A]o 67 -4 6 PITKIN COUNTY BOARD OF ADJUSTMENT WHEREAS, Resolution was adopted and extended from time to time by this Board, granting to McCullough Oil Corporation of California, succeeded by The Aspen Consolidated Mining Company, for the processing of mine dumps, and reclamation of land northerly of Aspen under a general plan submitted and approved by this Board, WHEREAS, objectors to such operations have complained that inadequate or insufficient notice was given to certain persons within five hundred feet of the area concerned with the variance, and the Board deems it advisable to re-open the matter for further consideration in connection with application made for variance by The Aspen Consolidated Mining Company, con- templating the same non-conforming uses, but for an extended period of time, and for authority to process through milling machinery installed on the premises, ore removed from The Smuggler and Cowenhoven Mines, located nearby on a test basis under the express assurance that "applicant estimates it will take a maximum of eighteen months to process and level the dumps.After the dumps have been levelled, the mill and all appurtenances will be removed from the present location." .. 1 RESOLUTION u U L u. THEREFORE, THE PITKIN COUNTY BOARD OF ADJUSTMENT FINDS AND DETERMINES: 1. That all persons within five hundred feet of the area for which variance is sought have been duly notified of public hearing concerning the request for such variances, and public hearing has been conducted at which all persons in interest were afforded full opportunity to object or state their opinions, and that this Board has jurisdiction to act on the request for variance, 2. That a variance is hereby granted to the applicant, The Aspen Consolidated Mining Company,successor to McCullough Oil Company, for a variance in accordance with the terms, conditions and limitations contained in Resolution heretofore adopted by this Board granting such variance, together with extensions thereof, all of which are expressly incorporated herein by reference, and are ratified, confirmed and approved, except as expressly modified hereby. 3. That the variance hereby granted shall extend to and include June 8, 1967, and that this Board reserves the right, without further public hearing, to grant an extension for an additional six months =hereafter, and thereafter to grant further extensions for a total of eighteen months from this date, provided applicant shall carefully and faithfully comply with all terms and conditions of this variance and shall make applications for such j f - A f 7 f 't 9 -2-ou.ULu.i. extensions prior to the term sought to be extended, it being expassly declared that this permit shall expire and terminate at the end of any period not extended by this Board. 4. That the last request for variance, that "Applicant desires to process through the mill material to be taken from The Smuggler and Cowenhoven Mines owned by it in the area," is hereby continued for further consideration at a continuation of this hearing, without the necessity of issuing additional public notice, at such time as applicant shall submit additional particulars as to the test ores proposed to be run through the mill, incldding duration of run, extent of ores, and changes, if any, in milling and disposal operations that will be attributable to such additional ore. 5. That this variance is granted and extended under applicant' s assurance that "Applicant is to take the maximum of eighteen months to process and level the dumps; after the dumps have been levelled, the mill and all appurtenances will be removed from the present location." *** I do hereby certify the above and foregoing to be a true, correct and complete copy of Resolution adopted by The Pitkin County Board of Adjustment on the /05 day of January, 1967. Brazelton, Secretary and General Councel Dear Mr. Brazelton: On the 29th of November, Pitkin County Board of Adjustment considered your letter of November 8th, requesting an extension to the present variance covering the mill operation in the mine dump area north of Aspen. The Board voted to grant an extension of your variance to June 8th, 1968, at which time the variance period shall end in accordance with the original resolution passed January 9th, 1967. It is our understanding that at the end of this variance the mill will be dismantled and removed from the area in accordance with the original agreement covering this variance.
