RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF P1THIN COUNTY,
COLORADO, REMEDIATING THE TAHING FOR THE SAWMILL HILL PARCELS 2, 4, 5, 6

RECITALS
Peter Martin and Cecil & Christine DeLoach ("Applicants"), applied to the Boazd of County
Commissioners, (`Board"), pursuant to Section 2-20-150(b) of the 2006 Pitkin Counry Land Use Code
("Code"), to amend language of a previously approved Board Resolution to extend the time of reliance on
conditions of approval.
The application was received after July 6`h, 2006 and therefore is reviewed under the 2006 Land Use
Code.
2. The property is zoned RS-30, and the lots each exceed 30 acres.
3. The parcels aze located in Redstone, and aze described as pazcels 2,4,5,6 of Sawmill Hill (Legal
Description, Exhibit A). The pazcels were approved for development through a taking remediation in
2002 (Res. No. 116-2002).
4. The Boazd heazd comments and testimony on the request at a regulaz meefing on November 19,
2008, and found that remediation for the taking could be accomplished through a purchase of the
parcels. The purchase also includes Sawmill Hill Parce17, which was not part of the original Taking
proceeding and purchase and/or conservation of two adjacent parcels in sepazate ownership, Sawmill
Hill Parcels 1 and 3. The purchase of a117 parcels includes the issuance of 6 TDRs to the owners.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
THAT, THE remediation for the taking of Sawmill Hill pazcels 2, 4, 5, 6 is accomplished through the
purchase of the property per BOCC Ord. No. 03l-O which includes the provision for 4 TDRs to be issued
to the owners of Pazcels 2, 4, 5, 6, 7(DeLoach, Martin). In addition, two TDRs will be issued to the owners
of Parcels 1 and 3. AND BE IT FURTHER RESOLVED THAT BOCC Res. No. ll6-2002 is hereby
rescinded.
