RECITALS
On August 5, 1997, the Firkin County Planning and Zoning Commission; hereinafter
referred to as the "Commission'; reviewed a request by Alan Potamkin, hereinafter referred to as
"Applicant', for a Scenic Foreground Overlay Review for an addition to a single family residence.
2. The subject property is located at 43151 State Highway 82; more specifically described in
Exhibit A, attached.
3. The Commission found the proposed development to be consistent with Section 3-60.40 of
the Pitkin County Land Use Code.
NOW, THEREFORE, BE TT RESOZVED by the Pitkin County Planning and Zoriing
Commission that it hereby approves the Potamkin Scenic Foreground'Overlay Review subject to
the following conditions:
The Applicant shall adhere to all representations in the application and in the public
meeting.
2. Prior to the. issuance of a building pemut, the Applicant shall plant IO evergreen`trees,
with a minimum height of 8 feet, in the areas near the driveway and Highway 82, and a
performance guarantee shall be submitted to the County Attorney's Office to assure the
success of the tree plantings.
The existing vegetation shall be preserved to the maximum extent possible, partculazly in
the azea between Highway 82 and the residence.

The City Staff reviewed this application and have the following comments:
The buildable area of the property is mostly at the toe of the mountain. Tt looks like the
present house has been set back from the highway as much as could be expected. The
proposed addation will also be set back far from Highway 82. The property is heavily
vegetated and the present development is largely invisible from Highway 82 in the
Summer.
In the Winter, however, the house will be significantly more visible considering this
existing vegetation is mostly deciduous. If the County is concerned about the visual
impact of this house from. the highway, the applicant should be encouraged to preserve
the existing vegetation and to plant a few evergreens between the'house and the lghway.

square footage and are found to have an insignificant impact on the scenic resource. The addition
is proposed to be approximately S,T84 square feet (126% of exis"ttngW"square=footage), therefore, a
Planning Director sign-off is not applicable andP&Z review is required.
LOCATION: The property is located east of Aspen at 4~ I51 State Highway 82.
PROJECT DESCRIPTIONk The :Applicant is proposing a 5,1$4 square-foot addition to an
existing 4,100 squaze foot residence, as represented on the elevation drawings submitted with the
application. The addition is proposed to be to the west and nortli of the existing house, The
drawings"submitted with the application indicate that a portion of the addition wil'be behind the.
existing residence, relative to the Highway. The same architectural`. style will be utilized' in the

new construction. The proposed addition will. be approximately 27Q feet from Highway 82.
STAFF COMMENTS: The residence is somewhat visible in the winter due to the:
predominance of deciduous vegetation (cottonwoods and aspen) between the residence and
Highway 82. The existing residence cannot be seen from the F-Taghway when the deciduous tree
are leafe3 out. In Staff's opinion, the addtrion wtll have a relativelyinstgnificant impact on tie
scenic resource, The preservation of tfie°existing vegetationis critical'in this case, however. Th
Applicant has committed to the planting of ten (10) 8-foot conifers scattered u`i tfiie cottonwoo"d
