Pursuant to Section 2-20-150.6 of the Land Use Code, Thomas and Lucy Danis ("Applicant") have applied to the Community Development Director of Pitkin County, Colorado ("Director") to amend the prior approvals as follows: A. Establish an activity envelope between the building envelope and the barn envelope [o encompass existing landscaping, lighting, parking, walkways, fire pit, and play equipment; B. Eliminate the reference in the growth management covenant to use of the secondary access for emergency access; and C. Amend the growth management covenant to accommodate paving of the driveway. 2. The property is located at 1900 Snowmass Creek Road, and is described as Parcel 1, Twin Creek Ranch Subdivision Exemption. 3. The property contains 24.340 acres and is anon-conforming size parcel in the RS-30 zone district. 4. The BOCC approved the 1041 hazard review and special review and GMQS exemption for a TDR receiver site for Parcel I, pursuant to Resolution No. 98-244. Approval was granted to use one TDR on the property to permit up [0 5,000 square fee[ of floor area. Resolution No. 98-244 was subsequently amended by BOCC Resolution No. 99-142, and Administrative Decision Nos. 99-71, 99-74 and 056- 2001. The 1041 site plan was recorded in Plat Book 50 at Page 28; a revised site plan that depicts the relocated barn envelope was recorded in Plat Book 52 at Page 28. The BOCC approved the use of one additional TDR on the property to develop up to 7,500 square feet of floor area, pursuant. to Resolution No. 022-2002. The BOCC subsequently granted a growth management allotment for 3,250 square feet of additional floor area (total of 8,250 square feet), pursuant to Resolution No. 081-2002; a Covenant memorializing the commitments made in the growth management application is recorded as Reception No. 486410. The Covenant includes the following provisions: A. Paragraph 2.d: The access road from Snowmass Creek Road to the barn and residence will not be paved. B. Paragraph 2.g: The Partnership shall take to action to restrict the use of the historic access through the adjoining property (Twin Creeks Ranch Parcel 2) for emergency purposes. 5. The Director finds that the proposed activiTy envelope complies with the applicable provisions of the Land Use Code. 6. The Director further finds that proposed changes to the Covenant would not have changed the scoring of the application or the granting of the allotment for additional floor area. The Basalt and Rural Fire Protection District finds that the existing access complies with their requirerents, and [hat a secondary access is not necessary, and that a paved driveway is acceptable and exceeds their requirements for an all weather surface. The Director further finds that the proposed amendments will not change the use of the proposed development or the basic character of the land, are consistent with action taken during the original review, do not increase off-site impacts or the allowable floor area, and will not endanger the public health, safety or welfare. THE DHtECTOR DOES HEREBY APPROVE the Danis Minor Amendment to a Development Permit, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. All conditions of BOCC Resolution Nos. 98-244, 99-142 and 022-2002; Administrative Decision Nos. 99-71, 99-74 and 056-2001; and the Growth Management Covenant recorded as reception #486410, shall remain in full force and effect, except as amended herein. 2. Within 60 days of the date of this approval, the Applicant shall be required to submit for approval by the County Attorney and Community Development Department an amended Site Plan and an amended Growth Management Covenant. The above referenced approvals shall be a condition precedent to finalization and recordation. The mylar copy of the site plan must be signed by the owner prior to submittal for recording. The site plan shall be amended as follows: A. Change the title to "Danis Second Amended 1041 Site Plan." B. Change the Certification of Ownership from "Bankcenter One Partnership" to "Thomas and Lucy Danis", and included signature lines for both owners. C. These drawings were submitted by Richard Camp Landscape Architecture for our review. I offer this letter to be attached as documentation of the Fire District acceptance of the plans to the permit set along with information regarding the sprinkler system for the addition. It is our conclusion that these drawings are consistent with our conversations with the Danis's and his staff some time ago. The road depiction is consistent with the Pitkin County asset management plan at the time of the original permit with general locations determined for the two pullouts. The final location details will be determined in the field by Mr. Danis's staff in conjunction with the Fire Official. The plans also show a dry hydrant system plan and location acceptable to the fire district. These plans listed as L3.0 and L3.1 with revision dates of 2-26- 2007 meet approval and Catherine will attach them to the original permit set. Along with the access construction the addition to the main home is required to be sprinklered meeting the 13-D standard and the policies of the Basalt Fire District. A 2000 gallon storage tank already exist in the present dwelling's sprinkler system that was previously designed to incorporate this addition. This storage for the most part should cover any potential design scenario. The sprinkler designer will need to evaluate the existing pump systems capability to meet the demands of the new addition. The storage tank has also been previously designed to incorporate a separate pump by manifolding off of the existing system to meet the new sprinkler demand criteria if needed. The fire district can be contacted at the El Jebel Station 970- 704-0675 for rough in and final inspections of the roadway with pullouts, the sprinkler system and the dry hydrant assembly as applicable. During our conversation with Mr. And Mrs. Danis I understand that they would like to offer their premise toward civic functions that benefit the community. In my initial contact with Landscape Architect Richard Camp and County Staff, we discussed acceptable turnarounds for fire district vehicles toward a revised access plan. The details of the plan and our understanding of site concerns including dissolution of the secondary access were chronicled in my first letter dated 10-02-03, ("To Quote; The dual access is absent and we are in the process of a turnaround design meeting department approval. /have been Informed that the dual access went awuv because the guest wing has been repositioned."). In May of 2007, Pitkin County Planning Engineer Catherine Berg and I met with the Danis's and their representatives to develop a plan that would bring ongoing concerns with access and water supply to closure. My letter reflecting that meeting and drawings submitted by Mr. Camp and subsequently approved by Ms. Berg and myself has been implemented. The paving of the road was the desire of the Danis's. I was not aware of the non-paving regulation of the GMQS, however from [he fire code perspective this surface meets/and exceeds the all weather surface requirement and is acceptable. The fire district after conducting an access drive thru, final automatic fire suppression systems inspections and water flow test of the dry hydrant assembly accepted the site as meeting compliance to these directives toward a final Certificate of Occupancy. The access as constructed, dry hydrant placement and installed sprinkler systems allows us to provide service to this property, If I can be of further assistance regarding this application please feel free to call me anytime.
