A G R E E M E N T

THIS AGREEMENT, made and entered into this ~ day
of ~ , 1973, by and between THE CITY OF ASPEN,
COLORA , a municipal corporation (hereinafter referred to
as "City") and BOARD OF COUNTY COMMISSIONERS, COUNTY OF
PITKIN, STATE OF COLORADO (hereinafter referred to as
"County").
j WITNESSETH:
WHEREAS, the County desires to utilize the services
of the City Animal Warden and his deputies; and
WHEREAS, the City has entered into an agreement with
Luther Albright reserving dog kennelling facilities, and the
County desires to participate equally with the City in said
agreement.
NOW, THEREFORE, for good and valuable consideration, each
i to the other, the City and County hereby agree as follows;
1. The City Animal Warden and his deputies shall be duly
i appointed by the County as its Animal Warden and deputies for
a period of five years, for the purpose of enforcing the
Resolutions of the County of Pitkin and the Statutes of the
' State of Colorado pertaining to animals. The Animal Warden
and his de uties shall devote their time equally, insofar as i

practicable, between the City and the County in the enforcement
I
of the animal laws of the State, County and City.
2. The Animal Warden and his deputies shall be employed
and paid by the City of Aspen, and the County shall pay to the
City, in monthly installments, 50% of the salaries of the Animal
Warden and his deputies, cost of operation, equipment, supplies

and insurance attributable to the office of the Animal Warden.
3. The City hereby assigns to the County one-half
interest in and to that certain Agreement with Luther Albright,

a copy of which is attached hereto and incorporated herein,
for the kennelling of dogs, and the Cou m y and City agree
that each shall share equally in the benefits, obligations
and payments required under that certain Agreement.
4. The parties hereto mutually understand and agree
that the within Agreement effectively replaces and supersedes
in its entirety that certain earlier Agreement between the
same parties on the same subject dated July 1, 1970.
IN WITNESS WHEREOF, the parties hereto have executed
this Agreement the day and year first above written.
