Dear Mr• Benedict:
Pursuant to the November 27 1978 meeting of the Pitkin County
Board of Commissioners, I ha#,e been instructed to issue you the
following guidelines to be followed in the reclamation of your
sand .excavation operation east of Aspen.
1y By April 1, 1979 have ready to present to the Commissioners
for approval a detailed plan for reclamation and revegetation.
This plan shall have been previously reviewed by the County
Extension Agent and the CityfCounty planning Office. This plan
shall strictly adhere to the .Pitkin Sand and Gravel Regulations
and shall include, but not be limited to: ,
a) A minimum of 18°' of topsoil, and
b) Slopes not greater than 50~o around any wet pit areas.
This plan shall include repair of any areas disturbed under
atfh~e1972 permit issued to P.B. Hemann and any work that was done
r the January 1, 1976 expiration of that permit.
3) By October 1, 1979, all reclamation and revegetation depicted
on the above mentioned plan ahall be accomplished and approved
by the County Es-tension Agent.
If these deadlines for the reclamation are not met the County
Attorney will be instructed to initiate legal action against
you to insure completion.
Should you de~:re to reapply for a permit to excavate as you
did in 1976, please subm_ia a request and a second plan showing
what areas you w%sh to disturb in the future and your intentions
for reclamation of those areas to the Planning Office for pro-
cessing. Tf your application is denied, you will still be
required to follow the deadlines stated previously.

Since I was not notified of the commissioners meeting on November 27th to
hear,Jim Smith concerning the Stillwater gravel pit,' I cannot specifically
answer his charges.. I can, however, answer his former charges, assuming
they are approximately the same.
The gravel pit was opened daring the mining days and has always been a
valuat~le community resource. Pat Iiemann clai?~s it is the best sand deposit
on th'e IYestern Slope. R'hen d bought the property 20 years ago, I leased the
pit to Fiemann who later sold the operation to T.C. Aggregates. 4Yhen they
ceased to operate, I leased the pit to Stutzman-Gerbaz.
Before I bought the land in 1958 and leased i~ to }iemann, the pit had been
operated very haphazardly. Excavation was scattered over a large area, top
as wasted, and trees needlessly destroyed. Flemann gradually brought

In 1964 and 1965 the cut bank on the east side of the lake was sloped and seeded.
The banks near the pit entrance were reclaimed in 1968. In 1970 the high bank
in the southwestern area of the pit was sloped and seeded. In the fall of 1976,
the old tailings ponds were leveled and seeded. An earth berm was formed
along my east property line to screen the pit from Jim Smith's land. This

In 1970, I gave Pat Hemann permission to mine a gravel ridge at the south
part o£ the property. This was not "primeval forest" as Mr. Smith maintains
but sagebrush with some scattered aspen trees_
Until quite .recently there was no government control of gravel pits, but in
1970 the county commissioners called in gravel pit operators to draft regulations.
Consequently, when Pat Hemann wanted to expand the lake excavation, he filed a
map July 26, 1972, to show how he planned to enlarge this lake.
By the summer of 1872, the gravel ridge had been sera
stockpiled and excavation continuing. Hemann had remoPed the~graveloand only
sand was left. That. is why he needed to extend the lake to obtain gravel.
Mr. Smith Maims that the pit was expanded beyond the permit area but that is
not correct.. As Pat Hemann could testify, excavation started in the area to
which he refers in 1970, before county regulations or 'permits existed.
Stutzm
over oan-Gerbaz continued to mine sand from the south ridge after they took
peration in 1975. Stutzman-Gerbaz' permit expired on January 1, 1976.
On February 2'3, 1975, I applied at a public hearing to have the permit extend-
ed five years. The corunissioners referred the matter to the P g Z to have
them address each of Smith's points of contention, and forward their recommenda-
tion to the Board of Commissioners at vhich time a legal notice would be pub-
lished of a public hearing and the meeting would resume. To my knowledge, none
of the above evor accured so I again made a formal. application on September 8,
1976.
On December I7, 1976, the county P ~, Z inspected the gravel pit revegetation
and on t~1ay 16, 1977, Dave Boyle sent a letter to Hal Clark of the planning
office approving the reclamation performed in 1976.
Ihiring June 1976, there were various meetings and submission of maps to the
Planning Office. Finally, after I cancelled a meeting with the Planning
Office June 30, 1977 because the pit operator Gerbaz, failed an appointment,
I decided not to `pursue the application,untl the steep banks were reclaimed.

the cut flanks to a 2 to 1 slope. At least 2,OOQ loads of dirt were hauled.
N7hen Mr. Smith appeared before the commissioners on November 27, 1978 to claim
that reclamation of the steep banks had not been done, it had indeed been accom-
plished, including the spreading of top soil. Henry Pederson seeded grass and

wildflowers two days later. Mr Smith showed a p}iotograph of 2 loads of
broken concrete in an attempt to prove that the pit was being used as a
dump. 'This concrete had already been covered by several feet of earth.
John Hyrup tells me that if the thousands of yards of dirt that he took
to the pit from the Midland Park project had been hauled out to the high-
way west of Aspen, it would have cost the county twice as much money.
I saved the city considerable money by allowing it to store earth from the
water tank site (see letter from James blarkalunas). During 1977, most of the '
material hauled from the pit was sand for backfilling electric lines that the
city was burying. In 197$, the City of Aspen prevailed on Gerbaz to haul some
sand for the golf course. They got most o£ their sand £rom Vail at great ex-
pense but ran short.
It is difficult to understand `rir. Smith's opposition to my pit when he himself
has been_ in the sand and gravel business for m2ny years without ever having a
permit.' For 3 or 4 years after 1956, Pat Hemann was hauling sand and gravel
from the Smith property. hfore recently sand has been dredged from{the river
and T believe your building inspector has photographs. Sand 'has been hauled
from thz Smitli ranch as recently as Aiovember 1978. 'The day aftex Mr" Smith

The area where the city has material stored fron the water tank site will be
leveled and revegetated by October 1979.
I would like permission to leave the boulder stockpile and to gradually remove
the pile of cobbles as they are needed for off-site landscape purposes. If the
permit is extended, the large flat sandy area would be needed for material
stockpiles. If the pit is shut down, I would like permission to leave this area
as a sand beach.

1 was asked by George Ochs to research the above mentioned property
and submit a report on the activities to date and make a reconanendation
on the future use of the pit.
Attached find minutes of the Board of County Commissioners public
hearing (#76-10 of 2/23/76) and minutes of the Planning and Zoning
dated 10/13/76 and 11/17/76 concerning the gravel pit. I can find
no other records and must assume the issue was dropped after the
11/17/76 session of planning and Zoning::

Dear Mr. Benedict,
I am in receipt of your letter of August 14, 1978, to the Board
of County Commissioners and I have .the following comments and
suggestions to offer.
1) You may continue with the Dumping of clean fill in the area.
This is a necessary and worthwhile step in the rehabilitation
process.
2) Strictly prohibit Stutsman-Gerbaz or any other operator from
removing sand from the area. A stop-work notice has been placed
on the pit and, as owner, you are r~spbnsible to see that it is
not violated.
3) If you desire to reapply fora permit to excavate sand as you
did in 1976, I suggest you do the following'as soon as possible:
a) Contact this office and :set up a meeting with
Larry Dunn, County Extension Agent, and me, to deter-
mine what reclamation has been done up to now and to
formulate a master .plan to be followed during the
permit period if it is granted.
b) After the above has been accomplished, contact
Karen Smith of the Planning Office to fill out the
necessary paper work for the permit and to provide
any documents that may be necessary.

Letter of August 14, 1978
Observation of the subject property confirms the content of the letter.
At this time, all I have seen is the dumping of clean fill for reclamation
purposes.
I have not yet seen any sand being hauled. out and would be very reluctant
to proceed with prosecution for use wi haut a permit based on pictures
presented to me by Mr. Smith. {The pictures do indicate a case of
criminal trespass, howeverl)
A close watch will be kept on the operation and if any sand is excavated
immediate action will be taken against Benedict. At the same time
Larry Dunn and I will be working with Benedict to insure that the
rehabilitation plan meets the specifications set forth by the County.

Bob Child mentioned at yesterday's meeting that gravel operations
are still being carried out at the old Benedict gravel pit site
.just east of town and located adjacent to James Smith's residence.
Bob has some photographs which indicate that the operation is
definately up and ongoing. T'm certain that Benedict has no
current approval and would like for you to immediately tour the
site, contact Benedict and get some assurance that this operation
will be shut down.

Dear Sirs:
This refers to your Flood Plain Information Report. - Roaring
Fork River, Aspen, Colorado dated June 1973, and specifically
to information contained on Plates 12 and 13 thereof.
These two lates show - at approximatel 46.75
p. ~ Y p - the Roaring
Fork River in a narrow channel and flood lain area on the
north side and wide flood .plain course (.blue) on the south
back into thelow channel`running in s northwesterly direction
Roaring Fork channel.
Our first question is whether you have more detailed topogra-
phical data on this area. We believe there were 2' contours
available although the plates indicate only S' contours.
The second question is what would be the effect of placing a
15' earth berm across the wide ]glue area ott°the south side
running rcrth and south approximately at the west end of the
dark blue area which indicates a lake bed.
a) Would this protect the gravel pit shown by hatched

To what extent would it cause greater flow velocities

The Chairman opened the Public Nearing on the Benedict Sand and
Gravel Permit Stillwater Pit.
Hal Clark stated that appropriate public notice had been given of
the Public Itearing.to consider the request of Jerry Gezbaz (landowner -
Fritz Benedict) for a sand and gravel permit for the term of five ($)
years. The pe zttiit would be for excavation, screening, washing, and
removal of sand and gravel. There would be no rock crushing facilities,
asphalt or concrete plants. A similar permit issued to P. B. Fiemann
expired on January 1, 1976.
Pitkin County p & 2 hadrecommended granting this permit conditioned
upon receipt andapproval of a new reclamation plan; receipt of a perfor-
mance bond and clarification of the official applicant.
James Smith questioned the location as given in the public notice -
noting that the property is 600 yards from the city limit and not one and one-
half miles a5 stated.
Clark added that this pit is the only source of masonry sand available
in the County at this time. There is a bond on fi.1e of $2,000 which is to
be transfered to this application. The planning office would like to see the
Hemann operation closed out before going ahead with the new application.
Mr. Smith showed an aerial photo of the area and the pits. ~~
Fritz Benedict noted that t}ie pit is well hidden from most people; he
showed a picture from Aspen Mountain and a picture from Knollwood; he explained
that the 5-year plan is to fill up the old pit, eliminate the old tailings
piles and plant native grasses and bring the area back up to grade and revegetate.

Smith then took the floorand stated that the situation was not as it
had been described by Benedict, he said Benedict was obligated to restore
the area NOW to as close a condition as possible before the operation began.
He said the Commissioners had'to determine whether the contract of the
previous operator had been ful Filled before allowing a new permit. He also
stated that Benedict had violated the acreage that he was allowed to dig up
under the ol.d permit. He accused Benedict of dwmping "stuff" from the
escavationa in. the pits right now without a permit and that this "stuff" will
become really visible when the snow melts.
Smith cited the following sections of the new Land Use Code which he
feels have been or are being violated: 2.01,2. 02,2.03a, 2. 04c, 2,06, 2.09,
2.12, 2.14, 5.03.02d, 5.03, 03b, 5,06.02e (4), 5,08 and 5.15.01 - and these are
not all.
Gerbaz stated that any vegetation that is going to be bothered has already
been bothered.
Shellman noted the teckm cal point of the defective notice was well taken
and that it may regvi re renotice and rehearing,. .Sm.i th noted also that the
land owner was Fritz and Fabicnne Benedict, not just Fritz Benedict. He further
objected to the statement thit "a copy of the ,pronosal may be examined in the
Office of the City-County Planner during normal working hours." as he hadbeen
unable to examine such a Dopy two weeks after the notice. He also objected
because the prior permit had not been complied with. fie is~a].so not sure that
the Stillwater Pit is the only major source of masonry sand.
Shellman suggested lcavi ng the matter to P & 7„ asking the Planning Office
to renotice for Commissioners' hearing and getting a specific proposal into the
hands of the planning office. Knslcy wanted to know if .putting it off was
going to screw up the timing badly, The answer was that outside of masonry
sarid, i.t would not, .but that they were planning to take the pit run too '(not
ir. the notice.)

want to have input to attend that hearing, He asked the Planning office to
be sure that Mr. Smith is invited to the hearing.)
The Chairman polled the people present and found that there were four
persons there in opposition to the application and two for it.
Smith then added that there should be a site inspection when the area
does noEhave snow on it so that the real impacts canbe noted. He asked if
the new Land Use Code would apply to the situation. He said he would study
it and make a presentation at the later hearing.
Jerry Gerbaz noted the following: He had cleaned up the pit when he
first started working; that there would be pollution no matter where the pit
was located; the maximum degradation is already done; the water is blue (this
to refute an earlier statement of Smith's that the water was brown j; that
sand is very hard to get in this area.
Shellman wondered whether Sim Smith's points had validity and noted
that the photographs show lack or compliance with the last peYxnYt.
Shellman then moved that the Commissioners refer the matter to P & 2
for consideration and send them a copy of the record of this meetingand ask
them to address each of Smith's points and findings as to which are substantial
and how any adverse environmental effect should be miaigated an3forspecific
findings as to whether the applicant has complied withthe terms'ofthe permit;
and to forward their recommendation to the Hoard of Commissioners at which
time ,a legal notice will. be published of a public hearing and this meeting
will resume. P & Z is also to consider the .common is by other obj ectgrs; 2nd
