1. The Topographic Map for Lot 34 shows the ;previously approved subdivision
rear Setback line to be six feet off the rear property Brie, with an,..,

County setback lines. During our discussion$_with the Snowmass Design Committee,
the design concept for this house was explained as an attempt to create

The Preliminary Plan approved by the Committee showed the house and .deck within
the County setback lines; in our discussion, of fhi's~splan the"suggestion was
made that the County had been allowing cantilevered decks to project over the'
setback lines and this. being 'the case tfie~Desgn`Commttee was also'allowng
a maximum four-foot projection; furth`er`;`"since 'the "rear lot `lines of`-Lots 33, '`
34 and 35 abut Forest Service"rand, no homeowners would be affected along the
South@ also,: the existing houses on lots`33 and 3~ are set respectively to the
east and west sides of their lots maximizing visual separ"ation between houses.,.
No views would be affected on'the house`s across Forest Lane on Lots 41, 42 and
43 since their principal views are to'the North, away from Lot 34:`
The F,na1 Plan was slabmitted.and ,approved on-Pay 17, 1977, showing the revised
Plot Plan.
2. A foundation permit was issued by the Building Inspector the end of May,
1977, `and the £oundaton'work has been. completed. The Building Inspector
later .issued the Builaing'Permt conditioned on removing the deck overhang,
unless' a varience was granted for the cantilevered portion. Subsequent `
discixssions with the Buil~irig"Inspector iridicate3`tTe Department cebuld not
object to oUr appeal £or thin varienc~ c`o7is"ideririg the conditions of the adjacent
