RECITALS
IKS Imports, Inc. (Daryl Snadon) (hereafter referred to as "Applicant") has applied to Pitkin County
Community Development Director ("Director") for Activity Envelope and Site Plan, and with vested
rights to develop a single family residence with accessory residential uses up to 15,000 square feet. The
intent of this application is to re-vest the property rights for the lot.
2. The Lot is caned AR-10 and contains approximately 7 acres. PID#: 2643-352-00-004. (Legal Description,
Attachment A).
3. The Lot is GMQS exempt up to 5,750 square feet. The lot is vacant and a 900 squaze foot residence that
was constructed in 1971 was recently demolished. The lot received Activity Envelope, Site Plan, and
Special Review for a TDR Receiver Site for floor area up to 15,000 square feet subject to Hearing Officer
Determination No. 15-2007 (Rec. No. 539636). The Activity Envelope and Site Plan were recorded at BK
88 PG 22 (Rec. No. 552060) The Hearing Officer Determination was amended to document a change in
the house design pursuant to Administrative Decision No. 14-2009 (Rec. No. 556759). The Applicant has
submitted an identical activity envelope and site plan review request with the desire to establish an
identical approval.
4. The Lot was approved for a TDR Receiver Site pursuant to Hearing Officer Determination No. 15-2007.
Pursuant to section 2-30-10: Table 2-1 approval of a TDR Receiver Site does not lapse. The Land Use
Code has not been amended such that the current TDR review procedure or standards are different from
the previous review procedure or standards. The Director acknowledges that the TDR approval is still
applicable.
5. The Colorado Division of Wildlife (CDOW) and the Aspen Fire District have both commented on the
application and stated that previous conditions from the 2007 approval be carried forward.
6. Public notice was published in the Aspen Times Newspaper on June 7, 2009. The Applicant mailed the
public notice to the adjacent property owners on June 3, 2009. No formal objections were received within
30 days.
7. The Director finds that (a) The parcel is mapped within a medium wildfire hazard area and standards
can be implemented to mitigate this hazard; (b) The parcel is mapped within elk and mule deer winter
range and bear conflict area and conditions of approval can lessen the impacts on these resources; and
(c) the lot is mapped within a Scenic View Protection area as viewed from McLain Flats Road and the
proposed residence will not obstruct a ridgeline as viewed from this Road.

The Applicant shall adhere to all material representations made in the current or prior applications or in
public meetings or hearings and shall consider those representations to be conditions of approval, unless
amended by other conditions.

2. At the time of building permit submittal, the Applicant shall surrender the TDR's for additional floor area
up to 15,000 square feet from a base 5,750 squaze feet.
3. No calculations for height, bulk, setback, size, floor azea, or any other building and zoning requirements
have been conducted. These requirements will be considered at the time of building permit. Any structures
represented in the application may not be permitted under building and zoning regulations.
4. The Applicant is not required to record a Site Plan for this approval. The ActiviTy Envelope and Site
Plan Recorded at BK 88 PG 22 (Rec. No. 552060) shall be the approved Site Plan.
5. If applicable, prior to issuance of a building permit application for the residence, the Applicant shall:
A. Complete a fireplace/woodstove registration form with the Community Development
Department, if necessary.
B. Obtain a stormwater permit from the State of Colorado if site disturbance exceeds one (I) acre.
C. If necessary obtain a County access/driveway/turnaround permit acceptable to the Aspen Fire
Protection District and County Engineer.
D. Submit a drainage and erosion control plan for review and approval by the Planning Engineer. All
slopes steeper than 2:1 shall utilize erosion control blankets.
E. Submit engineered plans for retaining wall greater than four feet in height.
F. Submit a construction management plan for review and approval by the County Engineer
showing the locations of staging, material storage and employee and construction traffic
parking.
G. Pay the applicable road and employee housing impact fees.
H. Obtain a permit for construction of the ISDS.
I. Applicant shall consult with County's Natural Resource Specialist regarding the adequacy of
the Lot's water supply.
6. The Applicant shall submit a landscape plan for review and approval by the Community Development
Director that utilizes native vegetation on the site to screen the residence as viewed from McLain Flats
Road. For areas disturbed during construction of the ponds, driveway, culverting of the Ditch, and
burial of the power lines, mountain shrub and sagebrush of the same density shall be installed. Upon
submittal of a landscape plan the Applicant shall also identify all trees over 6" d.b.h. on the Lot and
mitigate for their removal. Because the parcel is located within a beaz-human conflict area, the landscape
plan shall address the DOW's concerns of aspen and spruce trees to close too the residence that could
potentially act as a ladder far beaz to enter a residence. If aspen and/or spruce are used for landscaping
around the residence, a minimum of 15' setback shall be adhered to. All other areas disturbed by
construction shall be re-vegetated in accordance with an approved landscape plan within one growing
season of the project's completion.
If the Applicant desires to stock the ponds with fish, a fish stocking permit shall be obtained from the
CDOW.
8. Prior to culverting of the Ditch, the Applicant shall provide a letter from the Ditch Company showing
approval for the project.
9. No structural development, with the exception of fencing, in excess of 30" shall occur within the
setbacks of the Lot. Landscaping in the form of berms shall not exceed four feet from the most
restrictive grade. Any development located within setbacks mandated by County zoning regulations

shall require a variance from the Board of Adjustment. Approval of a landscape envelope within such
setbacks does not assure approval of a variance.
10. The Applicant shall comply with all standards for development within Scenic View Protection Areas as
represented in the application and approved in this Determination. The residence shall use natural earth
tone colors for the fagade of the residence and non-reflective roofing. Driveway lighting is prohibited
and all other lighting shall comply with the lighting code.
11. Standards Applicable for Development in a Medium Wildfire Hazard Area:
A. Defensible Space: The area around al] buildings/structures, limited by property boundaries that may
limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire
defensible space considerations as follows (note: actual vegetation manipulation to meet these
conditions may not be necessary where the natural vegetation patterns have already fulfilled these
conditions):
A. Brush, debris, and non-ornamental vegetation shall be removed within a minimum 15" feet
perimeter around all structures and non-combustible hndscape surfaces shall be installed.
Firewood or other combustible materials shall not be placed within this area.
B. Beyond 15' up to 35' or to the property line, maintain natural and/or ircigated grass at less than
6"and thin existing trees, sagebrush, and brush into individual clusters. Limbs shall be pruned
to '/z the height of the tree or 10' whichever is less.
C. No brush or shrubs which when mature shall be tall enough to act as ladder fuels. Clusters of
brush or trees should be separated from each other and from those beyond the 35' area by a
distance of 2 '/z times the height of the mature vegetation. The diameter of a cluster a cluster
shall be limited to 2 %z times the height of the mature vegetation.
D. Thin and remove lower branches of brush or shrubs within clusters or individual plants to
eliminate ladder fuel. Cut ends of brush shall be treated with Garlon or an equivalent by a
person licensed to apply herbicides. Cut materials shall be removed or chipped and spread.
E. All deadfall up to a one hundred (100) foot perimeter shall be removed.
F. The property owner shall be responsible for the continued maintenance of the defensible space
vegetation requirements.
B. Access
A. Access roads and driveways shall be built to County standards; however, these standazds may
be increased to mitigate wildfire hazards based on comments provided by the Colorado State
Forest Service, the Sheriff's Department, local fire protection districts and/or a person
approved by the County as an expert in wildfire area designation and mitigation. Where
feasible, looped routes of access/egress to a public road shall be incorporated in the design of a
proposed development. Looped routes of access/egress is defined as two (2) or more dedicated
access roads to the main artery/highway for widely separated ingress/egress; looped drives with
one (1) entrance point or divided single entrances do not satisfy this condition. Where this is
not feasible, the Community Development Department may approve vehicular turnaround areas
a maximum of seven hundred fif4y (750). feet apart installed between the road intersection and
its terminus. Turnaround areas shall be the same standard as cul-de-sac turnaround pads; these
may be incorporated into the proposed driveway entries.
B. New dead-end streets shall not be permitted, except for cul-de-sacs and other turnarounds
accepted by the applicable local fire district.

C. Cul-de-sac turnaround pads shall have a minimum of a thirty (30) foot drivable surface inside
turning radius or a hammerhead or other T-turn azea acceptable to the applicable local fire
district.
D. New driveways and access roadway shall enter the roadway at aninety-degree (90°) angle for
the first twenty-five (25) feet of the driveway.
C. Water Supply for Fire Safety
A. When access to a public or private pressurized water system is not available or if it is necessary
to augment fire protection water systems, private ponds may be used if approved by the
Community Development Deparhnent and the local fire district.
B. Any fire department recommendation for individual structure water supply and storage shall be
accessible to fire departrnent vehicles from the exterior of the structure through a fire
department approved mechanism (such as a fire hydrant). The Lot shall have a minimum
20,000 gallon water storage tank. Verification of the closest hydrant satisfactory to the AFPD
can mitigate this requirement.
C. All structures greater than five thousand (5,000) squaze feet in size shall be required to install
in-house sprinkler systems that meet the standards of the AFPD and the adopted Building Code.
At building permit submittal, the AFPD may require smaller structures to be sprinkled due to
hazard considerations, emergency access difficulties and lack of proximity to fire protection
services.
D. Roofs and projections at or below roof line in shall be constructed according to the following
specifications:
A. Medium Hazard Area
l . Roofs with less than a 3:12 pitch aze not permitted unless they comply with the
following:
a. All roof coverings shall be Class A materials approved for installation
on a Class-A Assembly as defined by the currently adopted Building
Code.
b. All roof coverings shall be constructed of non-combustible materials
and installed on a Class A roof assembly.
c. All roof coverings shall have a surface that shall facilitate the natural
process of clearing roof debris.
d. Protrusions above the roofline, such as parapets, shall be prohibited.
e. Roofs shall be installed as required by the adopted Building Code and
shall have a minimum pitch of 1:48.
f. All roof designs, coverings, or equivalent assemblies shall be
specifically approved by the Fire Marshall prior to submittal of a
building permit application.
2. No wood shakes or shingles.
3. All other adopted Building Code compliant methods and materials permitted.

E. Maintenance and Miscellaneous Requirements
A. Roofs and gutters shall be kept clear of debris.
B. Roof vents shall be screened with corrosive resistant wire mesh, with mesh one-fourth (''/a) inch
maximum.
C. Any outbuilding shall adhere to the same wildfire requirements.
D. Yards shall be kept cleaz of all litter, slash and flammable debris.
E. All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet
away from any structure.
F. Weeds and grasses within the ten (] 0) foot perimeter shall be maintained to a height not more
than six (6) inches.
G. Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (I S) feet away
from the structure.
H. Swimming pools and ponds shall be accessible by the local fire district.
I. Fences shall be kept cleaz of brush and debris.
J. Wood fences shall not connect to other structures.
K. Fuel tanks shall be installed underground with an approved container.
L. Propane tanks shall be buried, if possible, or installed according to NFPA 58 standazds and on a
contour away from the structure with standard defensible space vegetation mitigation around
any aboveground tank. Any wood enclosure around the tank shall be constructed with materials
approved for two (2) hour fire-resistive construction on the exterior side of the walls.
M. Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher.
N. Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be
visible at the primazy point of access from the public or common access road and installed on a
non-combustible post.
12. The Applicant shall comply with the following general conditions regarding wildlife:
A. When existing native vegetation must be altered within the Activity Envelope, the
Applicant may be required to prepare a habitat mitigation plan acceptable to the County.
Such mitigation plan may substitute (in a nearby area on the subject property) vegetation
equal in type and quantity to that being removed to mitigate effects on wildlife species.
Should there be no opportunity on the property for habitat mitigation or restoration, off-site
mitigation benefiting the same species may be required, or financial mitigation may be paid
into a County habitat mitigation fund should such a fund be established in the future.
B. Manipulation of vegetation outside of the Activity Envelope is prohibited.
C. Mesh or woven wire fences are prohibited outside the Activity Envelope.
D. Wood rail fencing shall employ three (3) rails or less, be the round or split rail type, shall
not exceed fifty-four (54) inches in height above ground level, and twelve (12) inches in
width (top view), and shall have at least eighteen (18) inches between the lower hvo (2)
rails.
E. Wire fencing must be three (3) strands or less. The top wire should be atwelve-point-five
(12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The
middle strands (which may be barbed) should be located a minimum twelve (12) inches
apart and from the top wire preventing entanglement when mule deer jump over. The
bottom strand should be sixteen (16) inches from the Bound.
F. Tall overly mature trees and standing dead trees (snags) should be retained at the rate of
two (2) to five (5) per acre whenever possible as nesting and perching habitat.
G. In areas of high black bear activity, fruit bearing trees and shrubs shall be prohibited within
the Activity Envelope. This does not include pre-existing native trees and shrubs.

H. Development shall be clustered to the maximum extent possible to minimize impact on
wildlife.
I. Access shall be provided to the Colorado Division of Wildlife for trapping, tagging,
studying, or otherwise managing wildlife.
J. Trash/garbage shall be kept in an approved bear resistant container or enclosure.
K. Bird feeders, including hummingbird feeders, shall be hung away from any deck or
window, and be at least ten (10) feet from the ground suspended between two (2) trees or
posts. All seed feeders shall include a seed catchment pan to catch discarded seed.
L. Horse grains, pellets, and cookies shall be stored in bear resistant containers.
M. Pet food shall not be left outside.
13. The following conditions shall also apply with regard to wildlife and development within big game
winter ranges:
A. Dogs shall be kenneled within 50' of the residential building or leashed under human
supervision at all times.
B. High impact recreational uses are prohibited.
C. No construction shall be permitted on the Lot from December 1 s` through March 31 s`.
D. Livestock and horses shall be prohibited outside the activity envelope.
E. Construction dogs are prohibited on site.
F. A screen shall be installed at the ends of the culverted Ditch to prevent beavers from habiting
and congesting the ditch.
14. Applicable road and employee housing impact fees must be paid at building permit
15. No development shall occur outside the approved building and landscape envelopes, with the exception
of vegetation removal necessary to comply with the wildfire mitigation measures described above. No
structures shall be permitted outside of the approved building envelope. Applicant shall be required to
obtain an Earthmoving Permit for any work outside the approved envelope.
16. The access drive shall be built to current County Standards, as described in the Pitkin County Asset
Management Plan and submit for an access permit. The driveway layout shall be staked in the field and
reviewed and approved by the County Engineer, prior to commencement of construction.
17. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the
corners of the activity envelope and install construction fencing around the construction site within the
perimeter of the building envelope. The fencing shall remain in place until issuance of a Certificate of
Occupancy.
18. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land
Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, §
2-20-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on
August__ ~_~, 2012.
19. Failure to comply with the conditions of this approval may result in revocation of this approval, or any
subsequent permit(s) or approval(s) related to this property, or vested rights associated with this
property.

IKS Imports Inc. (applicant) is represented in this land use application by Davis Horn
Incorporated. The applicant owns a seven acre +/- parcel located at 113 Trentaz Drive
within the non-County approved White Horse Springs Subdivision (parcel ID # 2643 352
00 004-113). Refer to Figure 1, Vicinity Map.
The applicant is seeking Activity Envelope, Site Plan, Scenic View Protection and Vested
Property Rights ]and use approvals. The subject site received Activity Envelope, Site
Plan, Scenic View Protection and Special Review Approval as a Transferable
Development Rights (TDR) receiver site and Vested Property Rights pursuant to Hearing
Officer Determination No. 15-2007 (see Attachment 2). The approval as a TDR receiver
site does not lapse. However, the term of the Vested Property Rights expires in March of
2010. Attachment 3 is a copy of the IKS Imports Inc, Activity Envelope, Site Plan for
Additional Floor Area Review and TDR Receiver Site Lot 3, Block 2, White Ilorse
Springs recorded at Book insert, Page insert.
In February of 2009, the Community Development Department approved Administrative
Decision No. 14-2009 (see Attachment 4) which approved a slight modification to the
house design. Attachments 5, 6 and 7 are new perspectives of the propose house which
are based upon the original house design as amended by Adminstrative Decision No. 14-
2009.
The sole purpose of this land use application is to establish a new Vested Property Rights
term.
This land use application is identical to the applications submitted by the applicant in the
past with the exception of the inclusion of Attachment 5, 6 and 7. Attachment 8 is a
current title commitment for the property and Attachment 9 is a new list of adjacent
property owners.

RECITALS

3. The Lot is GMQS exempt up to 5,750 square feet. According to the Assessor's Office a residence of 900
square fact was constructed in 1971. No previous land use approvals apply to the parcel.
4. The Applicant submitted an application after July 6, 2006, therefore, the application is being considered
pursuant to the 2006 Land Use Code, as amended.
5. The Heating Officer comidered this application at a duly noticed public hearing on March 201°, 2007 at
which time evidence and testimony were presented with respect to this application.
6. The Hearing Officer finds that: (a) Tha parcel is mapped within a medium wildfire hazard area and
standards can be implemented to mitigate this hazard; and (b) The parcel is mapped within elk and mule

designated scenic corridor. The redesign shall include techniques for reduMion of the height of the
structure from 30', allocation of some floor area into asub-grade location, and/or relocation of floor area
to the back portion of the lot so it is not as visible from McLain Flari Road. The Applicant shall submit

these plans to the Community Development Department for review and approval. Revised plans can be
viewed as Attachment B.
5. Prior to submission of any future building permit applications, the Applicant shall be required to submit
for approval by the County Attorney and Community Development a Site Plsn with an Activity
F~velope in accordance with Card Use Code Section 230.20(8) and Application Manual Section 2,1.12.
The above referenced approvals shall be a condition precedent to finalization and recordation. The Site
Plan shall also incorporate the following changes:
A. The Site Plan should state the following: (1) The Lot is mapped in a mediumwildfire hazard area;
(2j The Lot is mapped elk and mule deer winter range;
B. The activity envelope shall be redrawn to when the existing utility line is kroated on the Lot with
the exception of the area approved by the CDGW to accommodate regrading and retaining walls;
C. The activity envelope shall also be redrawn to encompass water intake and outflow for the ponds;
D. The site plan shall show where dewlopmeat will be located within the new activity envelope;
E. The site plan shall show the placement of the 20,000 gallon water tank within the activity
envelope.
6. Prior to issuance ofa building permit application for the residence, the Applicant shall:
A. Complete a fireplace/woodstove registration form with the Community Development
Department, if necessary.
B. Obtain a stormwater permit from the State of Colorado if site disturbance exceeds ono (1) acre.
C. If necessary obtain a County access/driveway/turnaround permit acceptable to the Aspen Firo
Protection District and County Engineer.
D. Submit a drainage and erosion control plan for review and approval by the Planning Engineer. All
slopes steeper than 2:I shall utilize erosion wntrol blankets.
E. Submit engineered plaaa for retaining wall greater than fora feet in height.
F. Submit a consWction management plan for review and approval by the County Engineer
showing the locations of staging, material storage sod employee and construction traffic

the Lot's water supply.
The Applicant shall submit a landscape plan for review and approval by the Community Development
Director that utilizes native vegetation on the site to screen the residence as viewed from McLain Flats
Road. For areas disttrbed during consttucdoa of the ponds, driveway, culverting of the Ditch, sad
burial of the power lines, mountain shrub and sagebrush of the same density shall be installed. Upon
submittal of a landscape plan the Applicant shall also identify all trees over 6" d.b.h. on the Lot and
mitigate for their removal. Because the parcel is located within ebear-human conflict area, the landscape
plan shall address the DOW's concerns of aspen and spruce trees to close too the residence that could
poaen[ially act as a ladder for bear to enter a rosidence. If aspen and/or spmce are used for landscaping
around the residence, a minimum of 15' setback shall be adhered to. All other areas disturbed by
construction shall be re-vegetated la accordance with an approved landscape plan within one growing
season of the project's completion.

8. If the Applicant desires to stock the ponds with fish, a fish stocking permit shall be obtained from the
CROW.
9. prior to culverting of the Ditch, rho Applicant shall provide a letter from the Ditch Company showing
approval for the project
10. No structural development, with the exception of fencing, in excess of 30" shall occur within the
setbacks of the Lot Landscaping in the form of banns shall not exceed four feet from the most
restrictive grade. Any development located within setbacks mandated by County zoning regulations
shall require a variance from the Board ofAdjustrnent. Approval of a landscape envelope within such
setbacks does not assure approval of a variance.
11, The Applicant shall comply with all standards for development within Scenic View Protection Areas as
ropn:sented in the application and approved in this Determination. The residence shall use natural earth
tone colors for the tagade of the residence and non-reflective roofittg. Driveway lighting is prohibited
and all other lighting shall comply with the lighting code.
l2. Standards Applicable for Developmrnt in a Medium Wildfue Hazard Area:
A. Defensible Space: The area arotmd a!I buildings/structwes, limited by property boundaries that may
limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire
defensible space considerations as follows (note: actual vegetation manipulation to meet these
conditions may not be necessary where the natural vegetation patterns have already fulfiBod these
conditions):
A. Brush, debris, and non-ornamental vegetation shall ba removed within a minimum 15" feet
perimeter around all structures and non-combustible hardscape surfaces shall be installed.
Firewood or other combustible materials shall not be placed within this arts
B. Beyond 15' up to 35' or to the property line, maintain natural and/or irrigated grass at less than
6"and thin existing trees, sagebrush, and brush into individual clusters. Limbs shall be pruned
to'h the height of the trex or ! 0' whichever is less.
C. No brush or shrubs which when mature shall be tell enough to act as ladder fuels. Clusters of
brush ar trees should ba separated from oath other and from those beyond the 35' area by a
distance of 2 'h times the height of the mature vegetation. The diameter of a cluster a cluster
shall 6e 1 invited to 2 % times the beight of the maluro vegetation.
D. Thin and remove lower branches of brash of shrubs within clusters of individual plants to
eliminate ladder fuel. Cut ends of brush shall be treated with Garton or an equivalent by a
person licensed to apply herbicides. Cut materials shall be removed or chippedand spread.
E. Al] deadfall up to a one hundred (100) foot perimeter shall be removed.
F. The property owner shall be responsible for the continued maintenance of the defensible space
vegetation rcquitemrnts.
B. Access
A. Access roads and driveways shall be built to County standards; however, these standards may
be increased to mitigate wildfire hazards based on comments provided by the Colorado State
Forest Service, the Sheriffs Department, local fire protection districts and/or a person

feasible, looped routes of access/egress to a public road shall be incorporated in the design of a
proposed development. Looped routes of access/egreas is defined as two (2) or more dedicated
accea roads to the main artery/highwey fu widely separated ingress/egrcss; looped drives with
one (1) rntrance point or divided single entrances do not satisfy this condhion. Where this is
not feasible, the Community Development Department may approve vehicular turnaround areas
a maximum of seven hundred fifty (750) feet apart installed between the road intersection and
its temtirtus. Turnaround areas shall be the same standard as cul-de-sec tumamund pads; these
maybe incorporated into the proposed driveway entries.
H. New dead-end streets shall not be permitted, except for cal-d>sacs and other turnarounds
accepted by the applicable local fire district.
C. Cul-de-sac turnaround pads shall have s minimum of a thirty (30) foot drivable surface inside
taming radius or a hammerhead or other T-tam area acceptable to the applicable local fire
district.
D. Nov driveways and access roadway shall enter the roadway at aninety-degree (90°) angle for
the fast twenty-five (25) feet of the driveway.
C. Watu Supply for Firc Safety
A. When access to a public or private pressurized watu system is not available or if it is necessary
to augment fire protection-water systems, private ponds may be used if approved by the
Community Development Dapattmrnt and the local fax district.
B. Any fire department recommendation for individual structure watu supply and storage shall be
accessible to fire deparfinem vehicles from the exterior of the structuro through a fire
department approved mechanism (such as a fire hydrant). The L.ot shall have a minimum
20,000 gallon watu storage tank. Verification of the closest hydrant satisfactory to the AFPD
can mitigate [hls requirement.
C. All structures greater than five tlrousend (5,000) square feet in size shall be required to install
in-house sprinkler systems that moat the standards of the AFPD and the adopted Building Code.
At building permit submittal, the AFPD may require smaller strucmros to be sprinkled due to
hazard considerations, emugency access difficuhies end lack of proximity to fire protection
services.
D. Roofs and projections at or below roof line in shall be constructed according to the following
specifications:
A. Medium Hazard Area
]. Roofs whh less than a 3:] 2 pitch are not permitted unless they comply with the
followutg;
a. All roof coverings shall be Class A materials approved for installation
on a Class-A Assembly as defined by the currently adopted Building
Code.
b. All roof coverings shall be constructed of non-combustible materials
and insulted on a Class A roofassembly.
c. All roof coverings shall have a surface that shall facilitate the natural
process of clearing roof debris.

d. Protrusions above the roofline, such as parapets, shall be prohibited.
e. Roofs shall be installed as required by the adopted Building Code and
shall have a minimum pitch of 1:48.
f. Al] roof designs, coverings, or equivalent assemblies shall be
specificalty approved by the Fire Marshall prior to submittal of a
building permit application.
2. No wood shakes or shingles.
3. All other adopted Building Code compliant methods and materials permitted.
E. Maintenance and Miscellaneous Requirements
A. Roofs and gutters shall be kept clear of debris.
B. Roof vents shall be screened with corrosive resistant wire mesh, with mesh one-fourth ('/.) inch
maximum.
C. Any outbuilding shall adhere to the same wildfire requimnenis.
D. Yards shall ba kept clear of all litter, stash and flammable debris.
E. All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet
away from any structure.
F. Weeds and grasses within the ten (10) foot perimeter shall be maintained m a height not more
than six (6) inches.
G. Firewood/wood piles shall be stacked an a parallel contour a minimum of Fifteen (15) Feet away
from the sttveturc.
H. Swimming pools and ponds shall be accessible by the local fire district.
[. Fences shall be kept clear of brash and debris.
f. Wood fences shall not connect to other sttuchrres.
K. Fuel tanks shall be installed underground with an approved container.
L. Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a
contour away from the strucmre with standard defensible space vegetation vitigation around
aoy aboveground rank. Any wood enclosure around the tank shall be constructed with materials
approved for two (2) hour fire-resistive construction on the eztorior side of the walls.
M. Each struduro shall have a minimum of one ten (10) pound ABC fire extinguisher.
N. Addresses shall be clearly marked with two (2) inch non-combustible Ictters and shall be
visible at the primary point of access from the public ar common access road and installed on e
non-combustible post. ;
13. The Applicant shall comply with the following brcnerol conditions regarding wildlife:
A. When existing native vegetation must ba altered within the AMivity Envelope, the
Applicant may be required to prepare a habitat mitigation plan acceptable to the County,
Such mitigation plan may substitute (in a nearby area on the subject property) vegetation
equal in type and quantity to that bring removal to mitigate effects on wildlife species.
Should them ba no opportunity on the property for habitat mitigation or restoration, off-site
mitigation benefiting the same species may be required, or financial mitigation may be paid
into a County habitat mitigation fund should such a fund be established in the furore.
B. Manipulation of vegetation outside of the AMivity Envelope is prohibited.
C. Mach or woven wire fences are prohibited outside the Activity Envelope.
D. Wood rail fencing shall employ three (3) rails or less, be the round or split rail type, shall
not exceed fifty-fovr.(54) inches in height above ground level, and twelve (12) inches in

rails.
E. Wire fencing must be three (3) strands or less. The rop wire should be atwelve-point-five
(12.5) gauge twisted barbless lype at a maximum height of forty-two (42) inches. The
middle strands (which may be barbed) should be located a minimum twelve (12) inches
apart and firm the top wire preventing entanglement when mule doer jump over. The
bottom straad should be sixteen (l6) inches from the ground.
F. Tall overly mature trees and standing dead trees (snags) should ba retained at the rate of
two (2) ro five (5) per acro whenever possible as nesting and perching habitat,
G. Tn areas of high black bear activity, fruit bearing trees and shrubs shell be prohibited within
the Activity Envelope. This does not include pre-existing native frees and shrubs.
H. Development shall be clustered to the maximum extent possible to minimize impact on
wildlife.
I. Access shall be provided ro the Colorado Division of Wildlife for trapping, [egging,
studying, or otherwise managing wildlife.
7. Trash/garbaga shall be kept in an approved bear resistant container or encbsure.
K. Bird feeder; including hummingbird feeders, shall be hung away from any deck or
window, and be at leas[ ten (10) feot from the ground suspended between two (2) trees or
posts. All sad leaders shall include a seed catchment pan to catch discarded seed.
L. Horse mains, p~,l(ety,.a•rtd cookies shall be storgd in bear resistant containers.
M. Pat food shall not be left outside.
14. The following conditions shall alsoapply whh regard ro wildlife and development within big game
winter ranges:
A. Dogs shall be kaoneled within 50' of the residential building or leashed under human
supervision at ail rimes.
E. High impact recreational uses are prohibited.
C. No construction shall be,pamrimed om the Lot from December 1"through Match 31".
D. Livestock and horses shall be prohibited outside the activity envelope.
E. Construction dogs are prohibited on site.
F. A screen shall be installed at the ends of the culverted Ditch ro prevent beavers from habiting
and congesting the ditch.
15. Applicable road and employee housing impact fees must ba paid at building permit.
l6. No development shall occur ophide the approved building and landscape envelopes, with the exception
of vegetation removal nacessaty to comply with the wildfire mitigation measures. described above. No
structures shall be permitted outside of the approved building envelope. Applicant shall be required to
obtain m Eerthmoving Permit for any work outside the approved envelope.
17. The access drive shall be built ro current County Standards, as described in the Pitkin County Asset
Management Plan and submit for an access permit. The driveway layout shall be staked in the field and
reviewed and approved by the County Engineer, prior ro commencement of construction.
18. Prior to wtnnrencement of any earthmoving or other construction activity, the Applicant shall stake the
comer of the activity envelope and install conslmction fencing around the construction lice within the
perimeter of the buildiog envelope. The fencing shall remain in place until issuance of a Certificate of
Occupancy.

CONDITIONS
1. DEFINITIONS
(a) "Mortgage" means mortgage, deed of trust or other security instrument.
(b) "Public Records" means title records that give constructive notice of matters affecting the
title according to the state law where the land is located.
2. LATER DEFECTS
The Exceptions in Schedule B Section 2 may be amended to show any defects, liens or
encumbrances that appear for the first time In public records or are created or attached
between the Commitment Date and the date on which all of the Requirements of Schedule B
-Section 1 are met. We shall have no liability to you because of this amendment.
3. EXISTING DEFECTS
If any defects, liens or encumbrances existing at Commitment Date are not shown in
Schedule B, we may amend Schedule B to show them. If we do amend Schedule B to show

DISCLOSURE STATEMENTS
Note I: Colorado Division of Insurance Regulations 3-5-1, Paragraph C of Article VII, requires that
"Every Title entity shall be responsible for all matters which appear of record prior to the time of
recording whenever the Title entity conducts the closing and is responsible for recording or filing of legal
documents resulting from the transaction which was closed." (Gap Protection)
Note 2: Exception No. 4 of Schedule B, Section 2 of this Commitment may be deleted from the Owner's
Policy to be issued hereunder upon compliance with the following conditions:
A. The land described in Schedule A of this commitment must be asingle-family residence, which
includes a condominium or townhouse unit.
B. No labor or materials may have been furnished by mechanics or materiahnen for purpose of
construction on the land described in Schedule A of this Commitment within the past 13 months.
C. The Company must receive an appropriate affidavit indemnifying the Company ageiinst unfiled
mechanic's and ma[erialmen's liens.
D. Any deviation from conditions A though C above is subject to such additional regriirements or
Information as the Company may deem necessary, or, at its option, the Company may refitse to delete
the exception.

Note 3: The following disclosures are hereby made pursuant to §10-11-122, C.R.S.:
(i) The subject real property may be located in a special taxing district
(ii) A certificate of taxes due listing each taxing jurisdiction shall be obtained from the County

Pursuant to our telephone discussions and the requirements outlined in the Pre-
Application Conference Summary, we are submitting this Application for Review by the
Hearing Officer. The existing small cabin, which has been there since the 1950's or early
1960's, will be demolished. The proposed new residence will be located in the area that
was cleared and regraded for the cabin and the existing driveway which will bf: utilized in
the proposed site development.
We will address the new Pitkin County Land Use Code development standards as
follows:
Section 2-30-20(g): Activity Envelope Criteria for Approval;
1.) General
As stated in the Pre-Application Conference Summary, this Application will be
subject to Hearing Officer Review, not Administrative Review. It is our intention to
demonstrate that we will comply with all applicable provisions of the new Land
Use Code and Policies. There are no previous land use approvals for this
property.
2.) Site Plan
A site plan has been prepared and is attached to this application. It shows the

The Applicant intends to build a new custom residence utilizing 4 TDR's to add to
the basic development right of 5,750 s.f. for a total of 15,000 s.f. l"his property
contains 6.99 acres and is zoned AFR-10 The White Horse Springs
neighborhood'is developed with large custom homes that average over 12,000
s.f. of floor area and therefore this proposed development is compatible. The
proposed Activity Envelope is defined so as to accommodate the proposed
residence and proposed landscaping related septic field and access driveway as
well as the required wildfire hazard mitigation. The septic field will be located and

Section 2-30-30 (h) One-Step Review Criteria for a TDR Receiver Site;
1.) General
This Application for One-Step Review is intended to comply with alll applicable
provisions of the new Land Use Code and Land Use Policies.
2.) Special Review Uses or Activities
a. The Subject property has been informally identified by Pil:kin County
Planning Staff as an appropriate landing site for TDR(s) and is consistent
with the applicable County Master Plan.
b. The proposed special review use is in an established residential
neighborhood and has the appropriate zoning so that it will not conflict
with applicable sections of the new Pitkin County Land Use Code,
including the County Land Use Policies, Section 1-60-70: Rural
Development.
c. The proposed development, single family residence, is entirely consistent
with development in the surrounding area and will not endanger the public
health, safety or welfare.
d. As previously stated, the proposed development will replace a small cabin
which is substandard and inconsistent with the neighboring large custom
residences. Thus, it will substantially increase the value of adjoining or
abutting property rather than decreasing it.
e. The special review use will be entirely consistent with the intent of the
zone district (AR-10) Agricultural Residential - 10 acres, in which it is
proposed to be located.
f. The special review use is in an established residential neighborhood of
large custom homes and thus will be compatible with the character of the
immediate vicinity.
g. The location, size and operating characteristics of the proposed special
review use will be in harmony with the surrounding area and minimize any
adverse effect including visual impacts, impacts on pedestrian vehicular
circulation, traffic generation, parking, trash, service delivery, air /water
pollution or other impacts by natural resources, noise, vibrations and odor
on surrounding properties.
h. There are adequate public facilities in place for this established residential
neighborhood. It has a paved road (Trentaz Drive), potable water, trash
service, police, fire protection, emergency medical /hospital medical
services and is in an established school district. An on-site septic system

will be designed and installed by qualified professionals. The property has
a nearly uniform slope averaging about 20% grade which drains to an
existing ditch along McLain Flats Road.

1: The single family use will begin within the 3 year period
following approval of this application.

• Section 7-10-50: Site Plan and Activity Envelope:
a.) We have defined an Activity Envelope on a proposed Site Plan which
will be recorded once it is approved. It will contain appropriate
language for Natural Hazard mitigation and other issues deemed
• necessary by planning staff. See Exhibit A.
b.) The Site Plan indicates the proposed Activity Envelope, including the
. proposed residence, related septic field water feature and driveway.
As stated earlier, the existing disturbed area around the cabin and the
driveway will be utilized to minimize development impacts to the
. natural terrain and vegetation. The most of the Activity Envelope is in
the 0-15% and 15%-30% slope areas. Only small areas of man-made
slopes in the 30%-45% range occur in the envelope, whiich are the
. banks above and below the driveway and cabin site.
c.) The Activity Envelope for primary development uses will be large
• enough to accommodate the proposed residence, septic field water
• features and driveway as well as required Wildfire Hazard Mitigation
and burial of the existing overhead power line that crosses the
property. See Exhibit A.
d.) Clearing, grubbing, excavation and grading will only occur within the
i Activity Envelope. All such activity will occur after approval and
. recording of the site plan for this property which is within a Scenic View
Protection Area.
e.) As stated above, the natural grade, topography, vegetation and
• drainage areas outside of the approved Activity Envelope will not be
disturbed, except as specifically permitted by this Land Use Code. The
boundaries of the Activity Envelope will be identified by construction
. fencing which will remain in place until development activity has been
completed.
f.) This Application will not require a separate Activity Envelope
• Application since it is site specific.

g.) The proposed development in the Activity Envelope will meet all of the
standards set forth in Table 7-1 of the new Land Use Code.
Section 7-20-20: Steep and Potentially Unstable Slopes:
a.) Slope Delineation
We have prepared a Site Plan that indicates slopes by distinct graphic
pattern as follows:
1). Slopes that are fifteen (15) percent or greater, but less than
thirty (30) percent.
2). Slopes that are thirty (30) percent or grater, but less than forty
five (45) percent
3). Slopes that are forty five (45) percent or greater.
b.) Forty five (45) Percent or Greater Gradient
There are small areas of 30% to 45% slope within the Activity
Envelope that were created by the grading for the existing driveway
and cabin. The rest of the Activity Envelope has less than 30% slope,
averaging around 20%. See Exhibit A.
These man-made anomalies will be removed for thE: proposed
development. A soils study and report is being prepared by HP
Geotech. In a recent site visit, Dan Hardin, P.E. said he could detect no
signs of slope instability. See Exhibit B.
c.) Thirty (30) Percent or Greater Gradient
The majority of the Activity Envelope is on slopes less than 30% except
as follows:
(3) Minor Slope Anomaly
Minor areas of 30% or greater slope are man-made by
grading of the site as noted above.
4) Existing Roads and Driveways
The existing road is cut into slopes of 15% to 30% slopes
such that the average grade profile for the road is 6%~
(a/c) The driveway was built in the late 1950's or early 1960's
thus is exempted from the regulations of the new Larid
Use Code.
(d) Improvements to the driveway will be the minimum required to
meet current standards of the Pitkin County Road Management
and Maintenance Plan as well as the Aspen and Rural Fire
Protection District.
(e) A soils engineer and civil engineer will collaborarte in any
mitigation devices that may be needed to prevent soil
movement. None are anticipated at this time.
d.) Less than thirty (30) percent gradient
The proposed development will be in an area that is predominantly less
than 30% gradient with minor slope anomalies as noted above. Thus it
is permitted under the standards in this Section of the new Land Use
Code.

Section 7-20-30: Water Courses and Drainage;
a.) Applicability _
The standards of this section are generally applicable to all
development.
b.) Encroachment or Channeling
Not Applicable
c.) Drainage
(1) General
(a) The site drainage is being studied by Mountain Cross Engineering,
Civil Engineers, for maintenance / management of historic flow
patterns and runoff amounts to preserve the natural characteristics of
the area. The resultant design will be documented for submittal with
the building permit application. See Exhibit C.
(b) The unimpeded flow of natural water courses and ditches:
The Salvation Ditch which crosses the property, will be diverted and
culverted for approximately two thirds (2/3) of its length across the
properly to facilitate burial of the existing overhead power line and
maintenance of the required maximum grade in the development area.
This work will be coordinated with the Salvation Ditch Company and
Holy Cross Energy Company for maintenance and service.
(c) Adequate drainage of low points:
There will be no low points in the proposed development.
(d) The engineered drainage for this development will accommodate
the runoff for the site. Adjacent properties above and below will not be
impacted. See Exhibit C.
(e) Maintenance of drainage systems:
This drainage system will be maintained as need for continues proper
functioning.
(f) On-site treatment of storm water:
This will be included in the engineered drainage and erosion control
plan. See Exhibit C.
(2)Runoff Volumes
The above referenced Civil Engineering study and design will manage
runoff volumes and peaks so that the proposed development will not
cause any increase over that attributable to the undeveloped site. See
Exhibit C.

The Proposed activities and development will be engineered so that
no contaminants will be introduced to groundwater and there will be
not interference with any recharge area or aquifer. See Exhibit C.
e.) Irrigated Areas
Proposed activities and development will be designed and engineered
so that there will be no adverse effect on the adequacy of water
supplies available for the irrigation of agricultural lands nor the
exercise of any existing and decreed irrigation water right. The
Applicant is negotiating with the Salvation Ditch Company to obtain
water rights for the proposed water features. Unused wal:er will be left
in or returned to the ditch.
f.) Irrigation Ditches
(1) Access
Access to the Salvation ditch which crosses the property
East to West, will be provided off the driveway by means of
clearing in vegetation along the East Boundary Line. There
are no public trails crossing this property.
(2) Preventing Leakage
The existing ditch is below the proposed building location
and thus will not cause any leaking problems.
(3) Avoid Flooding
The segment of the property below the existing irrigation
ditch will not be irrigated.
(4) Avoid Seepage
Not Applicable.
g.) Sedimentation
Proposed activities and development will be engineered for:
(1) Control during construction
(2) Sedimentation retention on site
(3) Revegetation as soon as possible, but no longer than one growing
season after conclusion of development on this site.

Section 7-20-130: Landscaping and Vegetation Protection;
a.) Purpose
The proposed development will preserve to the maximurci possible all
• existing vegetation, except for noxious weeds, and screen man-made
improvements to preserve the rural character of the Count)r.
b.) General Provisions
(1) Protection of Natural Vegetation
In addition to preserving natural vegetation, new landscaping will
use compatible indigenous plant materials while maintaining the
• required Wildfire Hazard Mitigation. The entire area below the
irrigation ditch will be left undisturbed.
(2) Conformance with Wildfire Regulations
The recommendations contained in the report by Art Hougland,
Certified Wildfire Expert will be carried out in harmony with the
above mentioned landscaping and preservation of natural
vegetation.

a.) Wildfire Hazards Map
This property has been designated as "Low to Medium Wildfire
• Hazard" on the Pitkin county adopted Wildfire Hazard Areas Map. Art
Hougland, Certified Wildfire Expert, has visited the property and
determined that it is a Medium Wildfire Hazard. His recommendations
• for mitigation are attached. See Exhibit D. These recommendations will
be incorporated into the Activity Envelope, Landscape Plan and
protection of natural vegetation, as noted earlier.

b.) Wildfire Hazard Area Delineation an Activity Envelope as :>tated above,
the Wildfire Expert has determined that this property is in the Medium
Hazard category. All wildfire mitigation recommended by him will occur
within the Activity Envelope.
c.) Standards Applicable to All Wildfire Areas
The recommendations by the Wildfire Expert in his report (Exhibit D)
have taken into consideration all of the development standards in this
subsection and will be complied with in the proposed development.
Section 7-20.70 : Wildlife Habitat Areas
a.) Wildlife Habitat Maps
This Area is mapped by the County as being '/: mile frorn Mule Deer
and Elk winter range, critical habitat and severe winter range. We met
at the site with Kevin Wright, District Wildlife Manager, who made the
following comments: this is winter range for Mule Deer and Elk, but not
critical since the area is already developed. It is also a fall
concentration area for Black Bears. The proposed placement of the
new residence is good, because the area is already disturbed and the
thistle growth will be removed. Thistle encroaches on the native sage
brush which is prime winter forage. He recommends minimizing the
residence footprint as much as possible. There should be no horses or
other livestock keep on this property because grazing area requires
sagebrush removal. An orange fence will be placed around the Activity
Envelope and kept as tight to the building footprint as possible, while
allowing for the recommended wildfire mitigation measures. No fruit or
berry producing trees /bushes should be in the landscaping to avoid
attracting bears. Bear proof trash containers or permanent enclosures
are highly recommended. No bird feeders should be placed around
the new residence from April 1 through December 1. Round door
knobs are recommended instead of lever handles to help keep bears
from breaking in.
b.) General Principal
The delineation of the Activity Envelope will include the five (5)
principals for maintaining wildlife habitat, etc. and aany further
recommendations by the District Wildlife Manager.
c.) General Standards
The fourteen (14) standards in this subsection, as applicable, and any
further recommendations by the District Wildlife Manager, will be
incorporated into the Activity Envelope for development of this
development.

mile from critical habitat and severe winter range for Mule Deer and
Elk. It has no Wetland or Riparian Areas, and is not in any wildlife
migration or production areas.
f.) Addition Species -Specific Standards
As stated above, this property is not in any critical habitat cr production
areas for Deer or Elk nor is it close to Bighorn Sheep habitat, etc. Dogs
will be kenneled and otherwise supervised and controlled.
g.) Timing of Construction
This property is more than the Y. mile distance standard from winter
range, etc, and is within an established rural residential neighborhood.
Therefore timing of construction restrictions do not apply.
Section 7-20-120 Scenic View Protection
e.) Intent
The proposed Activity Envelope and development of this property will
complement the natural landscape and reduce visual dannage to the
natural landforms and views to achieve an aesthetically pleasing rural
atmosphere.
e.) Applicability
The Scenic View Protection Area Map has identified ttris area as
viewed from McLain Flats Road, which is a Scenic Corridor.
e.) Exemptions
Not Applicable.
e.) Standards for Development Within Scenic View Protection Areas.
(1) The proposed Activity Envelope utilizes existing disturbed areas
of the site which were regraded for the existing cabin .and access
driveway. The natural vegetation will be preserved and
integrated into the proposed development to the greatest extent
possible.
(2) The proposed development is located in the least obtrusive area
of the property. The terrain has a fairly even gradient which
averages 20% slope toward McLain Flats Road. There is no
area on this property which is not visible from 1:he Scenic
Corridor at some point along the southwest boundary, although
the residence will be screened by the existing scrub oak at the
northerly corner. See Exhibits F1 and F2.
(3) The proposed development's height and bulk will be in
conformance with the Pitkin County Land Use Code for this Zone
District (AFR-10). It will be well articulated to break up the
facade facing the Scenic Corridor and roof elements will be
staggered. See Exhibit G.

(4) The proposed structure will not project above a ridgeline or be
silhouetted against the sky. See Exhibit H.
(5) The proposed development is designed to complement the
natural topography and utilize natural materials and coloring with
low reflectance. It is not near a ridgeline. See Exhibit H.
(6) The proposed development will preserve natural vegetation
except for noxious weeds to the maximum extent po:>sible. There
is no irrigated meadow on this property.
(7) The proposed development includes burial of 'the existing
overhead power line which bisects the property. All other utility
lines will be buried in the least disruptive locations possible to
minimize visual impact.
(8) Satellite dishes will be located and/or screened to minimize
visibility from the Scenic Corridor.
(9) No earth berms for screening are contemplated in the proposed
development.
(10) The proposed development is located in an estatdished rural
residential neighborhood. None of the Rural Character
Guidelines for Building Location Apply.
(11) Earth Tone Materials
The exterior of the proposed development will utilize indigenous
earth tone materials or colors. See Exhibit G.
(12) Roofs
The roofs will have anon-reflective color or composition. No
wood shingles or shakes are allowed by the Wildfire Hazard
restrictions and will not be incorporated in they proposed
development.
(13) Revegetation of Disturbed Areas
All previously disturbed land areas and areas disturbed by this
development will be revegetated using native species that are
already growing on the site or in the region. No fruit bearing trees
or shrubs will be used to avoid attracting bears. Irrigation
systems will be provided as necessary to insure survival of
landscaping.
(14) Driveways Avoid Dividing Meadows and Pastures
Not Applicable.
e.) Rural Character Guidelines for Building Location
The proposed Activity Envelope /Site Plan is not (1) at the edge of an
open meadow or pasture; (2) behind an existing stand of vegetation;
(3) behind or built into a change in natural topography; or (4) within a
pasture or meadow, clustered in the form of a ranch commpound or
adjacent to, or integrated into, an existing ranch compound. Therefore,
none of the guidelines in this subsection apply to the proposed
development.
Section 7-20-140 Lighting

The exterior building /landscape lighting plans and fixture selections are
required for this Activity Envelope /Site Plan application because it is
located within a mapped Scenic View Protection Area. It is 'the intent of
the Applicant to comply with the standards of this section and the Pitkin
County Lighting Ordinance.
The exterior building fixtures are fully shielded and provide only down
light on the wall at the south /southwest elevation which faces the scenic
corridor which is McLain Flats Road. All of the other elevations are
shielded from view by native vegetation and proposed landscape
planting. The main entry is on the North /Northeast elevation which is
shielded from view by native scrub oak along Trentaz Drive, ~Nhich is not
a scenic route. These fixtures are fully shielded down / up wall bracket
lights which are code compliant. The only landscape lighting proposed is
hooded pedestals along pathways and shielded step lights that are also
code compliant. Please refer to the Landscape Plan (Exhiibit E), the
Building Floor Plans with exterior light locations shown (ExFiibits I-1, 2,
83) and Light Fixture Types A and B with lighting specifications.
b.) Bulb Visibility
As stated above, all light bulbs are fully covered with opaque shielding
and will be a maximum of 60 watts.
c.) Light Trespass
There will be no light trespass since all fixtures are fully shielded down or
down / up directed lighting.
d.) Maximum Heights and Intensities
Figure 7-1: All lights are fully shielded and will comply with the intensity
standards. Wall lights will be a maximum of 8 ft. above finish grade,
landscape wall lights are in steps or retaining walls at 1 ft. above walking
surface and hooded pedestal lights will be 4 ft. or less above finish grade.
e.) Uplighting
Uplighting will only occur in the Type B fixtures which are down / up
focused at the main entrance and not visible from the scenic corridor.
f.) Highlighting
There will be no highlighting of the building facades, driveway, or
landscaping.
g.) Floodlighting
There will be no floodlighting in this project.
h.) Safety and Security Lighting
(1) Motion Sensors are riot intended in this project at this time
(2) Photocells will be used at the Garage doors and Main Entrance to the
Residence

PURPOSE AND SCOPE OF STUDY
This report presents the results of a subsoil study for a proposed residence to be located
on Lot 3, Block 2, White Horse Springs, McLain Flats Road, Pitkin County, Colorado.
The project site is shown on Figure ] . The purpose of the study was to develop
recommendations for the foundation design. The study was conducted in accordance
with our agreement for geotechnical engineering services to IKS Imports dated July 21,
2006.
A field exploration program consisting of exploratory borings was conducted to obtain
information on the subsurface conditions. Samples of the subsoils obtained during the
field exploration were tested in the laboratory to determine their classificatiion,
compressibility or swell and other engineering chazacteristics. The results of the field
exploration and laboratory testing were analyzed to develop recommendations for
foundation types, depths and allowable pressures for the proposed building foundation.
This report summarizes the data obtained during this study and presents our conclusions,
design reconunendations and other geotechnical engineering considerations; based on the
proposed construction and the subsurface conditions encountered.
PROPOSED CONSTRUCTION

At the time of our study, design plans for the residence had not been developed. The
building is proposed in the area roughly in the azea of the existing cabin bebween the
exploratory boring locations shown on Figure 1. The existing cabin will be razed as par[
of the new construction. We assume the residence will be a two story wood frame
structure over a walkout basement level. We assume excavation for the building will
have a maximum cut depth of one level, about 10 to l2 feet below the exisfnrg ground
surface. For the purpose of our analysis, foundation loadings for the structure were
assumed to be relatively light and typical of the proposed type of construction.
If building loadings, location or grading plans aze significantly different from those
described above, we should be notified to re-evaluate the recommendations contained in
this report.

SITE CONDTTIONS
There is an existing single story log cabin in the azea of the proposed residence. The
ground surface in the building azea slopes strongly to moderately steep down to the west
at grades between about 12% and 16%. There is about 8 to 10 feet of elevation difference
across the proposed building azea. Vegetation consists of scruboak, grass and weeds.
Scattered cobbles and boulders were exposed on the ground surface, primarily south of
the existing cabin.
FIELD EXPLORATION
The field exploration for the project was conducted on August 9, 2006. Two exploratory
borings were drilled at the locations shown on Figure 1 to evaluate the subsurface
conditions. The borings were advanced with 4 inch diameter continuous flilght augers
powered by a track-mounted CME-45B drill rig. The borings were logged by a
representative of Hepworth-Pawlak Geotechnical, Inc.
Samples of the subsoils were taken with 1'/s inch and 2 inch I.D. spoon samplers. The
samplers were driven into the subsoils at various depths with blows from a 140 pound
hammer falling 30 inches. This testis similar to the standazd penetration test described
by ASTM Method D-1586. The penetration resistance values aze an indication of the
relative density or consistency of the subsoils. Depths at which the samples were taken
and the penetration resistance values aze shown on the Logs of Exploratory :Borings,
Figure 2. The samples were returned to our laboratory for review by the project engineer
and testing.
SUBSURFACE CONDITIONS
Graphic logs of the subsurface conditions encountered at the site aze shown on Figure 2.
The subsoils consist of about'/: foot of topsoil and 4 to 4%i feet of stiffto very stiff, sandy
to very sandy silty clay overlying relatively dense, silty sand and gravel with cobbles and
possible boulders. Hazd, sandy to very sandy silty clay was encountered beneath the sand

and gravels at depths of about 10 feet. Drilling refusal was on boulders encountered in
the lower clay deposit.
Laboratory testing performed on samples obtained from the borings included natural
moisture content, density, Atterberg limits and finer than sand size gradation analyses.
Results of swell-consolidation testing performed on a relatively undisturbed drive sample
of the hazd clays, presented on Figure 4, indicate low compressibility under existing
moisture conditions and light loading and a moderate to high expansion potential when
wetted under a constant light surchazge with a swelling pressure of about 14,000 psf. The
laboratory testing is summarized in Table 1.
No free water was encountered in the borings at the time of drilling and the; subsoils were
slightly moist.
FOUNDATION BEARING CONDITIONS
The lower clay soils encountered at the site possess an expansion potential when wetted.
The expansion potential can probably be mitigated by subexcavation of the expansive
clay and/or load concentration to reduce or prevent swelling in the event of'wetting below
the foundation bearing level. The rock content of the soil should help limit the expansion
potential. Surface runoff, landscape imgation, and utility leakage aze possible sources of
water which could cause wetting. The expansion potential of the subgrade ;should be
further evaluated at the time of construction.
DESIGN RECOA~NDATIONS
FOUNDATIONS
Considering the subsurface conditions encountered in the exploratory borin€s and the
nature of the proposed construction, we recommend the building be founded with spread
footings bearing on the natural subsoils.
The design and construction criteria presented below should be observed for a spread
footing foundation system.

1) Footings placed on the upper undisturbed natural clay soils should be
designed for an allowable bearing pressure of 2,000 psf. Footings placed
entirely on the gravel soils can be designed for an allowable; soil bearing
pressure of 3,000 psf. A minimum dead load pressure or suibexcavation of
expansive clays may be needed for footings bearing on the deeper clay
soils. Further evaluation of the deeper clay soils will be nee;ded at the time
of construction. Based on experience, we expect settlementlheave of
footings designed and constructed as discussed in this section will be about
1 inch or less. There could be some additional movement ii~the bearing
soils become wetted.
2) The footings should have a minimum width of 16 inches for continuous
walls and 2 feet for isolated pads.
3) Exterior footings and footings beneath unheated azeas should be provided
with adequate soil cover above their bearing elevation for frost protection.
Placement of foundations at ]east 42 inches below exterior grade is
typically used in this azea.
4) Continuous foundation walls should be reinforced top and bottom to span
local anomalies such as by assuming an unsupported length of at least 12
feet. Foundation walls acting as retaining structures should :ilso be
designed to resist lateral earth pressures as discussed in the "Foundation
and Retaining Walls" section of this report.
5) All existing foundations, fill and debris from prior site development,
topsoil and any loose or disturbed soils should be removed and the footing
bearing level extended down to the fum natural soils. The er:posed soils in
footing azea should then be moistened and compacted. If water seepage is
encountered, the footing areas should be dewatered before concrete
placement.
6) A representative of the geotechnical engineer should observe all footing
excavations prior to concrete placement to evaluate bearing conditions.

Foundation walls and retaining structures which are laterally supported and can be
expected to undergo only a slight amount of deflection should be designed for a lateral
earth pressure computed on the basis of an equivalent fluid unit weight of at least 55 pcf
for backfill consisting of the on-site soils. Cantilevered retaining structures which aze
sepazate from the residence and can be expected to deflect sufficiently to mobilize the full
active earth pressure condition should be designed for a lateral earth pressuure computed
on the basis of an equivalent fluid unit weight of at least 45 pcf for backfill consisting of
the on-site soils.
All foundation and retaining structures should be designed for appropriate hydrostatic and
surcharge pressures such as adjacent footings, traffic, construction materials and
equipment. The pressures recommended above assume drained conditions behind the
walls and a horizontal backfill surface. The buildup of water behind a wall or an upward
sloping backfill surface will increase the lateral pressure imposed on a foundation wall or
retaining structure. An underdrain should be provided to prevent hydrostatic pressure
buildup behind walls.
Backfill should be placed in uniform lifts and compacted to at least 90% of'the maximum
standazd Proctor density at a moisture content neaz optimum. Backfill in pavement and
walkway azeas should be compacted to at ]east 95% of the maximum standard Proctor
density. Care should be taken not to overcompact the backfill or use lazge equipment
neaz the wall, since this could cause excessive lateral pressure on the wall. Some
settlement of deep foundation wall backfill should be expected, even if the material is
placed correctly, and could result in distress to facilities constructed on the lbackfill.
The lateral resistance of foundation or retaining wall footings will be a combination of the
sliding resistance of the footing on the foundation materials and passive earth pressure
against the side of the footing. Resistance to sliding at the bottoms of the footings can be
calculated based on a coefficient of friction of 0.35 for the clay soils and 0.45 for the
gravels. Passive pressure of compacted backfill against the sides of the footings can be
calculated using an equivalent fluid unit weight of 350 pcf. The coefficient .of friction

and passive pressure values recommended above assume ultimate soil strength. Suitable
factors of safety should be included in the design to limit the strain which will occur at
the ultimate strength, particularly in the case of passive resistance. Fill placed against the
sides of the footings to resist lateral loads should be a nonexpansive granulaz material
compacted to at least 95% of the maximum standazd Proctor density at a moisture content
near optunum.
FLOOR SLABS
The natural on-site soils, exclusive of topsoil, aze suitable to support lightly loaded slab-
on-grade construction. There could be some post-construction slab movement and
distress if the bearing soils become wetted. The settlement/heave potential of the
subgrade should be further evaluated at the time of construction. To reduce; the effects of
some differential movement, floor slabs should be separated from all bearing walls and
columns with expansion joints which allow unrestrained vertical movement.. Floor slab
control joints should be used to reduce damage due to shrinkage cracking. 'The
requirements for joint spacing and slab reinforcement should be established by the
designer based on experience and the intended slab use. A minimum 4 inch. layer of free-
draining gravel should be placed beneath basement level slabs to facilitate drainage. This
material should consist of minus 2 inch aggregate with at least 50% retained on the No. 4
sieve and less than 2% passing the No. 200 sieve.
All fill materials for support of floor slabs should be compacted to at least 9:>% of
maximum standazd Proctor density at a moisture content near optimum. Required fill can
consist of the on-site granulaz soils or suitable imported granular fill devoid of vegetation,
topsoil and oversized rock.
UNDERDRAIN SYSTEM
Although free water was not encountered during our exploration, it has been our
experience in the azea and where clay soils aze present that local perched groundwater can
develop during times of heavy precipitation or seasonal runoff. Frozen ground during
spring runoff can create a perched condition. We recommend below-grade construction,

such as retaining walls, crawlspace and basement areas, be protected from. wetting and
hydrostatic pressure buildup by an underdrain system.
The drains should consist of drainpipe placed in the bottom of the wall backfill
sunounded above the invert level with free-draining granulaz material. Tt~e drain should
be placed at each level of excavation and at least 1 foot below lowest adja~yent finish
grade and sloped at a minimum I % to a suitable gravity outlet. Free-draining granular
material used in the underdrain system should contain less than 2% passing the No. 200
sieve, less than 50% passing the No. 4 sieve and have a maximum size of 2 inches. The
drain gravel backfill should be at least 1'/: feet deep.
SITE GRADING
The risk ofconstruction-induced slope instability at the site appears low provided the
building is located as planned and cut and fill depths aze limited. We assume the cut
depths for the basement level will not exceed one level, about 10 to 12 feet. Fills should
be limited to about 8 to 10 feet deep. Embankment fills should be compacted to at least
95% of the maximum standazd Proctor density neaz optimum moisture content. Prior to
fill placement, the subgrade should be cazefully prepared by removing all vegetation and
topsoil and compacting to at ]east 95% of the maximum standazd Proctor density. The fill
should be benched into the portions of the hillside exceeding 20% grade.
Permanent unretained cut and fill slopes should be graded at 2 horizontal to 1 vertical or
flatter and protected against erosion by revegetation or other means. The risk of slope
instability will be increased if seepage is encountered in cuts and flatter slopes may be
necessary. If seepage is encountered in permanent cuts, an investigation should be
conducted to determine if the seepage will adversely affect the cut stability. This office
should review site grading plans for the project prior to construction.
SURFACE DRAINAGE
The following drainage precautions should be observed during construction and
maintained at all times after the residence has been completed:
I) Inundation of the foundation excavations and underslab areas should be
avoided during construction.

2) Exterior backfill should be adjusted to neaz optimum moisture and
compacted to at least 95% of the maximum standazd Proctor density in
pavement and slab areas and to at ]east 90% of the maximLUn standazd
Proctor density in landscape areas.
3) The ground surface surrounding the exterior of the building; should be
sloped to drain away from the foundation in all directions. We
recommend a minimum slope of 12 inches in the first 10 feet in unpaved
areas and a minimum slope of 3 inches in the first 10 feet in paved aeeas.
Free-draining wall backfill should be capped with about 2 feet of the on-
site finer graded soils to reduce surface water infiltration.
4) Roof downspouts and drains should discharge well beyond the limits of all
backfill.
5) Irrigation sprinkler heads and landscaping which requires regular heavy
irrigation, such as sod, should be located at least 5 feet from foundation
walls.
LIl~IITATIONS
This study has been conducted in accordance with generally accepted geotechnical
engineering principles and practices in this azea at this time. We make no warranty either
express or implied. The conclusions and recommendations submitted in this report aze
based upon the data obtained from the exploratory borings drilled at the localtions
indicated on Figure 1, the proposed type of construction and our experience in the area.
Our services do not include determining the presence, prevention or possibility of mold or
other biological contaminants (MOBC) developing in the future. If the clierd is
concerned about MOBC, then a professional in this special field ofpractice should be
consulted. Our findings include interpolation and extrapolation of the subswrface
conditions identified at the exploratory borings and variafions in the subsurface
conditions may not become evident until excavation is performed. If conditions
encountered during construction appeaz different from those described in this report, we
should be notified so that re-evaluation of the recommendations may be made.

Purpose and Scope of Report
This study evaluates 113 Trentaz Drive from a storm water management perspective. It
supplies data, calculations, and design criteria that will be used to mitigate the site concerning
storm runoff and erosion control.
Runoff from snowmelt is typically very large in volume but because it happens over a much
longer time period, the peak flows are generally much less than a rainfali event. Therefore
storm water is defined in this study to be surface water that is a direct result From a rainfall
event.
Storm water management in this study is concerned with managing the quantity of water
expected from the site in accordance with typical engineering and hydrologic practices as well
as protecting site discharge by means of best management practices for erosion control. All
flows are listed in units of cubic feet per second (cfs) unless otherwise noted.
This study will provide a project overview, a brief description of the methodology, a
discussion of the analysis performed, a description of the erosion control anticipated for the
site, and the results of the analysis.
Project Overview
The project is a residence construction at 1 l3 Trentaz Drive in Pitkin County, Colorado. The
existing residence will be razed and the grounds relandscaped. Building plans are available
from Chazles Cunniffe Architects; grading and landscaping plans aze available from Greg
Mozian and Associates. The project elevation is approximately 7,900 feet above sea level and
located at Latitude 39°13'49.5" North and Longitude L06°51'31.4" West. The: property area
is approximately 6.991 acres and the approximate area of disturbance due to construction
activities is approximately 3.931 acres. Storm water will ultimately drain to the; Roaring Fork
River through a series of roadside ditches and culverts.
[t is the intent of this Drainage Plan to: 1) Convey the captured mnoff flov~s through the
project site, 2) Provide detention sufficient enough that runoff from the proposed site does not
exceed the calculated flows for the existing condition, and 3) Reduce the pollutants in
stormwater discharges from erosion associated with construction activity.
Methodology
The design of a storm water management plan begins with a calculation of the volume of
water that will be produced from a rainfall event. The Rational Method was used to estimate
the amount of runoff that will occur. This method calculates runoff (Q) in cubic feet per
second (cfs) from basin area (A) in acres, runoff coefficient (C), and rainfall intensity (I) in
inches per hour:

When acres and inches per hour are used as the units, the conversion mto cubic feet per
second is L008 but is usually ignored and it has been in this report. The runoff coefficient is
a dimensionless coefficient.
Basin Area
Drainage basins have the characteristic that any precipitation falling vrithin that area
will drain to the same point of discharge. The project basins were delineated from
project topography, project site plan, and building architecture.
Runoff Coeffecient
A runoff coefficient is assigned to each basin that gives a relationship between the
amount of precipitation that becomes surface water and the amount of water that is
lost to infiltration, evaporation, or transpiration. The runoff coefficient is a function of
surface and/or land-use. Because the land-use and the surface cover often vary
through the project and from the pre-project and past-project conditions, a composite
coefficient is assigned to each drainage basin, based on the weight oli the areas and
their respective coefficients.
Rainfall Intensity
Rainfall intensity is determined from intensity duration frequency curves, or IDF
curves. IDF curves are graphs of, more or less pazallel, frequency curves that yield
rainfall intensities based on storm durations.
Frequency: The return frequency of a rainfall storm is the statistical
probability that a given storm event will occur on average in a given period.
For instance a 100-year storm has the statistical probability of occurring once
in a 100 yeaz span or it has a 1% chance of occurring in any gliven yeaz. It is
important to emphasize that it is based on probability statistics and therefore
does not reflect actual storm frequency. Storms of a 100-year magnitude can
occur in sequential years, even in the same year. The retum frequency of
design is chosen and then referred to as the design storm.
Duration: The duration of a storm is chosen to coincide with the time of
concentration. The kinematic wave flow equation was used [o estimate the
time of concentration. Length and velocity of flow are used to calculate time.
Three flow elements are used: overland-flow, collector-charmel flow, and
main-channel flow. The parameters needed to determine the flow elements
include length, slope, Manning's "n" value, and channel shape. The theory
states that if the duration is equal to the time of concentration, the length of
time will be adequate For the entire basin to contribute flow.

Analysis
Basin areas were determined based on architecrural design, proposed grading, and project
topography. A site visit determined that the drainage basin area is relatively small, more or
less bounded by Trentaz Drive that diverts runoff from above and the Salvation Ditch that
captures flows below Trentaz Drive. The property extends to McLain Flats Road below the
Salvation ditch. Existing and proposed basin delineations are shown on Figures I and 2.
Runoff coefficients were determined from descriptions of land use and/or ground cover for
the basin. The existing vegetation is mainly oak brush and sage with grass and weed
understory. Ornamental shrubs, trees, flower beds and turf will replace some of the existing
vegetation while a large portion of native vegetation will remain. An existing gravel
driveway is anticipated to be paved. The individual basin concentration paths were calculated
based on project topography and proposed grading. The rainfall intensity was determined by
using the 100-year storm curve, calculated storm duration, and [he IDF curve for the City of
Aspen. The design storm was determined from Section 4.27.01 from the Pitkin County
Assets Manaeement Plan, stating culvert design fora 100-year storm.
The flows for the basins were calculated using the Rational method describt:d above. All
calculations are attached for review in the Appendix.

Minimum pipe sizes to convey the runoff flows were determined using the Manning's
equation for open channel flow. Minimum pipe slope of 2%, corrugated material, and project
flows were used to compute pipe sizes. Pipe sizing calculations are attached in the Appendix.
Pipe routing is shown on the Drainage Plan, Figure Cl.
The channel shape used is a "V" type ditch with 2:1 horizontal to vertical side slopes with a
depth of 12". The erosive flow velocity for vegetated, earth channels is between 4 and 5 feet
per second (fps). Slopes greater than 5°.% generate erosive velocities and will need to be
armored. Riprap is usually the preferred armor due to its natural appearance and availability.
Calculations are provided in the Appendix.

Existing flows were compared to the proposed project flows. Since proposed exceeds
existing levels, detention is necessary. Detention volume was estimated using the FAA
method. Detention volume for Area 1 is 796 cubic feet and will be provided. on top of the
normal water surface elevation of the proposed water feature. Detention volume for Area 2 is
859 cubic feet and will be provided in a dry pond.
Erosion Control
Construction activities can be expected to increase the potential for storm runoff to erode the
site. Temporary structures have been designed to contain sediment on the site and to mitigate
erosion from construction activities. Straw bale check dams are placed in drainage swales and
ditches. [nlets are protected with straw bales. Riprap is placed on the outlet shies of culverts.
Silt fencing is shown downhill of construction activities. The permanent structures will be
riprap protection at outlets and on ditch thalwegs for slopes where velocities aze erosive.
Also, revegetation and landscaping is planned with turf, landscape plants, and/or native
grasses per Pitkin County seed mix. Currently the existing vegetative cover is mature native
materials. The proposed revegetation is expected to match the coverage percentage and
therefore the quality of the storm water discharge from the site is expected to meet existing
levels.
Results
Pipe culverts aze sized to accommodate flows from the impervious areas of the site. Culverts
and ditches convey major contributions through the site. All culverts should have a 2%
minimum or steeper slope. Point dischazges of concentrated flows from the site have been
avoided by means of riprap aprons to spread flows and reduce velocities. Channels are lined
with riprap to protect the thalweg from erosive velocities. Calculations show erosive
velocities at slopes of 5% or greater. The entire roof azea could be drained with a single 8"
line.
The grading plan proposes to have the Salvation Ditch piped, with fill placed across the
current ditch alignment. This decreases the area of Area 1 and expands the azea of Area 2. All
of the impervious surfaces aze being placed in Area 1. There aze no impervious surfaces
planned in Area 2. Both areas will require detention to maintain existing peak flows.
Detention volumes were calculated using the difference from existing and proposed peak
flows. Detention for Area 1 is to be provided on top of the proposed pond. The proposed
surface area of the pond is 3,550 square feet and the volume would create a surface elevation
of 2.5" above the normal water elevation. The pond is relatively small and wave action
should be minor. A free board of 6" above the 100-year elevation should be sufficient. The
dry pond for Area 2 is shown on Sheet Cl as being 20'wide by 20' long by 18" deep. This
pond will have an 8" PVC outlet that limits the flows to less than or equivalent to the existing
levels. Calculations are attached in the Appendix.
Because the construction on the site is anticipated to disturb more than one acre, a permit for
stormwater discharge is required from the State. The Drainage & Erosion Control plan have
been designed to meet the requirements of the Stormwater Management Plan that is required.

Recommendations of the geotechnical engineer are to be used in conjunction with the
drainage plan and if a conflict arises should be brought to our attention to revise the
recommendations accordingly.
Although this study refers to a 100-year storm, it is speaking from a statistical standpoint that
the flood has a 1% chance of occurring within any given year. [t does not actually relate to
the frequency of flood occurrence. Also the 100 year flood can be exceeded in any given
year, and it can occur more than once in any year, and can happen in sequential years.

The existing cabin is generally on a slope of less than 20%. The vegetation is a
combination of scattered oak and serviceberry with continuous sage and native grass. I
determine the site to be a Medium Wildfire Hazard' The site provides the opportunity to
develop and maintain defensible space. ~+
Vegetation.Management and Modification Recommended:
1. Around the proposed house and accessory buildings and beyond the furthermost
projection of combustible construction of these buildings for a distance of 15-feet the
area should be of primarily noncombustible hard scape surfaces. V/oody vegetation
should not be planted within this azea. Firewood or other combustible materials
should not be stored within this area. If the owner wouldlike to maintain bmdon if
or small .clusters of trees or shrubs in the vicinity of the buildings this may
the 15-foot area is extended outwazd from the furthest growth expected from the
mature trees and shrubs. In other words, these trees and shrubs should have defensible
space as the buildings do. Crowns of vegetation within these clusters should be at
Ieastl0-feet from any portion of the buildings. Limbs of trees within these clusters
should be pruned to one half the height of the tree or 10-feet whichever is less.
2. Beyond the 15-foot area up to 35-feet or to the property line mamtam natural ~~OS

then the diameter of the cluster should be no greater than 25 feet and the distance
between clusters should be greater than 25 feet. Ideally the plant material growing
between trees and clusters of bushes or trees is grass maintained at 6-inches or less.
Thin and remove lower branches of brush or shrubs within clusters or individual
plants to eliminate ladder fuel. Most of the shrubs that will be cut are vigorous
sprouting plants and the cut ends should be treated with a product named Garlon® or
an equivalent by a by person licensed to apply herbicides. Cut materials should be
either removed or chipped and spread.
3. For a distance of 100-feet or to the property.line of the proposed house and accessory
buildings remove all standing dead and deadfall. Cut and collected materials should
be removed, chipped and spread or burned after obtaining appropriate permits.
New Construction, Additions:
Pitkin County has Structural Design and Construction Requirements, the following are
pazaphrased from 3-80-070 Wildfire Hazard Areas and may or may not contain exact
language but it is intended to be consistent with the intent and purpose of the Pitkin
County requirements:
Roofs shall be constructed with aClass-A roof assembly.as defined in the 2003
International Building Code (IBC) Section 1505.2. Wood shakelshingle roof coverings
aze prohibited in all wildfire hazard areas. Roofs with less than a 3:12 pitch are not
permitted in wildfire aeeas unless they comply with the following:
1) All roof coverings shall be Class-A materials approved for installation on
a Class-A roof assembly.
2) All roof coverings shall have a surface that snau racrlttate the natural
process of clearing the roof.
3) All roof designs shall facilitate the natural process of clearing roof debris.
Protrusions above the roofline, such as parapets, shall be prohibited.
4) Roofs shall be installed as required by the adopted building code and shall
have a minimum slope of 1:48.
5) All roof designs, coverings or equivalent assemblies shall be specifically
approved by the Fire Marshal prior to submittal of a building permit
application.
Vents: Vents shall be screened with corrosive resistant wire mesh, with
mesh one-fourth inch ('/,") maximum.
Maintenance:
a) Roof's and gutters shall be kept cleaz of debris.
b) Area shall be kept cleaz of all litter; slash and flammable debris.

• 2. APPLICANT understands and agrees that Pitkin County Ordinance No. 018-2004
• establishes a fee structure for land use applications and the payment of all processing fees is a
~ condition precedent to a determination of application completeness. The fee structure is based on
~ the COUNTY'S policy that development shall pay, in full, the cost of development review in the
COUNTY. Fees have been set to be consistent and fair to the public and to reflect the expense
•' incurred in providing such services to the public.

~ 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the
• proposed PROJECT, it may not be possible at the time of application to ascertain the full extent of the
costs involved in processing the application.

• 4• APPLICANT and COUNTY agree that fees charged for the processing of land use
• applications shall accumulate if an application includes more than one type of land use review.
• 5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to
• complete processing or present sufficient information to the Planning Commission and/or Board of
`County Commissioners to enable the Planning Commission and/or Board of County Commissioners
• to make legally required findings for project approval, unless current billings are paid in full prior to
• decision.
• 6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right
• to collect full fees prior to a determination of application completeness, APPLICANT shall pay a base

The Planning Office has completed its preliminary review of the captioned application. We have determined
that this application is complete. After a more detailed review of the submittal information, additional
information specific to the application may be requested in order to adequately review and process the
