The purpose of this letter is to .protest the prOpc~sed variance being sought by Timberline Associates for a building to be constructed ' to the South and above the Laurelwood condominiums - - more par- titularly directly out in front of all of'the 400 unit condominiums in the Laurelwood building. As I understand the matter the developer is seeking a var'ia'nce of three feet so as to increase the height of the building by that amount over and above the twenty-five foot limit set by the applicable zoning regulations for the Snowmass area. It seems to the writer that the obvious purpose for building height limitations in the Snowmass area is to preserve the' general character of the entire development, and to in general preserve views' of the surrounding mountain country. Obviously if' developers were permitted to build at all different heights some would go to such degrees that' not only would an inconsistent building pattern develop but in many cases views would be completely destroyed. In particular the proposed Timberline building, if permitted to go any higher, would seriously interfere with the view of all of the owners in the 400 unit of Laurelwood, and specifically would interfere with the view of this writer as the owner of unit 403. If this building can go three-feet over the limit then the next one will want the same treatment or higher, and one never knows ;where tfie'matter stops. Standards have their purposes, as enumerated above, and are generally not 'to be departed fram without good reason. The only ation variance such as that bean sou ht b Timberline in the instant goenerally'acceptable legalggantogheovariance would=oreate1a hard situation is that to not ship n the developer. Again legally speaking a hardship has been L++a,~r Pitkin County Board of Adjustment -2- May 21, 1971 interpreted to mean a problem which arises because of some unusual topography or building problems facing the developer, and not merely an economic grounds upon the basis of which the developer seeks to claim that unless the variance is given to him he will not be able to maximize his investment. I fail to see where there is any hardship connected with the physical aspects of the proposed Timber- line building, here involved. Timberline is building on the same slope that all of the other buildings have been constructed on, faces no different construction _ y problems than have faced an of the other condominium buildings and lodges, and I can therefore see no reason why Timberline should be given a variance any more than any of the other condominiums and lodges. In view of the foregoing I therefore respectfully request that the Pitkin County Board of Adjustment deny the request'of Timberline Associates for a height limitation variance respecting any of the proposed Timberline buildings. I purchased my condominium with the full wlderstanding there would be nothing that would jeopardize the true value of my condominium, which is largely based on the maguificient view available from my living room and balcony, I earnestly hope your review wi.i1 prove that it would not be in the best interest of the property-owners of ;inowmass to grant the request of Timberline Associates.
