RECITALS
Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code,
the Community Development Director of Pitkin County, Colorado
("Director") may approve a Temporary Commercial Use/Special Event
Permit for commercial activities or special events.
2. NBC (hereafter, the "Applicant") has applied to the Director for approval of
a Temporary Commercial Use/Special Event Permit to film a segment for
the Premier of the Tonight Show with Conan O'Brien on May 16, 2009.
Cast and crew consist of 5 people with one vehicle. Filming will occur at
the Maroon Bells and on McLain Flats Road. Filming will be of Conan
O'Brien running along the lake and road.
3. The Pitkin County Sheriffs Office, the Aspen Fire Department, and County
Road and Bridge have all approved this event. A Certificate of Insurance
covering this event and naming the County as an Additional Insured has
been received. The USFS has also approved the Application.
4. The Director finds that, to the extent applicable, the application complies
with the standards in Subsection 4-30-50(i) of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial
Use/Special Event Permit for the NBC filming of the Tonight Show with Conan
O'Brien, subject to Applicant's compliance with each of the following conditions:
1: Applicant shall adhere to all mal:erial representations made in, or in
connection with the application.
2: Applicant shall secure any necessary permits from the U.S. Forest: Service.
3: Applicant shall not impede traffic.
4: No emergency access shall be blocked.
5: Failure to comply with the conditions of approval may result in revocation
of this permit.

DATE: May 15, 2009
REQUEST: The Applicant is requesting approval of a Temporary Commercial Use/Special
Event Permit in order to film a segment for the Premier of the Tonight Show with Conan
O'Brien.
APPLICANT: NBC (hereafter, "Applicant").
LOCATION: Filming will occur at the Maroon Bells and on McLain Flats Road.
BACKGROUND: The filming will occur on May 16, 2009. The filming will be of Conan
O'Brien running along the Lake at the Maroon Bells and running along McLain Flats Road.
The cast and crew consist of 5 people and 1 vehicle. They anticipate filming between
approximately 330 PM and 6:30 PM.
REFERRAL COMMENTS: The application was referred to the USFS (Aspen District),
Tom Grady, Joe Disalvo, GR Fielding, and Ed Van Walraven.
Tom Grady and Joe Disalvo reviewed and signed off on the application for the Sheriffs
Department. Ed VanWalraven reviewed and signed off for the Fire Department.
GR Fielding approved the application for County Road and Bridge.
The USFS.has approved the application and will be opening the gate and escorting the film
crew to the Maroon Bells.
The Applicant has provided adequate proof of Insurance
STAFF COMMENTS:
Pursuant to Subsection 4-30-50(i) of the Land Use Code, Applicant must demonstrate that
adequate provisions have been made for all of the following:
1. Police supervision (if necessary);
2. Public parking;
3. Insurance;
4. Site set-up, maintenance and clean-up;
5. Emergency services; and
6. Safety of operations.
Additionally, temporary structures must conform to applicable building codes and other
County regulations. Each of these requirements is addressed, in turn, below.

Police Supervision: No special provisions are deemed necessary. The Sheriff's
Office has signed-off on the application.
Public Parking: N/A
Insurance: Applicant has provided adequate proof of insurance.
Site Set-Up. Maintenance and Clean-Up: Outdoor set-up is minimal for this type of
event. Brian Hall from NBC is identified as the responsible party for any clean up required.
Emergency Services: Cell Phone and a radio will be used to call 911.
Safety of Operations: The USFS will be with the film crew at the Maroon Bells.
Conformance with Building Code: N/A
RECOMMENDATION: Staff recommends that the Director approve the Temporary
Commercial Use/Special Event Permit application subject to Applicant's compliance with
each of the conditions in the attached Administrative Determination.

Event Summary: The Tonight Show with Conan O~ Brien premiers on June 1st. We are opening the
show with a piece that starts in NYC and Conan runs across America to Los Angeles. We are a very
small crew consisting of 5 people that will Fly into each city by private jet. The idea is we capture very
promenate spots in all parts of the US. We will be in Chicago Wrigley feld, Vegas strip, Monument
Valley, NYC, Washington DC,S[. Louis arch, and the most exciting Maroon Bells. This event as well as
any information is conftlential and NOT available to the public. This will be at most a 30-minute
shoot; we are due in St. Louis to shoot the arch Saturday nigh.

Brian Hall c/o The Toni ht Show with Conan O'Brien ,hereinafter called the Holder, is hereby authorized
to use, subject to the terms and conditions of this permit, National Forest System land identified within the unit
area as It occurs on National Forest System land located within the Aspen Ranger blstric[, white River
National Forest, Pitkin County, Colorado.
This authorization covers approximately 2 acres end/or N/A miles.
The holder is authorized to conduct the following activities and/or install the following temporary
improvements on the permitted area: Conduct a commerical TV shoot.
The following location Is authorized for this photo shoot:
7. May 16, 2009- Shooting to occur at the Maroon Bells, around Maroon Lake Scenic Loop.
Helicopter use has NOT been authorized for th/s locat/on.
This Special Use Authorization covers National Forest Svstem lands only

TERMS AND CONDITIONS
1, Use under this permit shall begin on 0 511 8/2 0 0 9 and end on 05/1612009. The permit shall not be
extended.
2. The fee for this use is $300.00 (three hundred dollars). It shall be paid in advance and is not
refundable-
3. The holder shall conduct the authorized activities according to the attached approved plans and
specifications, and Exhibits N/A .
4, The holder shall not install any improvements not specifically identified and approved above.
5. No soil, trees, or other vegetation maybe destroyed or removed from National Forest System lands
without specific prior written permission from the authorized officer.
6. The holder shall comply with all Federal, State, county, and municipal laws, ordinances, and regulations
which are applicable to the area or operations covered by this permit.
7. The holder shall maintain the improvements and premises to standards of repair, orderliness, neatness,
sanitation, and safety acceptable to the authorized officer. The holder shall fully repair and bear the
expense for all damage, other than ordinary wear and tear, to National Forest System lands, roads and
trails caused by the holder's activities.
8. The holder has the responsibility of inspecting the use area and adjoining areas for dangerous trees,
hanging limbs, and other evidence of hazardous conditions which would pose a risk of injury to
individuals. After securing permission from the authorized officer, the holder shall remove such hazards.
9. The holder shall be Ilable for any damage suffered by the United States resulting from or related to use of
this permit, including damages to National Forest resources and costs of fire suppression.
10. The holder shall hold harmless the United States from any liability from damage to life or property arising
from the holder's occupancy or use of National Forest lands under this permit.
11- The holder agrees to permit the free and unrestricted access to and upon the premises at all times for all
lawful and proper purposes not inconsistent with the intent of the permit or with the reasonable exercise
and enjoyment by the holder of the privileges thereof.

12. This permit is subject to all valid existing rights and claims outstanding in third parties.
13. This permit may be revoked upon breach of any of the conditions herein or at the discretion of the
authorized officer. Upon expiration or revocation of this permit, the holder shall immediately remove all
improvements except those owned by the United States, and shall restore the site within 1 day(s), unless
otherwise agreed upon in writing. If the holder fails to remove the improvements, they shall become the
property of the United States, but that will not relieve the holder of liability for the cost of their removal and
restoration of the site.
14. This permit is a license for the use of federally owned land. It does not grant any interest in real property.
This permit is not transferable. The holder shall not enter into any agreements with third parties for
occupancy of the authorized premises and improvements.
15. Appeal of any provisions of this permit or any requirements thereof shall be sub)ect to the appeal
regulations at 36 CFR, Subpart C, or revisions thereof.
16. This permit is accepted subject to the conditions set forth herein, condition(s) 1-21 and attached to and
made a part of this permit.
17. The Permittee will remove all trash generated by the film shoot. The area will pe maintained in a neat
and orderly fashion at all times. Trash receptacles and ash trays will be on site and removed.
18. All vehicles must stay on designated roadways and parking areas.
19. No more than two (2) vehicles are permitted on Maroon Creek road to transport The Tonight Show's crew
and equipment.
20. Though the road is closed, there are still recreation users, i.e, bikers and hikers, on the road. Please
follow normal traffic regulations, including speed limit.

925-1875 or (970) 948-6447. Please allow 30 minutes for the contacts to arrive at the gate upon
receiving notification that the crew has landed in Aspen.

Purpose of Form -f
A person who Is required to file an information return with the
IRS, must obtain your correct taxpayer identification number
(fIN) to report, for example, income paid to you, real estate
transactions, mortgage interest you paid, acquisition or
abandonment of secured property, cancellation of debt, or
contributions you made to an IRA.
U.S. person. Use Form W-9 only if you are a U.S. person
(including a resident alien), to provide your correct TIN to the
person requesting it (the requester) and, when applicable, to:
1. Certify that the TIN you are giving is correct (or you are
waiting for a number to be issued),
2. Certify that you are not subject to backup withholding, or
3. Glaim exemption from backup withholding rf you are a
U.S. exempt payee.
In 3 above, if applicable, you are also certifying that as a
U.S. person, your allocable share of any partnership income
from a U.S. trade or business is not subject to the
withholding tax on foreign partners' share of effectively
connected income.
Note. If a requester gives you a form other than Form W-9 to

For federal tax purposes, you are considered a person if you

Special rules for partnerships. Partnerships that conduct a

United States, provide Form W-9 to the partnership to
e=,ttablish your U.S. status and avoid withholding on your
share of partnership income.
The person who gives Form W-9 to the partnership for
purposes of establishing its U.S. status and avoiding
withholding on its allocable share of net income from the
partnership conducting a trade or business in the United
