. After some discussion,
Dobrovolny pointed out to Jensen that the type of traffic he
would be likely to get would be similar to the traffic at Boise
Cascade, local patrons who of"ter they found the location once,`
would know where Grizzly Landscaping was "located." Pearson moved
to decline the application for the enlarged sign because`'t
exceeds the code. Shaffran seconded the motion. Brooke Peterson
asked if they would take a second vote regarding the placement of
a sign that conforms to the sign code. Gull replied if that was
what the applicant wished'. Jensen stated that he would like to
change the application to request the variance for a sign that
meets code, a six sq. ft. sign. Pearson withdrew her 'motion 'and
applicantwat6dsew ftr second. Shaffran moved'to grant the
q. gn according to code. Zanin seconded`the
motion. The motion carried 5 - 0. Miller was the alternate
voting.
Zanin moved to adjourn. Pearson seconded the motion. All were
in favor.

WHIiREAS, the subject property is within the unincorporated area
of Pitkin County, Colorado; and,'
WHEREAS, the Board of Adjustment. is tested with the Bower to
grant or deny such variances by virtue of 'Title "TT", S'e"ct"ion
16--1.3 Pitkin Count code Land Use Code and'CoYorado Revise;
Statutes, 1973, 30-28-118{2) (6}; and,- ) d
WH£REA5, based on the evidence presented, the Board of Adjustment '
makes the following findings:
1. Proper notice procedures, including the
notification of all adjoining property
owners, has been shown 'by the applicant.
2. The required hardship or practical diff5cul;ty
has been established.
3. Granting such relief will not'cause substaxr-
tial detriment to the public welfare and will
not substantially impair the intent_an'd
purpose of the Zoning Resolutions and 'the
zoning maps. -
NOW, THEREFORE, BE N T RESOLVED that the applicant's request for
the placement of a 6 ft. sign which complies with the code.
Additional conditions or restrictions:
WARNING: Any violation of the terms of this resolution may
result in rehearing and possible revocation.
