Jones for the purposes of construction of a lodge in the Aspen Highlands Area. The site in question is located in an Accommodations and Recreation (R-30 Use) District. The Fitkin County Board of Adjustment met on May 15, 1961, to consider this request and a quorum of Board members, consisting of J. S. Adams, F. W. Anderson and J. B. Snobble, was present. Attorney Clinton Stewart represented Mr. Jones and made a presenta- tion which includes two previous variances which had been altered sufficiently to conform with zoning regulations. This left the matter of one variance still to be considered, and the Board con- ducted a personal examination of the site in question. After discussion and deliberation, the Board agreed to the granting of a building permit contingent upon the following conditions: 1. Mr. Jones will supply to Mr. Kirk, who is the owner of the property and the proposed lodge, such additional acreage as may be required to enable Mr. Kirk to meet the two-acre minimum re- quired under the Zoning regulations, such deed either to be recorded as a deed of record or held properly in escrow as defined under the laws of the State of Colorado. 2. The Board of Adjustment recognizes that due to the unusual terrain and topography of the building site undue hardship would exist should the owner not be able to situate the building on the presently proposed location.
