APPLICANTS: Candace and Brad Resnick LOCATION: The property is located at 5353 West Sopris Creek Road and is described as lot A of flee Resnick Subdivision. ZONING/LOT SIZE: The property is zoned RS-30 PUD and contains 31 acres. ROUND: The subject parcel is part of the Resnick subdivision that was granted final plat app oval in 1392 pursuant to Resolution No. 92-384. EXISTING CONDITYONS: This application was referred but no comments were`received from the County Attorney. • Joanna Schaffner, the Pitkin County Zoning Officer, reviewed the application and indicated that this particular lot does not require an Extension of Vested Rights `since it'is part of a`Boar3 approved subdivision. • Cindy Christensen of the Housing Office, reviewed the application'. and had no concerns. ANALYSIS OF PROPOSAL ExTENSiox OF VESTED RIGHTS: The following is a review and analysis of the proposal relative to the applicable standards of Section 4-140-030 of the Land Use, Code. In reviewing a request for the reinstatement of vested. property rights, the Board shall consider, but not be limited to, the following criteria: The applicant's compliance with any conditions requiring performance prior to the date of application for extension or reinstatement of vested rights. Response: It appears that the applicant has satisfied all conditions requiring performance prior to final plat approval of the Resnick Subdivision which include, but are not limited to: A,, Adoption and recordation of subdivision covenants B. An easement agreement between the Resnicks and Pitkin County for Dinkle Lake Road was executed and approved. C. In lieu of the, required memorandum of understanding with Mt. Sopris Ditch owners, the applicants have provided access and have relieved the ditch owners of any responsibility for damage to the property. D. The required park dedication fee has been paid. Satisfaction of other conditions is required prior to building permit submission. 2. The progress made in pursuing the project to date, including the effort to obtain any other permits, such as building permits, and the expenditures made by the applicant in pursuing the project. Response: There have been no efforts made to obtain building permits pursuant to the original approval 3. The nature and extent of any benefits already received by the County as a result of project approval, such as impact fees or land dedications. Response: The applicants have provided the park dedication fee as required at final plat, but still require payment of a housing mitigation fee prior to issuance of a building permit. 4. The needs of the County and the applicant that would be served by approval of the extension or reinstatement request. Response: The needs of the Applicant would be served by vesting the property from further land nse restrictions for a three year period. The needs of the County would not be served by this extension by giving up the right to enforce newly created laud use regulations on the property during the vesting period. ~. S. The subject property is located at 5353 West Sopris Creek Road, near the intersection of West Sopris Creek Road and the Dinkle Lake Road. The applicants received approval to subdivide 52 acres'of land into tow 31 acre parcels. At the time of application the property was improved with one single family residence, and no action has been taken. to improve the newly created lot. The following approvals were granted by the County with respect to this' project, and the Resolutions are attached: 1. Resolution No. PZ 91-46, forwarding GMQS scored to the Board of County Commissioners with a recommendation for approval. 2. Easement Agreement for Dinkle Lake Road (Book 706, Page 124). 8. 1041 Hazard Map. 9. Letter of Nicholas Lampiris re: avalanche hazard dated July 5; 1995. As can be seen from the attached resolutions of approval, this project did not present unique issues that required any conditions not typical for residential subdivision approval in Pitkin County. The project received a satisfactory scoring in the GIGIQS competition, and general and detailed submission approval was fairly routine. The opinions expressed in the May 31, 1991, certification letter, remain in effect, as title issues, including merger, remain unchanged today. Page 3 With respect to 1041 issues, it is recognized that these regulations have been amended since the time of this application's approval. The. 1041 issues of concern at the time of the application and uts approval included geologic hazard (slopes exceeding 30%), geologic hazard (potential avalanche), wildfire hazard, and wildlife hazard, as the property is located near a mapped elk calving area and within one-half mile of an elk migration route. Appropriate conditions were adopted to address each of these 1041 issues. 'With regard to steep slopes, the conditions of approval preclude development on slopes exceeding 15%. Conditions for wildfire hazard were included within the conditions of approval, including a requirement for a reservoir or pond on the pzoperty with a capacity of 2,000 gallons. Appropriate restrictions. are embodied in the subdivision cavenants. With respect to the wildlife issue, the property is located outside mapped 1041 wildlife areas. Randy Cote of the Division_of Wildlife stated no objections to the proposed building envelope, which was selected based_upon his recommendation. The migration corridor located on BLM[ lands east of the Resnickproperty is separated from the property by natural topography. At the boundary of the Resnick parcel, the land rises on a hillside to a ridge on BLIvI lands which serves as the migration corridor. The proposed building envelope is well removed from the migration corridor to preclude any impact, along with other standard conditions ,for wildlife approval. It should be noted that the existing residence is located much closer to the wildlife areas than the approved new building envelope. The calving area is also naturally separated from the property, being located on a hillside south of the property across and above the Dinkle Lake Road which serves as a natural boundary between the Resnick property and the calving area. With respect to avalanche hazard, the avalanche maps designate a portion of the property located immediately below the Dinkle Lake: Road as a potential avalanche hazard.. However, this slope is heavily wooded and there is no evidence of historic. avalanches having occurred on the property. In addition, the slope is of moderate length and the building envelope ns entirely free from avalanche hazard, by being located outside the hazard and away from any potential avalanche paths. Natural vegetation on the hillside designated as potential avalanche hazard must remain in place as a condition of approval. It was determined at the time of approval that further mitigation of th.e hazard was not necessary. We have included with this application the letter of Nicholas Lampiris, indicating that there is no avalanche concern on the Resnick property based upon his recent investigation. Section 4-1403 identifies the criteria for. approval of an application for extension of vested rights. Each of these criteria are addressed as follows; ,.. , --~ ~~. -. Page 4 1. The applicant has complied with any conditions requiring performance prior to the date of application for extension of vested rights. A Declaration of Covenants has been adopted and is recorded at Book 706, Page 120 with corrective amendments recorded at Book 712, Page 755. These covenants incorporate the conditions of approval regazding 1041 hazards, utilitizs; and other issues, to assure compliance with these conditions upon sale of either lot of construction on the newly created lot. In addition, the Easement Agreement required by the approval between the Resnicks and Pitkin County was executed and approved by the Board and recorded at Book 706, Page 124 of the records for Pitkin County. This easement agreement provides the County with an easement for the Dinkle Lake Road where rt traverses the Grantors' property. The approvals required the Resnicks to provide the Mt Sopi`is Ditch owrieis' with a Memorandum, of Understanding acceptable to the County Attorney. The County Attorney approved the MOU and the Resnicks executed it, but the ditch owners have never accepted it. Nevertheless, it was recorded at Book 706, Page 129, to show compliance by the Resnicks. No other conditions of approval have required compliance to date. 2. The application was originally pursued based upon the Resnicks' desire to provide a home and,building site for a member of the Resnick family. However, no effort has been made to develop the property for this or any other purpose, and the applicants have no imrnediate need or desire to sell the new lot or burld a home thereon. While the. applicants have not pursued the project in terms of requesting permits for development, they have complied with all applicable requirements of the County prerequisite to development, including the dedication of the easement and the recording of covenants to assure that the property is dedicated to the purposes and restrictions of the approvals which have been granted. 3. With respect to the benefits received by the County, as noted above, the easement for the Dinkle Lake Road has been granted to the County and accepted by it. The park dedication fee required for approval has been paid. A housing impact fee must be paid prior to the issuance of a building permit for a home on the newly created lot. 4. The granting of this approval would leave the property in its current state, i.e., development density of one unit for 62 acres from the standpoint of actual development. df this application is approved, the Resnick's will not. be required to seek immediately a building permit for further development of the property. 5.
