Dottie Fox - Voting alternate Carl Nutzhorh Raymond Auger Smuggler Illountain/Access Variance 'This vara.hce application was postponed from the August 27th meeting. Jim Moore, Attorney, expressed-concern as to since a the Board of Adjustment has ,7urisdlction for this variance. Nick McGrath, County Attorney, stated that typehofccess has not been threatened the Board has authority to grari't the variance if they deem it ~appropr'~iate. however, if the property was sold, the Board cannot guarantee the new owner will have access as this is not a part of the written deed of the property. This variance only grants access until challenged. The. Board discussed the application for access . ~ ~,- X~. variance and decided to delete the words "grant an easement ' variance to said Auger". (See attached) Dick 'Parker made a motion to grant a variance with the appropriate deletions. _~ or. Sotmovedox and Frank Smotherman seconded,. All in fav Jack Holst Lot 22, Eastwood/Setback Variance Jack Holst presented his request for a setback 6ariance to rough over a deck for a 2 car platform. The Building Permit was denied because the platform does not meet setback var- .... 'ince. There is a physical problem in having a structure nett to' a road in that it could interfere"with road right- _,. ~. ~ ~ ...,. r~ .~ of=way and snowplowing.. It was mentioned tlia£ it could be an asset to snowplowing as the platform will keep two cars off the side of'the road. Frank Smotherman made a motion to grant the variance. lIenry Stein seconded. " Prince of Peace Chapel/Sign Variance The sign proposed is to be placed across the road leading to the Chapel from the Castle Creek,Road. This sign exceeds the height li.tnit, the square footage limit and would inter- fere with snowplowing of the road. As they already have an identification sign, Dick Parker made a motion_ to deny the variance as presented. Dottie Fox secohded, All in favor. So moved. , Var'9.ance_ ___ _. .,..,~ ,_.,_~~. ~. ..~,~, ~-.._ ~_. ~ ~~ The Little Texas Subdivision was a legally platted subdivision before the area was zoned which makes i;hese lots legal non- conforming kits suitable for single family dwellings. How- , ever, the lots are so small (1/2 acre) that a housA cannot be buili; on the lots without violating the setback ordinances. The cabin planned for Lot 21 is to be 26' wide which leaves only a 24L' margin and a 25' front margin as opposed to a . g, g ~ p g ation. Tony Mazza, who represents Capital Improvement Corp. requested by telephone call to Hal Clark, a special meeting which was tehatively scheduled the meeting for mid= or Late October to present his arguments fox variance concerning his lahd west of Buttermilk which had been rezoned. His building permit was being reviewed at the time the down zoning went into effect. Shortly after the down zoning the permit was denied because it was no longer zoned for the purpose he had applied for. If the,presehtation is to be lengthy, Bi11 Mason suggested that the board be given copies of the application a week in advance so that they would have time to study it.` Then, in- stead of Mr. hIazza reading. the document to the Board, a copy could be submitted for the records.
