HomeMy WebLinkAboutbocc.res.033.2009A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, AUTHORIZING THE PITKIN COUNTY CLERK AND RECORDER TO CONDUCT THE NOVEMBER 3, 2009, ELECTION BY MAIL BALLOT, IN ACCORDANCE WITH C.R.S. 1-7.5-101 et seq. Resolution No. ~ 3 2009 Recitals The General Assembly has found, determined and declared that self-government by election is more legitimate and better accepted as voter participation increase; and 2. The General Assembly further found, determined and declared that mail ballot elections are cost-efficient and have not resulted in increased fraud; and 3. By enactment of Article 7.5 of Title 1 of the Colorado Revised Statutes, the General Assembly concluded that it is appropriate to provide for Mail Ballot Elections under specified circumstances, and under the supervision of the Secretary of State, subject to rules promulgated by the Secretary of State; and 4. Subsection (3) of Article X, Section 20 of the Constitution of the State of Colorado permits the ballot issues of various entities to be consolidated at specified elections, which elections may also be conducted by mail ballot; and 5. The Board of County Commissioners ("Board") finds it to be in the best interest of the citizens of Pitkin County that the various districts and political subdivisions in the County be permitted to conduct the election set for November 3, 2009, by consolidated mail ballot. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado: 1. The November 3, 2009 election shall be conducted by mail ballot. 2. Pitkin County Clerk and Recorder is hereby designated as the election official for said Mail Ballot Election, pursuant to C.R.S. 1-7.5-104(1). 3. The various political subdivisions and special districts within the County shall be permitted to consolidate their ballot issues, under the direction of the Pitkin County Clerk and Recorder. 4. The Pitkin County Clerk and Recorder shall conduct said Mail Ballot Election under the supervision of the Secretary of State, and the provisions of Article X, Section 20, Colorado Constitution and of C.R.S. 1-7.5-101, et seq.
