Building Inspector has advised that the AF-1 Toning category provides for

on Drawing submitted to the Building Inspector. In support of this
Application, it is submitted:
1. Please refer to attached copy of letter to Building Inspector
dated Nov. 24, 1976 and Dec. 78, 1976.
2. This Coal Dryer :is located immediately adjacent to and has about
the same height as the presently operating Coal Dryer which was constructed
several years ago. Both Dryers are an integral part of the Coal Preparation
Plant, which was built and has been operational for many years. The
Preparation Plant, storage bins and other facilities exceed the height of
the Dryers. The Plant is located in a valley in Coal Basin on the 160 acre
tract of land belonging to this Company, adjacent to National Forest. No
visual or other disturbance is created by the new Dryer. Safe design in
accordance with Federal regulations necessitate this Dryer height.

RESOLUTION N0. 78 - ~~
RE: Mid-Continent Special Review Use Permit
4JHEREAS, Mid-Continent Coal,and_Coke Company (hereinafter referred to
as Mid-Continent) has received special review approval subject to certain
conditions for a min ng operation in the Coal Basin area of the Crystal ,
River Valley, which approval was made pursuant to BOCC Resolution 77-60,
and
WHEREAS, said resolution, paragraph 21 b, provides for an annual
hearing for review of compliance with the Special Review Permit and further
provides that P1~d-Continent and the Board shall select a date on or before
February 15 of each year, and
WHEREAS, the Board recognizes certain problems with this date inasmuch
as it is during the winter when site inspections are infeasible and does
not permit review of work accomplished toward revegetation and other matters,

therefore, the Board wishes to amend the date. of saki a
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
that paragraphs b and c of Resolution 77-60 be. and hereby are amended as
follows:
b. Annually, Mid-Continent and the Board shall elect a date for a
public hearing to be held on or before November 15, and publish`
public notice thereof, at which hearing the Board shall review
F1d-Continent`s operations on or relating to the Lands and shall
give the public an opportunity to comment thereon. At the conclu-
sion of such hearing the board shall determine whether Mid-Continent
has substantially complied with the terms of this permit and, if it
has not, the Board may issue a cease and desist order and otherwise
follow the procedures set forth in paragraph 21 (a) hereof. The
Board has the right to waive the holding of the annual hearing.
c. The public hearing shall include report and testimony from the tas
force established through Section 20 of this Resolution ~' The task
force shall make a site inspection and review curren -~rogram pro
gress within the six weeks prior to the hearing.

adjacent to the 'northerly boundary of our 160 acre tract.

I. INTRODUCTION
On July 2, 1976, the United States Environmental Protection A-

basis of the information 17sted in Appendix 1.

On November 8, 79'76, information about the selected control de-
` vice was received from Dorr-Oliver, Inc. Review of this information

` 1) The emission tests on a pilot scrubber at the existing Mid-
Continent thermal dryer were inconclusive in determining what pressure
drop was needed to meet, the NSPS.
' 2) The proposed air pa7lntien control device was the same Ducon
size. 80/162 type VV0 venturi scrubber originally proposed to meet 0;1„
grains/dscf.r Operation of the scrubber would be changed by restricting
the venturi throat and adding a 6 inch thick demister pad. The pres-
sure drop acrgss the scrubber would increase from 12 to 20 inches W.C.,

EPA was not convinced that the proposed control equipment would
operate within the applca~Te NSPS limits for thermal dryers of 0.031
grainsJdscf. This belief was based on information acquired during
the development of NSPS for thermal dryers a.hd reported in the doc-
ument, "Background Information far Standards of Performance: Coal
Preparation Plants." Concurrence of this tielief was made by EPA per-
sonnel who helped develop the NSPS and prepared the background docu-
meet. Therefore, EPA had no choice but to conclude that the proposed
control device was not Best Available Control Technology (BACT).
It was brought to EPA's attention through public comments dated
November 15, 1976 that Mid-Continent had alre

consisted of a Consent Decree vahich was signed by United States Dis-
trict Mudge Sherman G. Fnesilver on December 25, 1976.

II. FIWDINGS
On file basis of the information listed in Appendix 2, EPA has de-
termined that:

These findings are based upon the analyses listed in Appendix 2.
III. CONDITIONAL AUTHORITY TO CONSTRUCT AND OPERATE
On the basis of the findings set forth ih II above, a.nd pursuant

posed new thermal dryer near Redstone, Pitkin County, Colorado, Section

a. The source shall not cause to be discharged into the atmos-
phere any gases from the new thermal' dryer which are in violation of
40 CFR 60.252(a) (e.g.> contain particulate matter in excess of 0.031
grains/dscf or exhibit 20 percent dpac~ty or greater) as promulgated
on this date.
b. Performance tests of the thermal dryer shall be conducted
pursuant to the provisions of 40 CFR 60. T, 60.8, a.nd 60.254. EPA
Reference Method 9 shall be used for the opacity measurements. Re-
salts of the performance tests ,shall be submitted to this Regional
Office within 30 days after tests are conducted.
c. The ov+ner ar operator shall continuously monitor equipment
operation as specified in 40 CFR 60.253. Continuous retarders shall
be used to record the pressure drop across the venturi constriction
and the water supply pressure. The dryer exhaust temperature shall
be recorded at least every hour. The owner or operator shall main-
tain records of all measurements, including continuous monitoring
equipment measurements; all monitoring device calibration checks;
and adjustments and maintenance performed on these devices iii per-
manent form suitable for inspection. The file shalt be retained for

a.ll provisions of the Colorado State Implementation Plan, 40 CFR Part
52, Subpart G, nor of the respensibiTity for compliance vaith a.ll other
applicable Federal, State, or local regulations.

Supplementing Application for Building Permit
for. the Thermal Dryer addition to our Coal Preparation Plant
in Coal Basin, about four miles_iaest of Redstone in the
SWq of Section 11, Tp. I0 S., R. 89 W. of the 6th P.M., I
request exemption. under 10.02.05 (a) (4) from requirements
o£`Secfion 10.02.03`(b) of the `Pitkin County Land Use Code
for the following reasons:
1. The Thermal Dryer is an integral part of the
Coal Preparation Plant which was built and, has been in operation
for over 10 years and 9_s acces'sory to and supplemental to
the existing Coal 'Dryer that has been in use for the past
several years. The 'Coal Preparation Plant combines a series
of proCes'ses whereby coal mined from the five mines' in Coal
Basin is mechanicallg cleaned and prepared for shipment
according to coki:nq coZl specifications. Nothing new in
the way of processing is being added' to the Plant, only
an enlargement of drying capacity. The 'existing dryer and
the new addition will kle,'operated from the same 'control
panel and will be used' alternately or interchangeably.
The 'combined drying capacity of the 'two Dryers will exceed
the Plant requirements. While the 'present Dryer is inadequate
to evaporate the''required amount ofwater, £he.'two Dryers
will exceed evaporation requirements and it is intended
that the 'new Dryer may be 'operated while 'repairs end maintenance
are occurring on the 'existing Dryer.'
Thus, the 'Coal Dryer fits into the 'exemption
category under 10.02:0~(a) (4) providing exemption for
"accessory structures not intended for human habitation

3. The Coal Preparation Plant, including the
Dryer addition is sited on land owned by Mid-Continent
Resources, Inc., dba Mid-Continent Coal & Coke Company and `
surface water drainage from the Plant site is collected and
carried into sedimentation pond's with p"rovison for"'over-~ ~ '
flow and discharge into Coal.Cree'k under EPA Permit No.
CO-0000396. The Coal Preparation Plant has a closed
curcuit water system without discharge into any stream.
4. It is recognized' that the 'Building Permit
will be subject to compliance 'with State and Federal-Air
Emission Standards. Applications for these ;have been filed,
Public Notice has been given, the comments period is closed,
and both the EPA and the Air Pollution Control Division of
the Colorado Department of Health are actively processing
these applications. Mans, specifications, design and
criteria have been submitted and have been under continuing
evaluation for the 'past several months by both agencies'.
