Pursuant to Section 3-200-080 of the Land Use Code, Connie and Marl: Nagle ("Applicant") have applied to the Community Development Director of Pitkin County,'Colorado ("Director") to amend the prior approval to realign the driveway to lessen impacts on steep slopes and irrigated areas, and to provide an adequate turning radius and passing space for emergency vehicles ?. The parcel is referred to as Parcel 1, Sopris Mountain Ranch, and is more specifically described in L--xhibit A. 3. "fhe property is zoned RS-30 and contains approximately 37 acres. 4. The Board of County Connnissioners ("BOCC") originally <~ranted 1041 hazard review and ~~eneral submission approval, pursuant to Resolution No. 95-7. The 1041 site plan was recorded in Plat Book 36 at Page 47. The BOCC subsequently ~ anted extensions of vested rights pursuant to Resolution Nos. 98-58 and 107-2001. The vested rights expired on .tune 13, 2004. 5. The approved driveway allotment camtot be construpted in complivtce with the County's driveway standards,, given the steep slopes, artd the driveway crosses directly through the middle of the irrigated pasture. 6. The County Engineer and the Basalt Fire Marshal have reviewed and approved the proposed amendment. The Sopris Mountain Ranch Homeowners Association also supports the request. 7. The Director finds that the proposed amendment will not change the use of The proposed development or the basic character of the (and, is consistent with action taken during The original review, does not increase off-site impacts w'the allowable floor area, and will not endanger the public health, safety or welfare. 8. T'he Director further finds that the proposed amendments will not create any additional impacts on 1041 areas, and that the encroachment of the proposed driveway on slopes in excess of 30°/<, complies with Section 3-80-OSO.C.1.c.ii.e, as the driveway encroaches on slopes of 30-40% for less than 100 linear feet, the driveway is not within an avalanche, landslide or rockfall hazard area, and there is no alternative aligmuent on slopes ofless than 30%. The architects recently staked the initially proposed design, and it was determined that the design intruded too much into the meadows and occurred on excessively steep slopes which were not included in the current survey. Therefore, a new and improved design has been developed where the driveway would impede less into the flood-irrigated fields and avoid the steep slopes. The new design should prove even more effective in complying with the County's current regulations and the goal of protecting public safety. It is our understanding that you have tentatively approved this new change as part of a site visit. Enclosed are two 24" X 36"copies of the new design for your reference. The property is located in Sopris Mountain Ranch and consists of "' approximately thirty-seven acres, which will become the site of asingle-family residence with a barn The applicant would like to relocate the driveway that was approved with the original 1041 Hazard Review. The approved driveway cuts excessively through slopes over 30% and goes in a direct path upslope to the site of the single-family residence. All measures will be taken to mitigate any negative impacts which the driveway may cause. As required for the RS-30 zone district, road development will be `"" located outside of irrigated lands. The proposed driveway runs along flood-irrigated fields but the design will incur minimal impact on the fields and slopes while the least number of trees possible will be removed All efforts will be mane to minimize total impact of driveway construction, and cuts and fills will be revegetated with native plant materials. ~, After a meeting with 13ud Bylaz, Ptkin County Engineer, and Bill Harding, Basalt Fire Mazshall, the design has been adjusted to meet the fire marshatl's requirements. The fuming radii now meet the County minimum requirement of 50 foot radius. It was agreed that the alignment shown in the attached drawing wilt suffice in meeting the County and Town of Basalt's'road requirernents. The width of the driveway will start at 16 feet and neck down to 14 feet, as the road approaches the residence. The fire truck turnaround and staging area will occur on the ~., pavement near the barn which will be located in the accessory building envelope. In order to maintain the Ranch's unique character, to preserve the natural beauty and balance of the site and maintain the quality of open space, Building Envelopes have been identified for each Lot. These envelopes have been defined to maximize each site's best features with con- sideration for natural terrain, views, privacy, vegetation, orientation, access and relationship to adjacent sites. These guidelines have been prepared to provide guidance and direction to the owners and professionals involved with the design and construction of homes within these envelopes. The underlying goals of these guidelines are to: 1. Protect the natural ecosystem. 2. Minimize the visual impact of site development on roads and other homesites. 3. Preserve the existing character of Sopris Mountain Ranch. 4. Preserve the view corridor to Sopris Mountain B. Relationship To Protecfive Covenants The Design Guidelines established herein are supplemental to restrictions and processes established in the Declaration of Protective Covenants for "" Sopris Mountain Ranch. DESIGN STANDAflDS The Design Guidelines address residential development at two levels: Site Planning and Architectural Design. Site planning standards refer to overall improvements in the Building Envelope and driveway access corridor. Architectural design standards `~ refer to structures in the Building Envelope. A. Site Planning Standar~rls ~» Every Lot at Sopris Mountain Ranch has its own unique land form features and chazacter. Whenever possitite, these features should be preserved and reinforced by any level of construction and design. The objectives are to fit the improvements to the site in a way that leaves the natural features of ~ Sopris Mountain Ranch intact, treating buildings and roads as an integral part of the site. Any proposed improve- ments should be carefully planned to minimize disruption to the exist- ing ecosystem or alteration of the topography. The prescribed envelopes have been located to minimize grading and avoid primary natural drainage systems. Specifically, new improvements should respond to the following: No grading shall occur outside the Building Envelope except for erasion repair and meadow repair approved by the Design Committee. Cuts and fi[]s shall be maximum 2:1 slopes unless mechanical retainage is utilized. Within the Building Envelope, no exposed cuts and fills wilt be allowed, including exposed drainage ditches, to minimize the visual impact of new construction. Intense}y developed areas will occur on graded platforms or ledges. Areas requir- ing level changes will be accomplished with cribbing or retaining walls as architectural extensions of the building. Architectural Standards Sopris Mountain Ranch Association recognizes the need for an owner, through his architect, to design with as much flexibility as passible to meet the owner's needs, ^~ taste and individuality. These criteria have been established to govern building massing and color, to reduce visual impact by conforming to the surrounding topography, and to minimize damage to the existing landscape. A fugitive dust control plan is required for approval by Pitkin County and the Design Committee prior to obtaining building permits or beginning construc- tion. E. Construction activity shall be limited to a period of time commencing at 7:00 a.m. and ending no later than 6:30 p.m. each day, with no construction activi- ty permitted on Sundays. The speed limit on the Ranch is 25 m.p.h.; traveling in excess of that speed may result in removal from the Ranch. G.
