GRANTING FRONT YARD SETBACK VARIANCE
Resolution No. 08 -2008
WHEREAS, John and Lea Vasten, owners of 24413 Frying Pan Road, are requesting a 47 foot
Front Yazd Setback variance for the replacement of an existing roof; and
WHEREAS, 50 feet aze required; and
WHEREAS, the parcel contains 6.96 acres and is located in the AR-2 zone district; and
WHEREAS, the property is described in Exhibits A-1 and A-2; and
WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by
virtue of Title II, Section 7-10.30, Pitkin County Code (Land Use Code) and Colorado Revised
Statutes, 1973, 30-28-118(2) (C); and
WHEREAS, based on the evidence presented, the Boazd of Adjustment makes the following
findings:
1. Proper notice procedures, including the notification of all adjoining property owners, has been
shown by the applicant.
2. The required hazdship or practical difficulty has been established.
3. Granting such relief will not cause substantial detriment to the public welfaze and will not
substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Boazd of Adjustment, that a 47 foot variance be
granted for the replacement of an existing roof as shown on Exhibit B, as the setback was created
after the construction of the original structure and due to a rezoning subsequent to the construction
of the original structure
WARNING: Any violation of the terms of this resolution may result in rehearing and possible
revocation.
The Resolution was adopted by vote of the Boazd of Adjustment of the County of Pitkin, State of
Colorado.

July 1, 2008

McAllister opened the meeting at 536 pm.
CASELOAD:

24413 Frying Pan Road
John and Lea Vasten were present to request a 47 foot Front Yazd setback variance where
50 feet is required on this 6.96 acre pazcel in the AR-2 zone district for the replacement of
an existing roof.
The Affidavit of Posting was submitted. There were no members of the public present to
comment on this application.
The Vasten's explained that they purchased this house in December of 2007. Due to a
fire on February 28, 2008, they need to rebuild a portion of the house. The original house
was constructed in the 1880's and there aze several existing problems with the roof
structure. The Vasten's are requesting to replace the roof, add a new ridge beam and a
new 6" post within the setback, to support the ridge beam. A variance is necessary for
this work as the front portion of the home ah•eady extends 2 to 3 feet into the 50 foot
setback.
Brewster-McLeod pointed out that the variance request is fora 3 foot setback variance,
not a 47 foot setback variance. The new setback will be 47 feet from the lot line.
Schaffrier concurred.
Throm made a motion to approve the application due to strict application of the zoning
code resulting in undue difficulty for the applicant. McAllister amended the motion
stating that because the setback was created after the fact the hazdship was due to down-
zoning. Head seconded the amended mofion and it passed 5-0.

During the May 6, 2008 Boazd of Adjustment meeting, a 9 foot 6 inch front yard setback
variance was granted for this .23 acre lot in the VR zone district to allow the expansion of
an existing deck, due to an unusual situation or condition of the property. However, two
new dormers proposed to be located partially within the front yard setback, were not
mentioned in the application. Head asked if there were public objections. Schaffner
stated there were not. The dormers were unanimously approved by the boazd, based on
the same hazdship.
#07-2007 Caine
60 Wildwood Lane
During the December 4, 2007 Boazd of Adjustment meeting, a 13 foot reaz yard setback
variance was granted for this 4.55 acre pazcel located in the AR-10 zone district, for the
construction of asingle-family residence due to topographic and avalanche hardships.
The location of the house has been adjusted, resulting in a reduced encroachment into the
setback. The reduction of encroachment into the setback was unanimously approved by
the Boazd.
OTHER BUSINESS:
There was a request made by Schaffner to hold the August meeting on August 7, 2008
rather than August 5, 2008. This request was granted by the boazd -all board members
were in agreement.
MINUTES:
Head made a motion to approve the minutes from the May 6, 2008 meeting. Brewster-
Mcl,eod requested that the minutes be changed to indicate that Vince Coglin was the
owner's representative and not the owner's azchitect. Head approved the minutes as
amended. Throm seconded the motion and it passed 5-0.
There being no further business before the Boazd, the meeting was adjourned.

To Whom It May Concern:
We bought this home in December 2007 and due to a fire on the back portion (bathroom
and laundry area) which occurred February 28, 2008, we aze needing to rebuild. At the
same time we need to install a new roof structure. Over the course of this winter it has
been apparent there are several problems with the roof structure ie. ice damage,
inadequate insulation, questionable snow load and leaking. Many additions have occurred
since the 1890's when the original structure was built. We feel a major portion of these
problems can be corrected with adequate roof pitches and increased insulation. In order
to accomplish this we are proposing to restructure the roof but understand we must have
a vaziance to the 50 foot front property line setback. Please refer to SITE and you will
see where the existing detached garage presently extends approximately 25 feet into the
50 foot setback. The front portion of the existing home also extends 2 to 3 feet (including
the 13 inch awning) into the 50 foot setback. E 1.2 illustrates this as well as how the
home sits on the lot in relation to the 50 foot setback In order to build a more efficient
"cold roof' with better insulation and more adequate roofpitches, we need to raise the
main ridge beam of the home by 3 feet. By raising the roof from 25 to 28 feet, we will
only be adding to the attic azea, not creating an upper level living area. This will create
more upward mass. To support this ridge beam, we will need to seta 6 inch post which
will be within the 2-3 foot present encroachment in the area already extending into the 50
foot front setback as shown in P 1.2 and P 1.5. Please refer to E 1.3 for the existing south
and east elevations where you will see the roofs aze mostly flat with very little pitch. P 1.3
shows how we aze wanting to raise the roof pitches to create the "cold roof' and try and
eliminate the problems we had with snow and ice buIld up. There is currently NO
insulation on the flat roof over the existing living room and we certainly want to correct
this and make it more energy efficient.
Your considerations in granting the variance will be greatly appreciated.
