RECITALS
Sandra Schiralli ("Applicant") has applied to the Pitkin County Board of County
Commissioners (`BOCC") to consider an Reinstatement of Vested Real Property Rights
pursuant to Secfion 4-140-30 of the Lana Use Code,.

4. The BOCC heard this application at a duly noticed public hearing on May 9, 2001, at which
time evidence and testimony were presented with respect to this application.
5. The BOCC has determined that the proposed development meets the criteria established in
Section 4-140-30 of the Land Use Code, and therefore found the reinstatement to be
appropriate.
NOW THEREFORE BE IT RESOT.VED by the Pitkin County Board of County
Commissioners that it does hereby grant a Extension of Vested Property Rights for the Schiralli
1041 Hazazd Review subject to the following conditions, which shall run with the land and be
binding on all successors in interest:
1. The Applicant shall adhere to all;material representations made in the application and in the
public meetings.
2. The conditions specified in the Lot 39, Sopris Mountain Ranch 1041 Hazazd Review and
q Extension of Vested. Rights approvals as recorded at Reception Nos. 339417 and 400385
shall remain in affect unless modified by the conditions of this approval.
3. Prior to submission of any building permit applications, the applicant shall submit a 1041
Hazazd Review Site Plan complying with the provisions of Section 5`70 040 ofthe Land
Use Code.. The site plan shall be submitted in digital format for integration into the '
County's GIS system.
4. The Applicants shall comply with the following landscaping and wildfire defensible space

a. Brush, debris, and non-omaniental vegetation shall be removed within a
minimum 20 foot perimeter around the structure.
b. Vegetation shall be reduced to break up the vertical and horizontal continuity of
the, fuels a minimum thirty-foot (30') perimeter around a structure built on flat
ground.
c. For a distance of 15 feet azound all structures, vegetation shall be maintained at
6 inches or less in height.
d. For a distance of 100 feet in every direction; shrubby material shall be thinned.
Shrubs shall be thinned so that clumps are no larger in diameter than'2 times the
height.
e. Existing trees shall be thinned for a distance of 100,. feet azound the cabin. Tree
crown separation within this perimeter shall have a' minirnum of 30 feet between
the edges of the crowns. All Branches from trees within'this perimeter shall be
pruned to a height of 10 feet above the ground or half the total height of the tree,
whichever is less.
f. All branches that extend over the roof eaves shall be trimmed and all branches
within 15 feet of the chimneys shall be removed.
g. Remove deadfall within 100 foot perimeter shall be removed.
h. The Applicant shall be responsible for the continued maintenance of the
defensible space requirements.
5. The Applicants shalt comply with the following additional wildfire mitigation
standards:
a. Roofs shall have a Class A, non-combustible roof system. Wood shake/shingle
roof coverings aze prohibited in all wildfire hazard areas. Roofs withless than a
3:12 pitch are not permitted in 1041 Wildfire Areas unlessthey comply with the
following:

iv. Roofs shall be installed as required by UBC 1997 Chapter 15 and shall
have a minimum lope of 1:48.
v. All roof designs, coverings, or equivalent assemblies shall be
specifically approved by the Fire Tvlarshal prior to submittal of a
building permit application.

maximum.
c. Roofs and gutters shall be kept clear of debris.

area shall be calculated based on the definition in effect at the time of building permit
submittal
9. Pursuant to Ordinance No. 022-2000, the Applicant is subject to the Fair Shaze
'Requirements and shall pay a road impact fee as calculated at the same time as building
permit issuance.

I read the application and inspected Lot 39 with Norm Clasen the
owner's agent on June 26th On that date I dic'["`no~~"have~t~le

referred to as the 'tiapplicant"), owner of Sopris Mountain Ranch Lot
39 in Pitkin County. The lot contain 35_.03 acres and is zoned RS-
30. The applicant seeks an Extension of Vested Property Rights

The first section of this letter provides a chronological summary
of land use actions affecting the subject site and the second
section demonstrates compliance ,with Section 4-140 of the Code,
Extension of Vested Property Rights.

This section of the land use application presents a chronological
history of land use actions affecting the subject site.
1. July 16, 1991 - The subject property received 1041
Hazard Review and general submission approval by the
Planning and Zoning Commission Resolution PZ 91-55.
Robert and Nancy 'Bean were the owners at the time of the
approval.
2. November, 1991 - Approximately 31 lots in Sopris Mountain
Ranch were granted f041"''TiazaYd Review approval and were
given a vesting period of 15 years. The vested property
rights for these 31 Rots, therefore, will not expire
until 2006. This subject was not one of the 31 lots.
2. July 28, 1994 -- An application for the Extension of
Vested Property Rights was submitted prior to the
expiration. of a three year vesting period. The.
application was withdrawn through a letter from the
applicant's representative, (John Younq) stating that the

approved a 3 year extension of Vested Property Rights'
through Resolutign_96-312.

1041 Environmental Haaasd Concerns
The major issues affecting the subject property which were
discussed in the 1991 1041 F'fazard land use review and again during
the 1996 Extension of Vested Property Rights review were wildlife
(proximity to elk calving habitat) and wildfire (moderate to severe'
hazards). Pitkin County imposed approval conditions addressing
wildfire danger in the original approval and added to those
conditions when the property received an extension of Vested
theo1996 extensionnapp~ovalerelate to bear2proof garbagencontainers
and revised wildfire mitigation conditions requiring a "defensible
space"'around the home to be maintaine3.
Extension of vested Property Rights

standards in Section 4-140..:30 of the Land Use Code, standards which
must be satisfied in order for an extension of Vested Property
Rights to be granted.

Resolution 91-55 grants the. original approval of the 1941
Hazard Review and gives 9 conditions of approvals. The
extension of Vested Property Rights granted in 1996 added two

WHEREAS, Robert and Nancy Bean, (hereinafter "Applicant") have
pplied to Ptkan Count for a

construct a single family residence in a wildlife and geologic'. __
hazard area pursuant to Section 5-400 of the Land Use Code; and
WHEREAS, the property is located south of West Sopris Creek
Road within the Sopris Mountain Ranch subdivision which is more'
specifically described in Exhibit "A"; and
WHEREAS; the Application was considered by the Planning and
Zoning Commission (hereinafter "Commission") at a duly noticed

public hearin on June 18, 1991 and which was continued to July 16,
1991, after the Commission conducted a site inspection on July 2,
1991; and
WHEREAS, the Commission had concerns regarding the close
proximity of an elk calving area, to the proposed residence, but
finds that the Division of Wildlife recommendations adequately
addressed their concerns; and
WHEREAS, the Commission approved 1041 Hazard Review and
recommended General Submission approval to the Board of County
Commissioners on June 18, 1991 on a vote of 3 to 2; and
WHEREAS,` pursuant to Board of County Commissioners Resolution
91-06, the Commission has the authority to take final action on

5. The following condi_tions._of the Division of Wildlife
shall be adhered to by the applicant:
a. No construction or site work is to take place
between December 1st and Sune 30th of each year.
'b. The maximum height of the residential structure
shall not exceed a lowest level floor elevation of
897 feet; "as~ related. to the site plan dated
September 10, 1990. The home 'and all structures
shall be placed be7ow_the meadow and the knob by an
isolated group of spruce trees..., The roof line of all
structures shall ,be beT~ow the knob and meadow
located above the homesite.
c. The driveway shall be located in the oak brush, and
entirely out of the aspen stringer.
d. No dogs shall be allowed on site.
