COLORADO, GRANTING A REZONING FROM
VILLAGE RESIDENTIAL (VR) TO VILLAGE COMMERCIAL (VC)
FOR THE WAGNER PROPERTY

Recitals
1. Stephen and Lisa Wagner, hereafter "Applicants", have applied to the Pitkin County Board of
County Commissioners, "Board", for approval to rezone one third (1/3) of their property from
VR to VC.
2. Currently, two thirds (2/3) of the subject property, Lots 7 and 8, are zoned VC and one third
(1/3) of the property, Lot 9, is zoned VR.
3. Said parcel is addressed as 475 Redstone Boulevard and is more specifically described as Lots 7,
8 and 9, Block 5, Kistler Subdivision of Redstone, along with an all inclusive, exclusive
easement for the use of the property lying west of said lots to the center of the Crystal River and
between the linear extension of the north and south side lot lines of said lots. The legal
description is attached as Exhibit A.
4. The Planning and Zoning Commission heard this rezoning application at their regularly
scheduled public meeting on May 5, 1998, at which time they recommended approval of the
requested zoning change.
5. The Board heard the rezoning request at their regularly scheduled and duly noticed public
hearing on May 27, 1998, at which time evidence and testimony were presented with respect to
this application.
6. The Applicants wish to increase their current bed and breakfast operation, which consists of four
pillows (two bedrooms), to a lodge type operation, which will consist of eight pillows (four
bedrooms).
7. The Board finds that this rezoning application is consistent with the Redstone Master Plan and
the Pitkin County Land Use Code.
NOW THEREFORE BE IT ORDAINED by the Pitkin County Board of County
Commissioners that it hereby rezones Lot 9, Block 5, Kistler Subdivision of Redstone, and the property
lying west of said lot to the center of the Crystal River and between the linear extension of the north and
south side lot lines of said Lot 9, as described in Exhibit A, from VR to VC
NOTICE OF PUBLIC HEARING PUBLISHED IN THE ASPEN TIME on the 25th day of
April, 1998.
INTRODUCED AND FIRST READ at the regular meeting and public hearing on the 27th day
of May, 1998.
APPROVED AND ADOPTED AFTER SECOND READING on the l Oth day of June, 1998.
