The Board will return this application if it does not contain all the facts in question.Description of proposed exception showing justification:
Appellant desires to locate house as far from the Highway 82 as possible.
Attached plan shows how this has been accomplished. This subdivision
was accepted long before the present 75' setback requirement. Appellant
purchased land before 75' setback requirement was adopted.
Inspection of the plan shows only a small corner requires a variance
and also shows how the irrigation ditch forces the car port on the north
side of the ditch.
Appellant has certainly complied with the object of the new requirement
since the mass of the house is well beyond the 75' requirement.
The small section requiring the variance would be well behind the
Dauson house to the east and there is no house to the West.

BEFORE THE PITKIN C OUNTY BOARD (F 'ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE DESCRIBED
BELOW:
Pursuant to Pitkin County Zoning Resolution of June 5, 1955, as amended, a public
hearing will be held in the County Commissioners' office, Court House, Aspen,
Colorado, (or at such other place as the meeting may be then adjourned) to consider
an application filed with the said Board of Adjustment requesting authority for
variance from the provisions of the County Zoning Resolution. All persons affected
by the proposed zariance are invited to appear and state their views, protests or
objections. If you cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to such variance, as
the Board of Adjustment will give serious consideration to the opinions of surround-
ing property owners and others affected in deciding whether to grant or deny the
request for variance.

Appellant desires to locate house as far from the Highway 82 as possible
Attached plan shows how this has been accomplished. This subdivision was
accepted long before the present 75 ft. setback requirement. Appellant
purchased land before 75 ft. setback requirement was adopted.Inspection of the
plan shows how the irrigation ditch forces the car port on the north side of the
ditch.
Appellant has certianly complied with the object of the new requirement
since the mass of the house is well beyond the 75 ft. requirement.
The small section requiring the variance would be well behind the Dawson house
to the east and there is no house to the west.
Duration of Variance:
Permanent.

Pursuant to Pitkin County Zoning Resolution of June 5, 1955, as amended, a publichearing will be held in the County Commissioners' office, Court House, Aspen,Colorado, (or at such other place as the meeting may be then adjourned) to consideran application filed with the said Board of Adjustment requesting authority forvariance from the provi sions of the County Zoning Resolution.
