The architectural expression of victorian roof pitches, and the cluster plan which allows maximum open space, indicate the nceessity of such variance to give optimum esthetic effect. HAL CLART //14/1/1<1/1 (3'juL'u'l ilslq RESOLUTION WHEREAS, Red Mountain Development Corporation has filed with the Pitkin County Planning & Zoning Commission and also with the Pitkin County Board of Adjustment a development plan designated Red Mountain Ridge Subdivision, providing a general planning layout for land located northerly of Aspen, Colorado, as thereon shown, AND, WHEREAS, the plan has been reviewed by the Pitkin County Planning & Zoning Commission and also by the Board of County Commissioners, who have found and determined that such plan as prepared by Karmen. A reduction from the R-30, 30,000 +square foot lot size shall be granted to the extend of permitting a minimum fee simple. lot size of 10, 000 square feet for each single family unit. 2. In Cluster Area A and Cluster Area B, the minimum lot width of 100 feet shall be waived, but the rear and side yard setbacks required in R-30 zoning areas shall be observed. 3. In the Cluster areas A and B the front yard setback may be not less than 20 feet from the centerline of the private access and service road providing access to the lots within the Cluster areas. 4. It is contemplated that the subdivision plat to be prepared and submitted in accordance with the Pitkin County Sub- division Regulations may be prepared in conformity to the variances hereby granted, and that such variances may be carried forward to building permits thereafter'granted, but with the exceptions hereby expressly enumerated the applicable zoning regulations shall be carefully adhered to. 000(26 2 5. Blue pojnted out that Chere was 72.9 acres in all useable land - 2.800,000 s1.,are feet, 50 percent is useable Board asked what wovld become of the effluent from the d*sposal plant in case Metro did not accept them. Mr. Blue explained that there would be a sewer pipe installed to all areas which wotild be acceptable to the Sanitation District and it would be installed in such a manner as to be able to connec(· to the sanitation district or go into the Roaring Fork. Mr. Stanton explained that anything installed would have to be accepted by the County Commissioners and The State D' part-ment of Public Health and the Water Pollution Control Comnliscion as well as the local Sanitarian. Mr. Bir,gorotaff--sai.d his 01.estion had already been answered. Mr. Mason asked what kind of ownership this project would be--the cluster. Mr. Blue explained t:Lat each person would own the land the house sat on and 1/20th interest in the complete area as well as being a part of a Homa Wwners Assoc. James Payne asked if the Owners in the Cluster Dev. would have ownership in all the open area. Yes. Mr. Doremus felt that 1-he name Ridge of Red Mountain might conflict with the presnnt Red Mountain Subdivi.sion No. 1. Mr. Stanton asked the Board for any further discussion. Mr. Parker madc a motion for conditional approval of plan-an attorney to be consulted on legal aspect. Motion died for lack of second. : Demming asked what would be I he next dev lopment if the Board gives approval. Mr. Stanton exp lained that pheir decision would be considered by the County Commissioners and legal control. 1.0 Mr. Derming again voiced his objection to the cluster development although he had no objection to the overall plan. Mr. Stanton asked for a motion. Mr. Mason made a motion that a decision be postponed until Friday July 19, at 1.:00 P.M. in the Commissioners Room when the Board would have a chance to consult with each other and with legal council. . BOARD OF ADJUSTMENT MINUTES Meeting os July 29, 1968 Present were: Oakes, Stein, Parker, Stanton & Mason. Mr. Kettering of Reid Realty presented a temporary for sale sign for consider- ation by the Board. The Board discussed whether or not to permit the sign in the R-15 Zone along Highway 82. The setback would only be 25 feet fromthe right of way boundary. after considerable discussion motion was made that they allow a 6 square ft. Sign (Temporary) . Motion was 1.,seconded and carried. Case 68-14, Steve Reischl, Conundrum Creek Property. The appeal was read by Mr. Stanton. Mr. Reischl explained the map and the terrain as related to the building site and the variance requested. He also showed that the sanitary facility was feasible. Mr. Gossard arrived. Mr. Stanton read a letter received from Mr. Gossard objecting to the variance. Mr. Gossard made objection from the floor also.He questioned the sanitary condition. On being questioned about his property across the river he admitted that his septic system was no further from the river thanthe proposed. Mr. Wendt, Attorney, was present to represent Keating Coffey who's property lies directly across the road. Mr. Wendt felt that the setback variance was merely a matter of economics and that Mr. Reischl had purchased the land knowing the zoning requirements.He also noted that the house would be that much closer to Mr. Keating Coffey's property line. There was some discussion of the Zoning Code and what conditions would give the Board the right to grant the variance.Mr. Stanton and Mr. Stein felt that it was a definite terrain problem. He suggested that they consult County Attorney Delaney. Mr. Stein made a motion that they recess the hearing until a later date when they had discussed the matter With Delaney. Mr. Parker seconded the motion. Mr. Mason disqualified himself from the vote. Motion carried. The Board will be notified when they have a decision from Mr. Delaney; either Wednesday or Thursday of next week. Ridge of Red Mountain A further study was made on the Ridge of Red Mountain Subdivision, proposed Resolution. The Board agreed that the open area should not be deeded. They discussed reduction of lots of R-30 to 10,000 square feet for each unit to be deeded land in the Cluster. The Building permit to be granted on the inclusion of common ground in the area. Person can get a building permit on this basis since the common area does bring the amount of open area up to density requirements of R-30 as provided under zoning. 9 There was some question as to whether or not the burden of development could be put upon the developer.It was generally agreed that he should give an un- divided interest in the common area bringing the 79 lots up to the permited requirements. The proposed Resolution to be changed to reflect this. It was also agreed that there was less damage to the terrain and that this type development would be less objectionable than others.Resolution to be further discussed with Mr. Delaney and decision on variance to be given at a later date.Plats to be resubmitted to the Planning and Zoning Cdmmission when plan is firm.
