The property is referred to as Lot 30, Sopris Mountain Ranch, and is more specifically described in Exhibit A. 3. The property is zoned RS-30. The property contains approximately 35.03 acres and is conforming in size. 4. The Hearing Officer, at a duly noticed public hearing on July 16, 2002, reviewed this application, and at which time evidence and testimony were presented withrespect to this application. 5. The Heazing Officer fords that this application proposes development in the best possible location, given the hazazds identified onthe property. NOW THEREFORE BE TT RESOLVED, by the Pitkin County Hearing Officer that he does , hereby grant approval to the Mandich 1041 Hazazd Review and Conceptual Submission, subject to the following conditions which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application, dated April 24, 2002, and'public meetings. 2. The Applicant shall record a 24 x 36 inch mylaz 1041 Hazard Review. Site Plan in accordance to Section 5-70-040 of the Land Use. Code. The site plan shall also be submitted in a digital format for integration into the County Geographic Information System (GIS). The site plan shall inchude the following: A. The building envelope shall be extended to the main ranch road in order to encompass all disturbance, including the construction for the driveway. The Applicant may consider establishing an access envelope. between the building envelope and main ranch road, Wildfire mitigation shall be as follows: A. Defensible Space: 1. Woody vegetation shall not be planted with this perimeter. Flammable materials (i.e. firewood) should not be stored in this area. b. For a distance of 100 feet in every direction from the structures, thin and clump existing oak/serviceberry. Existing oak is approximately 8 feet in height, therefore, clumps that remain shall be no lazger than 16 feet in diameter. The area between the clumps where woody vegetation (i.e, oak/serviceberry) has been removed shall be 24 feet wide. The vegetation remaining between clumps shall be grass-like. c. The Applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Structural Desien and Construction Requirements: 1. Roofs shall have anon-combustible roof covering on a Class A assembly. Wood shake/shingle roof covering are prohibited in all wildfire hazard areas. Roofs with less than 3:12 pitch are not permitted in 1041 Wildfire Areas unless they comply with the following: a. All roof coverings shall be non-combustible materials as defined in the Uniform Building Code (UBC) 1997 Section 1504 and installed on a Class A roof assembly. b. All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. c. All roof design shall facilitate the natural process of clearing roof debris. Protrusions above the roofline, such as parapets, shall be prohibited d. Roofs shall be installed as required by UBC 1997 Chapter 15 and shall have a minimum slope of 1:48. e. All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshall prior to submittal of a building permit application. 2. All vents shall be screened with corrosive resistant wire mesh of one quarter inch maximum. C. Maintenance: 1. Roofs and gutters shall be kept clear of debris. 2. Yards shall be kept clear of all litter, slash, and flammable debris. 3. The septic system shall comply with the setback requirements from surface and groundwater sources. A qualified professional engineer must design the system. The septic system shall be located within the approved building envelope. The septic system may be located outside of the building envelope, if approved by the Environmental Health and Community Development Departments. 8. Prior to submittal of a septic permit, the Applicant shall provide documentation of adequate quality and quantity of water to the Environmental Health Department. The well shall be located within the approved building envelope. The well may be located outside of the building envelope, if approved by the Environmental Health and Community Development Departments. 9. A fireplace/woodstove application must be filed and approved by the Community Development Department prior to the issuance of a building permit. 10. The Applicant shall comply with al] codes and requirements of the Basalt and Rural Fire Protection District. The 1,000-gallon cistern shall meet the requirement of the District and shall be located within the approved building envelope. 11. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the corners of the building envelope and install construction fencing around the construction site within the perimeter of the building envelope. The fencing shall remain in place until issuance of certificate of occupancy. 12. The Applicant shall submit a Drainage and Erosion Control Plau to the County Engineer for review and approval, prior to the submittal for any building permits. The plan shall address the management of runoff during construction aztd after construction is complete. 13. At the time of building permit application submittal for any new development, the Applicant shall submit, for review and approval by the County Engineer, a Construction Management Plan in accordance with the Asset Management Plan. The Construction Management Plan shalTindicate that vehicles associated with construction (i.e. employee traffic, construction vehicles, staging and deliveries) shall not violate County Law, such as parking on County rights-of--way. 14. Prior to the submittal of anybuilding permits, the Applicant shall obtain an Access/Driveway Development Permit approved by the County Engineer. 15. All lighting shall comply with the regulations of the Land Use Code. 16. All development must comply with the provisions of the Pitkin County Noxious Weed Management Plan. 17. Pursuant to Ordinance No. 022-2000, the Applicant is subject to the Fair Share Requirements and shall pay a road impact fee as calculated at the time of building pennit issuance for any new development or expansion of the existing residence or accessory structures. 18. Proof of adequate quantity and quality of water shall be'provided to the Envirbnmen"tal Health Department prior to submission of an individual wastewater disposal system (ISDS) permit for the pazcel. The well shall be located within the approved building envelope. If the well must be located outside of the building envelope, the Applicant shall seek an amendment to the building envelope. Sewer: The Applicant has indicated that the property will be serviced by an Individual Sewage Disposal System to be located within the proposed building envelope Aseptic system permit is required by the Environmental Health Department prior to the issuance of anybuilding permits. The property does not contain any significant mapped or field verified bighorn, mule deer, or elk habitats. The property lies within a broad elk migration pattern that extends from summer range around Mount Sopris and tha ;/1k Mountain Ridge outto Capital Peak to winter range on the. Crown and Light Hill. The dominant vegetation on the property is Gambel oak-serviceberry dominated mixed mountain shrubland with some small pockets of mountain sage. A ditch runs though the property that. supports a modest riparian ecological community. Wildlife would benefit from the persistence of this'habitat. The construction of a single family home on this site is unlikely to significantly impact elk migration patterns, migration habitat, critical habitat, or winter range. Black bears are v~ active in the vicinity of the Music School and there aze active human-bear conflicts. Given the above site assessment, the following conditions will reduce the impacts of the proposed development on ecological communities: 1. The applicant must comply with all of the General Standards as described in §3-80.80(A) of the Land Use Code. 2. The 2001 Wildlife Protection Ordinance (# 010 - 2001) requires installation and use of approved bear-proof trash containers. ~lerification of this condition should be required before issuance of a certificate of occupancy. Any azeas disturbed outside the building envelope must be revegetated with native plants according to a revegetation plan submitted by the applicant and approved by the County prior to issuance of a certificate of occupancy. This plan must contain the following elements: a. The name of the project; b. The name, address and phone number of the person preparing the Revegetation Plan; c.
