The property is located at 43051. S.H. 82 and is more particularly described in Exhibit A. 3. The property is zoned AFR-10 and contains approximately 2.3 acres. 4. The Hearing Officer heard this application at a public hearino on November 23, 1999, at which time ° _ evidence and testitiaony were presepted-with respect tathis application. 5. The Hearing Officer finds that the applicatiortcomplies with the applicable Code sections. NOW THEREFORE BE IT RESOLVEDby the Pitkin County Community Development Department Hearing Officer, that he hereby grants approval to the Andi Ranch 1041 Hazard Review and Scenic Overlay Reviewsubject to the following conditions which shall run with. the land and be binding on a sucgessors m interest 1. The Applicant shall submit a 24" x:36" mylar 1041 Hazard Review site plan to the Community Development Department for approval and recording prio{to the submittal of any building permit applications. 2. The site plan shall be submitted in digital format suitable for integration into the County's GIS system. 3. The following Disclaimer shall be placedon the Site Plan: "1041 environmental hazard areas exist that might affect the property, any improveinpxts, and the use and occupancy thereof. " 4. A 20 foot setback from the high water mark of the stream to protect ripazian vegetation as per Section 3-50.040(B)(5) of the Pitkin CountyLand Use Code. 2. Prohibit the removal of live ve etatior[ in rt artan areas and disturbance of ground cover adjacent to streams as per Section 3-80.080(G)(3) of the Pitkin County t;aniT Use Code. This includes, but is not <,. limited to, cottonwoods, birch, alder, red-osier dogwood, and willow. 3. A landscape plan should be required that includesrestoration of the riparian corridor of the stream where it has been altered. This plan should require the approval of the'Pitkin County Wildlife Biologist. A recommended plant list is included as `Attachment C'. 4 ] and~Use Code. Fencing should also 6e proh bitedywithin the120 footstr0eam(setback. ePitkin County 5. Prohibit dogs on the property as per Sections 3-80,80(B)(5) pf the Pitkin County Land Use Code 6. Native vegetation must be maintained outside the building envelope as per Section 3-86.80(A)(3). 7. Installation and use of approved bear-proof trash containers should be required2. 8. No more than 3 horses should be allowed on this property at any given dime. When on the property, horses must be corralled. These corrals must be collapsible oc removable and should be required to be removed or collapsed between April 15th and June 15m and between October 15th to November 15th (the height of the elk migration seasons). In addition to these comments, Kevin Wright of the D.O.W. also made the following recommendations: • The applicants shall fence offhay stacks to prevent elk eating the hay. • Avoid planting fruit and bevy producing trees and shrubs to avoid attracting bears. • The D.O.W. is not responsible for damage done to landscaping'by animals. Staff Comments on Wildlife: With regazd to the disruption of the perennial stream, staff recommends that the Hearing Officer require a revegetation plan for the disturbed riparian habitat to be approved by the T~itkin Courity'Wildlife Biologist. A bond would ensure the completion the revegetation depicted in the plan. The Applicant has already begun addressing the potential Clean Water Act violations by Siring awetland's consultant to contact the Army Corps of Engineers. Staff will require evidence that the Applicant has fulfilled the requirements of the Army Corps (fines, mitigation, etc.) before building permits or land use applications for the forthcoming additions to the single family home and accessory structure will be accepted by the Community Development Departrnent. From. a wildlife perspective, the proposed location of the collapsible corrals is acceptable and preferable to the dispersed pasture proposal in the original application. Geologic: Slopes: Geologic hazazds on site include moderate avalanche hazard, potentialrockfall, and debris and water flow (the site is an alluvialfan at the base ofan active mountain drainage). Code. Section 3-80-050 (D) prohibits development in rockfall hazard areas. Thus, Staff recommends denial of this application. COMMENTS ON THE SITE PLAN: Staff has the following comments with regard to the proposed site plan: The Zoning Officer (Attachment E) pointed out that there-routing of the driveway changes the setbacks. The southern and northern edges of the property become the front and rear yard, thus re'qu~nng 30 feet setbacks instead of the 20 feet setbacks as indicated on the site plan. The property lies within the mapped scenic overlay and is therefore subject to the standards in Code Section 3-60-040. Notes on the Scenic Code Standards. The mitigation standazds' in the Code focus on three types of scenic mitigation:`Site location (mostly'ioi• new subdivisions); site design, and architectural design. Staffff Response: The development proposed m this application consists of addthons to two existing structures and landscaping. A site visit to the properties revealed that a perennial stream that runs through the'property has been significantly disnxrbed.' The channel has been dug out and all riparian vegetation removed. Since this is a perennial stream, it is Waters of the United States and falls under the junsdiction of the US Army Corps of Engineers (CTSP CE). The property is within the Aspen 7.5 minute quadrangle, Pitkin County, Colorado. The tract of interest gonsists entirely of a small alluvial fan at the mouth of a typical steep mountain drainage. Slopes of the fan in the upper, essentiapy=undisturbed portion of the proposed expanded building envelope average about 20%, while slopes in the azea of the existing structures is less. HwY 82, Prncw COUNTY I have completed my geologic investigation, as required by House Bill 1041, of the above referenced property at the base ofthe soutliwest Tank ofSmugglerMountan, acrossColorado Highway 82 from the floodplain of the Roaring Fork River, about one mile east of Aspen: The property is within the Aspen 7.5 minute quadrangle, Pitkin County, Colorado.. The tract of interest consists entirely of a small alluvial fan at the mouth of a typical steep mountain drainage. Slopes of the fan in the upper, .essentially=undisturbed portion of the proposed eacpanded building envelope average about 20%, while slopes iri the area oftIie existing structures is less. The gully immediately above the property has; a gradient of about 50%, dianiiishing at higher elevations; the total drainage azea is small. A moderately-deep to deep, boulder-lined abandoned channel extends from the apex of the fan along the west edge to Highway `82, and a amvlaz channel, with fewer . The site, is in Pitkin County near the corporate boundaries_of Aspen and municipal services are pruvidedby'the city: Bedrock beneath the property, which is exposed immediately to the west, in the drainage above the Ranch, and extensively on the higher slopes of Smuggler Mountain, but which is covered by Quaternary alluvium on the tract itself, consists primarily of quartz moijzorute, a granitic rock, with minor granite, granodiorite, and inclusions of high-grade metamorphic schist and gneiss, all of Precambrian age (approximately 1.43 billion yeazs; the me'taitiorphios are approxiriiafe'ly 1'7 billion ears Two a es of facial moraine de ostts cover the rmddle and and rounded to subangulaz Mountain abovethe ro ert ,and consist of mixed silt, sand, cobbles' lower slopes of Smuggler P P Y boulders up to 10 ft in maximum dimension. Avalanches onlower-elevationsouth-facing slopes aze unusual, and the deep channels on the flanks of the fan will suFistantially mitigate both'avalanche and rockfall hazards.
