Bankcenter One Partnership I, hereafter "Applicant," has applied to the Board of County Commissioners of Pitkin County, Colorado, hereafter, "Board," for a special review approval of a detached caretaker dwelling unit and a minor building envelope expansion. 2. The Property described as Parcel 1, Twin Creeks Ranch is located at the confluence of Snowmass and Capital Creeks. 3. The property is 24.34 acres and is zoned RS-30 PUD. 4. The Board heard this application at a public hearing on October 13, 1999 at which time evidence and testimony were presented with respect to the application. 5. The Board finds that the application complies with the applicable Code Sections. NOW, THEREFORE, BE IT RESOLVED by the Board that it does hereby grant approval of the Bankcenter One Partnership 1 detached caretaker dwelling unit and minor building envelope expansion subject to the following conditions which shall run with the land and be binding on all successor in interest: 1. The applicant shall adhere to all material representations made during the application process. 2. The proposed caretaker unit shall comply with BOCC Resolution 98-244 and Administrative Decision 99-71 unless otherwise amended by this Resolution. 3. A caretaker dwelling unit deed restriction shall be recorded with the Housing Office prior to issuance of a building permit for the CDU. The applicant shall comply with all Housing Authority guidelines for CDUs. Floor plans of the proposed unit calculating the net livable square footage shall be submitted to and approved by the Housing Office prior to building permit approval. 4. There shall be one off-street parking space on the property for each bedroom in the CDU. 5. Prior to issuance of any building permits the applicant shall obtain approval of an ISDS permit from the Environmental Health Department. The septic system must comply with all minimum horizontal setback requirements between its components and physical features. A qualified professional engineer must design the system. The septic system shall be located within the septic building envelope. 6. Prior to the issuance of a building permit, the applicant shall submit a ditch hazard mitigation plan to be approved by a County planner at Community Development and the County Engineer. The applicant shall provide the required access to the owners of the ditch for maintenance purposes. 8. The Applicant is required to obtain an access permit that shall be approved by the County Engineer and a County planner at Community Development. 9. No development, including grading, landscaping, vegetation removal or disturbance, and septic system shall occur outside of the approved septic and building envelopes except as may be necessary for access, to implement the wildfire mitigation measures required by BOCC Resolution 98-244, and by complying with condition # 6 of this Resolution. 9. The Applicant shall adhere to all material representations made in the application and public meetings. 10. The vested rights established pursuant to this approval shall expire on October 13, 2002. APPLICANTS: Bankcenter One Partnership One. LOCATION: The property, Parcel 1 of Twin Creeks Ranch is part of the Twin Creek Ranch portion of the Oh-be-Joyful subdivision at the confluence of Snowmass and Capitol Creeks ZONING/LOT SIZE: The property is 24.34 acres and is zoned RS-30 PUD PROCEDURES: The Board of County Commissioners review detached CDUs. BACKGROUND: The BOCC granted approval for 1041 Hazard Review and GMQS Exemption to land one TDR on this pazcel as part of the Oh-Be-Joyful and Twin Creeks Ranch Major Plat Amendment. The approval for Paccel One inluded a building envelope for the residence and a "barn envelope." The applicant proposes to expand the existing barn envelope to allow for the construction of a septic system and to change it use to a Caretaker Dwelling Unit. REFERRAL COMMENTS: This report uses referral agency comments throughout. Referral agencies include: Zoning, Attorney, Housing, Environmental Health. STAFF ANALYSIS: Changing the approved use of the Baru Envelope: Staff reviewed the file on this original application and has concluded that the current proposal does not counter the intent of the original review. The main concern on this property is wildlife habitat along the riparian areas, wetlands, and above the Williams Ditch according to JonathanLowsky Wildlife Biologists and Randy Cote of the D.O.W. The existing Barn Envelope lies outside of all of these wildlife habitat areas. Caretaker Unit Special Review The following is an analysis of the proposal relative to the applicable standards of Land lJse Code Section 3-150.130: Cazetaker Dwelling Units. ' Gabe Preston has a M.A. in Geography from University of Colorado at Boulder and has two years of planning experience with Pitkin County. ~flU~~~Q3 Total floor area of the principal and caretaker unit shall not exceed the allowable floor area according to the FAR of the applicable zone district. Response: The combined floor azea of the main residence and the CDU will not exceed that obtained by the purchase of a TDR. 2. There shall be provided one off-street parking place for each bedroom within the prir:ciple unit and for each bedroom in the CDU. 3. The applicant shall deed restrict to comply with the CDUdeed restriction pursuant to Code Section 3-150.130(0) (3). 4. The dwelling unit deed restriction may only be removed upon approval of the Board. Response: The applicant agrees to these provisions. SPECIAL REVIEW: Cazetaker units are listed as a special review use in the RS-30 zone district. Following is a review of this application under the standards in the Special Review Code Section 3-210: The use is consistent with applicable master plans, County Land Use policies, the intent of the zone district, and the character of the surrounding area. Response: CDUs are consistent with County Land Use policies since they provide affordable housing to a significant number of working locals. The proposed combination CDU aligns with the rural residential and agricultural intent of the RS-30 zone district as well as fitting in with the immediate surrounds. 2. The locatior:, size design and operating characteristics of the use are in harmony with the surrounding area and minimize adverse effects. Response: A CDU fits well within the surrounding predominately residential/agricultural neighborhood. However, increased employment generation will result from the construction of the CDU, putting further strain on the already scarce affordable housing stock. 3. Adeguate Services and Public facilities are available. Response: The applicants will need to obtain septic system approval from Environmental Health in order to construct this unit. The septic system shall be contained entirely within the approved building envelope. WILDFIRE: Vince Urbina designated a low wildfire rating for this property. The applicant shall comply with the wildfire mitigation conditions in BOCC Resolution 98-244. MINOR BUILDING ENVELOPE EXPANSION: The applicant proposes to expand their building envelope to accommodate the construction of a septic system. The proposed expansion would not affect or be affected by any 1041 Hazard Areas. IRRIGATION DITCH: The proposed residence will be located below an irrigation ditch. The Code requires a ditch to be culverted in order to build below it. Staff asserts that the applicant should address "J~3t~~~x u the hazards associated with the irrigation ditch in a ditch hazard mitigation plan. It may not be necessary to culvert the portion of ditch running through the property, but the associated hazards should be mitigated. RECOMMENDATIONS: Staff recommends that the BOCC pass the following motion, "to approve the detached caretaker dwelling unit for Bankcenter One Partnership 1, and allow a minor expansion of the barn envelope for a septic system, subject to the conditions in the attached resolution." T. aRANDT, PARALEGAL Re: Bankcenter One Partnership I; Supplemental Application for Minor Amendment to Development Permit Dear Mr. Preston: This letter is submitted as an amendment to the application of Bankcenter One Partnership I, a Missouri limited partnership ("Owner"), for special review approval to construct a Caretaker Dwelling Unit ("CDU") in the Barn Envelope on Owner's property. The purpose of this amendment is to request a minor amendment to development permit in accordance with Land Use Code Section 3-200-80. Specifically, the Owner is requesting that the "Barn Envelope" on the Property, as shown on the Twin Creeks Ranch Subdivision Exemption Plat, be enlazged to accommodate the installation of a Individual Sewage Disposal System within the envelope in association with the CDU requested in Owner's original application. The Barn Envelope is currently 100 feet by 100 feet. The Owner requests that it be enlarged to 150 feet by 150 feet, with the enlazged portion to be characterized as an "Accessory Septic Envelope", as shown on the attached site plan. All other submission requirements relevant to the approval requested herein have been satisfied with those items submitted with Owner's previous application. The Owner provides the following in response to the standards for the requested amendment: A. The amendment must not change the use of the proposed development between residential, commercial and tourist accommodation uses. Comment: The proposed development use will remain residential. B. The amendment must be consistent with action taken during the review of the original development and does not constitute a new land development activity. Comment: The amendment is consistent with the action taken during the original review in that property was approved for residential development, which uUi71J07 approval carried with it the ability, upon special review approval, to construct a CDU within the principal dwelling or a properly approved accessory building. The barn envelope was also approved in the original development. C. The proposed activity does not: 1. Change the basic character of the approved use of land on which the activity occurs including basic visual appearance and method of operation; Comment: The proposed amendment to the Barn Envelope will have no effect on the approved use of land as the purpose of the amendment is to allow an Individual Sewage Disposal System to be installed within an approved development envelope, which will have no apparent affects on the lard use . 2. Increase off-site impacts in the surrounding neighborhood; Comment: The proposed enlargement of the Barn Envelope will have no off- site impacts. 3. Endanger the public health, safety or welfare; Comment: The proposed enlargement of the Barn Envelope will serve to benefit the public health, safeh~ and welfare as it will allow the development within that approved envelope to comply with the Pitkin County policy of requiring all utilities to be located within approved building envelopes. 4. Violate any Land Use Code Standard; Comment: The proposed enlargement of the Barn Envelope will not violate any Land Use Code Standard. 5. Substantially increase the need for on-site parking or utilities, or affect affordable housing generation; and Comment: The proposed enlargement of the Barn Envelope will riot increase the need for ort-site parking or utilities, or affect affordable housing generation. 6. Increase the floor area of the use by more than two (2) percent or decrease the open space on the site by more than three (3) percent. Owner is the owner of Pazcel 1, Twin Creeks Ranch Subdivision Exemption, according to the plat thereof recorded June 25, 1999 in Plat Book 50 at Page 27 (the "Property"). The legal description of the Property and a vicinity map are attached hereto. The Property zoned RS-30/PUD, and consists of 24.34 acres. Also, the requested CDU will not be located within the principal residence but rather in an outbuilding. As such, special review approval from the Boazd of County Commissioners is required. Under Board of County Commissioners Resolution No. 98-244, "approving the Oh-Be- Joyful Acres Subdivision/Twin Creeks Ranch Major Plat Amendment; Lot Line Adjustments; 1041 Hazard Review, Conceptual Submission, and Special Review and GMQS Exemption for a TDR Receiver Site," the Property was approved under application by Owner's predecessor in title as a receiver site for a TDR in order to obtain GMQS exemption, and a building envelope for a barn was approved to be located in the pasture area of the Property, subject to approval of such location by the Community Development Deparhnent. A Barn Envelope was included on the final plat and approved by the Community Development Department. The Owner is now requesting special review approval under Land Use Code Sections 3-150-130 and 3-210 to construct a CDU within the bam it intends to construct in the Barn Envelope. The Owner intends to construct the barn/CDU as soon as possible, and then construct its principal dwelling at some point in the future. The proposed CDU will not exceed 700 net livable square feet and shall have two bedrooms. The Owner understands that the floor azea of the CDU will be included in the total allowed floor area for the Property, and that the allowed floor area for the principal dwelling, when constructed, will be reduced by the floor area of the CDU. The Property has legal access directly from Snowmass Creek Road. The CDU will be provided with at least two off-street ~~~;11 ~J parking spaces at the unit. The Owner will execute and record the deed restriction required by 3- 150-130.B.3 and the Aspen/Pitkin County Affordable Housing Guidelines. The Owner provides the following in response to the criteria for Special Review uses as set forth in Section 3-210: A. The special review use shall consider: 1. The applicable County Master Plan; Comment: The Down i~alley Comprehensive Plan states "Provide safe, affordable housing in a variety of types and styles for all residents. " The proposed CDUwill address this concern. 2. County Land Use Policies in Article 2; Comment: Policy 2-260, Housing, states "It is the policy of the County to assure the existence of a supply of desirable and affordable housing for persons employed in Pitkin County, senior citizens, the handicapped and other qualified persons of Pitkin County who are necessary for a balanced cornmunity. " The proposed CDUadvances this policy. 3. The intent of the Zone District in which it is proposed to be located; and Comment: The proposed CDU forwards the intent of the RS30/PUD zone district by providing an affordable housing opportunity, located in a customary accessory building, which will visually preserve the agricultural character of the area, maintain a rural lifestyle and be located outside of the sensitive riparian areas found on other areas of this property. 4. The character of the immediate vicinity of the pazcel proposed for development and surrounding land uses, or enhance the mixture of complimentary uses and activities in the immediate vicinity of the pazcel proposed for development. Comment: The character of the Zand uses in the vicinity of the Property is varied, and includes small residential parcels in the Gateway to Snowrnass subdivision, large luxury homes with a preserved equestrian and ranching operation in the Lazy O Ranch subdivision, and traditional agricultural uses, such as on the adjacent Burke Ranch. The Burke property also contains two deed-restricted affordable housing units in addition to the principal residential dwelling and accessory structures. The proposed CDU contributes to and complements this vital mix of uses. B. The location, size, design and operating characteristics of the proposed special review use must be in harmony with the surrounding area and minimizes adverse effects, including visual impacts on pedestrian and vehicular circulation, parking, trash, service delivery, noise, vibrations and odor on surrounding properties. J~~'~~2 Comment: The proposed use will blend harmoniously with the surrounding properties by being constructed sensitively in the barn style, ~zr:d within the dimensional requirements of the zone district. Because all of the impacts of this proposed special review use will be concentrated in an already approved accessory building, which would customarily house agricultural vehicles, animals and related equipment, the small, second floor unit will not result in any additional impact to adjacent properties. C. There must be adequate public facilities and services to serve the special review use including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. Comment: Where applicable, there are adequate public facilities to serve the proposed use. In regard to potable water and sewer, individual systems will be constructed pursuant to proper procedures and the requirements of Resolution No. 98-244. D. An application for a special review use must demonstrate to the Board of County Commissioners that the proposed development will not: 1. Materially endanger the public health, safety and welfare; and 2. Substantially injure the value of adjoining or abutting property. Comment: The proposed CDU will not result in any negative impacts on health, safety or welfare, and tlae quality of the planned construction will most likely serve to enhance the value of adjoining and abutting property. Attached to this application are the items required in the Pre-Application Conference Summary. As of the date of this application, plans for the proposed CDU have not yet been developed. However, the applicant intends to present, if not detailed plans and elevations, at least a representation of the structure's planned barn-like appearance at the public hearing of this application, and this application will be supplemented with that information if it becomes available before such hearing.
