GOFF PLACER PIT 64
Dated:
1. A permit to excavate and remove pit run material is hereby
granted for a period of five (5) years commencing on Jan. 1, 1973
and continuing until Jan. 1, 1978. The operator, by acceptance
of this permit, does hereby agree to terminate all excavation
and removal of pit run material on expiration of this permit un-
less extended or renewed by the Pitkin County Board of County
Commissioners.
2. A permit to excavate, screen, wash and remove sand is hereby
granted only for the period immediately after cessation of simi-
lar operations at the Stillwater Pit and continuing until Jan. 1, 1978.
The operator, by acceptance of this permit, does hereby agree to
terminate all sand excavation, screening, washing and removal on
expiration of this permit unless extended or renewed by the Pitkin
County Board of County Commissioners.
3. The permits and permit agreements shall apply to the areas
delineated on the attached map (exhibit A) for the purposes out-
lined in 1. & 2. above. The corners of the permit areas shall be
marked on the ground by the operator before the operation begins.
4. A berm shall be constructed separating the Roaring Fork River
from all approved operations.
5. No disturbance of any nature of the Roaring Fork River bed
and bank shall occur and no equipment or any encroachment of any
approved operations shall be permitted in the Roaring Fork River.
6. Equipment at the Goff Placer Pit shall be restricted to that
needed for the excavation, loading and hauling of pit run material.

:removal may be moved onto the site upon termination of those
`same operations at the Stillwater Pit.
7. All junk and trash shall be removed from the permit area.
8. The entrance to Highway 82 from the permit area shall be
improved by P.B. Hemann, Inc. according to a plan approved by the
Colorado State Highway Department and the U.S. Forest Service
before operation begins.
9. The operator hereby agrees to remove all stockpiled pit run
material and sand and all other equipment and materials which
have been a part of the approved operations within 90 days of the
termination of this permit unless said permit is renewed or extended.
loo The operator agrees to post with the Board of County Commissioners
of Pitkin County, Colorado a public liability insurance policy in
the sum of $100,000.00 for the benefit of the general public and
for the further benefit and purpose of protection of the Board of
County Commissioners from any liability arising out of the mainten-
ance, existence or operation of the pit, or from issuance of the
permits.
11. The operator, by acceptance of said agreement, does hereby
agree to post a performance bond in the sum of $500.00 per acre
for the benefit of the Pitkin County Board of Commissioners* Said
bond is expressly posted for the purpose of ensuring full compliance
with the terms contained herein for rehabilitation of the area
worked in 1972, and any and all other provisions of the published
Pitkin County Sand and Gravel Regulations, and must be renewed or
increased to cover rehabilitation of the area worked in 1973.
Said bond may be transferred upon approval of rehabilitation in
one area and applied to any other segment of the permit area. Rn

bond shall run for the length of the permit herein issued unless
released by the Board of County Commissioners. Said rehabilitation
shall be the responsibility of the operator and shall be completed
in accordance with the Goff Placer Rehabilitation Plan attached
(exhibit A).

foregoing permits, the terms, conditions and requirements herein
contained, and do hereby accept all of the above terms.
14. Nothing above will prejudice the status of the unpatented mining
claim or the obligation of the claimant as to federal law and will
not prejudice in any manner an application for renewal or extension
of the permits. These permits will be binding upon the operator,
its agents, heirs or assigns.
