AMENDING PITKIN COUNTY CODE SECTIONS 10.16.010 AND 10.16,020
CONCERNING AIRPORT LANQING FEES

RECITALS
1. Pitkin County ("County") owns, operates and sponsors the Aspen/Pitkin County
Airport ("Airport").
2. The County has authority to set, charge, collect and enforce rents, fees and
charges for the occupancy and use of the Airport, pursuant to, inter alia, Sections 49~4-
101 et seq., 30-11-107, and 30-35-202, 1973 C.R.S., as amended, the Pitkin County
Home Rule Charter, as amended, and the Pitkin County Code, Title 10, Airport
Regulations, as amended.
3. The County has historically set Airport landing fees by ordinance amending
Pitkin Cour~ty Code sections 10.16.010 and 1 Q.16.020 concerning airport ianding fees.
4. The County desires to set landing fees by resolution rather than ordinance
because resolutions become effective upan adoption whereas ordinances do not
become effective until thirty (30) days after publication following final adoption.
NOW THEREFORE BE tT ORDAtNED by the Board of County Commissioners of
Pitkin County, Colorado that:
1. Section 10.16.010 of the Pitkin County Code is hereby repeaied and reenacted
as follows:
"Landing fees. Landing fees may be established from time to time by
resolution of the Board of County Commissioners."
2. Section 10.16.Q20 of the Pitkin County Code is hereby repealed.
3. This Ordinance shall be effective on and after August 1, 2007 so that the
landing fees previously set in sections 10.16.Q10 and 10,16.020 of the Pitkin County
Code will be repealed on that date and replaced by landing fees with an effective date of
August 1, 2007established by resolution prior to that date.
