HomeMy WebLinkAboutbocc.ord.017.2001 AN EMERGENCY ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO PROHIBITING BICYCLE USEAGE ON LOWER RIVER ROAD (CR# 16), BETWEEN THE HOURS OF 6:30 A.M. TO 5:00 P.M., MONDAY THROUGH FRIDAY,HOLIDAYS EXCLUDED, FROM MAY 15,2001 TO NO LATER THAN NOVEMBER 1, 2003 Ordinance No. 0/` - 2001 Recitals 1. Beginning May 2, 2001, the Colorado Department of Transportation and their contractors will open a detour on Lower River Road (CR# 16) for the purpose of directing all downvalley traffic from SH 82, between the hours of 6:30 a.m. to 3:00 p.m. This will make Lower River Road one of the most heavily traveled roads in the county. 2. Pursuant to C.R.S. §42-4-109 (11), the Board of County Commissioners shall have the power to prohibit any bicycle, animal rider, animal drawn conveyance, or other class or kind of nonmotorized traffic which is found to be incompatible with the normal and safe movement of traffic. 3. The Board of County Commissioners has determined that there will be unsafe conditions if any bicycle traffic were allowed on Lower River Road during this detour and bicycle traffic would be incompatible with normal and safe movement of vehicular traffic. 4. The Board of County Commissioners finds that the Rio Grande Bikepath is a suitable path on which to redirect bicycle traffic during the prohibition, and that the Rio Grande Bikepath is parallel to and within four hundred and fifty feet (450') of Lower River Road. 5. The Board of County Commissioners hereby directs that the appropriate official signs prohibiting bicycle traffic from using Lower River Road (CR#16) be erected. 6. It is necessary for the immediate health, safety and welfare of the health of the citizens of Pitkin that this prohibition be enacted NOW THEREFORE, BE IT ORDAINED, that the Board of County Commissioners of Pitkin County, Colorado, does hereby prohibit all bicycle traffic on Lower River Road (CR #16) from May 15, 2001 to no later than November 1, 2003. The hours of the prohibition shall be from 6:30 a.m. to 5:00 p.m. Monday through Friday. Holidays shall be excluded. This emergency ordinance is effective immediately.
