AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO CONFIRMING THE CONVEYANCE OF A
QUIT CLAIM DEED FROM PITKIN COUNTY TO THE CITY OF ASPEN FOR
PROPERTY KNOWN AS THE YELLOW BRICK
ORDINANCE #98- A/
RECITALS
1. Pitkin County is the owner of property known as the Yellow Brick, Lots 0
and P, Block 57, City and Townsite of Aspen, Colorado as more specifically described on
Exhibit A attached hereto and incorporated by this reference.
2. Pitkin County has agreed to deed this property to the City of Aspen upon
the following condition:
Provided that this property be used for only parks,
recreation, daycare, school, education or open space
purposes.
NOW THEREFORE, be it ordained by the Board of County Commissioners of
Pitkin County, Colorado that the Board of County Commissioners does hereby confirm
the conveyance of real property from the Board of County Commissioners of Pitkin
County, Colorado to the City of Aspen as more fully described in Exhibit A attached
hereto authorizes the Chair of the Board of County Commissioners to execute the Quit
Claim Deed on behalf of the entire Board.

THE 14th DAY OF JULY, 1998.
NOTICE OF PUBLIC HEARING PUBLISHED IN THE WEEKEND EDITION

CONFIRMED UPON SECOND READING AND PUBLIC HEARING ON THE
12TH DAY OF AUGUST, 1998.

QUIT CLAIM DEED
THIS DEED, made this day of , 1998, between the Board of
County Commissioners of Pitkin County, State of Colorado, Grantor and the City of
Aspen, Colorado, whose legal address is 130 South Galena Street, Aspen, Colorado,
Grantee,
WITNESSETH that the grantor, for and in consideration of the sum of TEN DOLLARS
($10.00) the receipt and sufficiency of which is hereby acknowledged, has remised,
released, sold, conveyed and QUIT CLAIMED, and by these presents does remise,
release, sell, convey, and QUIT CLAIM unto the grantee, its heirs, successors, and
assigns, forever, all the right, title, interest, claim and demand which the grantor has in
and to the real property, together with improvements, if any, situate, lying and being in
the County of Pitkin, State of Colorado, described as follows:
Lots 0 and P, Block 57
City and Townsite of Aspen, Colorado
subject to the following terms and conditions which shall constitute a covenant running
with the land for the benefit of Grantor, that this property may be used only for parks,
recreation, daycare, school, education or open space purposes.
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances
and privileges thereunto belong or in anywise thereunto appertaining, and all the estate,
right, title, interest and claim whatsoever, of the grantor, either in law or equity, to the
only proper use, benefit and behalf of the grantee, its heirs and assigns forever.
IN WITNESS WHEREOF, the grant to has executed this deed on the date set forth above.
