HomeMy WebLinkAboutbocc.res.043.2009A RESOLUTION OF THE BOARD OF COUNTY COMMISIONERS OF PITKIN COUNTY, COLORADO, ESTABLISHING THE PITKIN COUNTY PUBLIC HEALTH AGENCY AND APPOINTING THE BOARD OF HEALTH AS THE PITKIN COUNTY PUBLIC HEALTH AGENCY Resolution NO. ~~;~-2009 Recitals 1. Senate Bill 194 passed in 2008 by the Colorado Assembly and signed into law by the Governor of the State of Colorado, has revised and restructured the public health statutes of the State of Colorado: and 2. C.R.S. 25-1-506, et seq., requires each county to establish and maintain a county public health agency or participate in a district public health agency; and 3. The Pitkin County Board of Health that existed prior to this resolution has been dissolved pursuant to C.R.S. 25-1-506, et seq.; and 4. For decades Pitkin County has relied on Community Health Services, Inc, to serve as the public health authority for Pitkin County and the Board of County Commissioners wish to continue contracting this service to Community Health Services and can best achieve this by forming the Pitkin County Public Health Agency and naming the Board of Health as that agency; and C.R.S. 25-1-508 et seq., requires the Pitkin County Board ofCounty Commissioners to appoint a county board of health; and 6. The Pitkin County Board of County Commissioners, having a population of less than 100,000, is authorized to serve as the county board of health pursuant to C.R.S. 25-1-508, et seq.; and 7. The Pitkin County Board of County Commissioners desires to record their understanding and agreement in writing to fully comply with C.R.S. 25-1-508, et seq.; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado: 1. Pitkin County Board of County Commissioners shall serve as the Board of Health. 2. Pursuant to C.R.S. 25-1-509 et seq., the Pitkin County Board of Health members' initial terms shall be staggered and set to expire based on their individual terms in office as County Commissioners. 3. After the initial terms, full-term appointments shall be for five years pursuant to C.R.S. 25-1-508 et seq. 4. The Pitkin County Board of Health shall be designated as the Pitkin County Public Health Agency. 5. The Chairperson of the Board of County Commissioners shall serve as the President of the Board of Health with signature authority for the Pitkin County Public Health Agency. 6. The provision of quality, core public health services in Pitkin County shall be arranged for by Contractual Agreement between the Pitkin County Board of County Commissioners and Community Health Services and renew annually, if agreeable to both parties. 7. Collaboration shall be encouraged between Community Health Services, Pitkin County Environmental Health and Natural resources and the City of Aspen Environmental Health.
