SUBDIVISION EXEMPTION! fOR THE MOORE DUPLEX
Resolution No. 80-
WHEREAS, Ken and Betty Moore (hereinafter referred__to as applicants are
the owners of record of a duplex located on Lot 23, Block.. 1, Mountain Valley
Subdivision, and
WHEREAS, the applicant has requested exemption from the. definition of Sub-
division pursuant to Section 30-28-101 (10) (d), C.R.S. 1973, and
WHEREAS, this property was divided by an occupancy, use and maintenance
agreement as we17 as separate deeds of trust in May of T973, and
WHEREAS, ih April of 1976, the Land Use Code was adopted and provided in
Section 4.02.01, that
"'In addition to those exemptions listed in the definition of "Subdi-
visioh" found in Section 12, a duplex that is permitted by Special
Review in any zone district shall be exempted from the Subdivision
'procedures, except that condominiumizaton or its equivalent shall be
considered a Subdivision", and
.NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Pitkin'County, Colorado, that the Moore Duplex located on Lot 23, Block 1,
Mountain_Halley Subdivsion.is hereby granted exemption from the definition
of Subdivision provided title to the entire property is taken as tenants in
common or joint tenancy under the existing encumbrances by all purchasers..
Approved by the Board of County Commissioners at their regular mee"ting on
November 24, 1980.

vision. The proposal is to utilize the State statutory exemption request as
the vehicle for this division. The application ar ues that the division

The Planning Office comments are as follows:
1. Section 4-2.1(a) of the County land Use Code requires that. the
condominiumizatlon of a duplex be cpnsidered a subdivision..

and recommended approval, That proposed regulation includes

proposal's overall. impact on the County's housing stock. Considering
this forthcoming regulation, the Board may not wish to establish
a precedent for duplex condominumzation-via the State statutory
exemption procedure at this time. .

Relevant legislative history on the question is as follows:
In 1972 the General Assembly adopted S.B. 35 which required Counties
to adopt subdivision regulations. "Subdivision" was defined to include
"any parcel of land...which is divided into two or more .parcels,
separate interests, or interests in common;"unless exempted..." One
relevant exemption reads '
"(c) Unless the method of disposition is adopted for
the purpose of 'evading this art,l,'the terms
'subdivision` and 'subdivided land, as defined
in paragraph (a) of this subsection (10), shall
not apply to any division of'1and:...
(VII) Which is created by the acquisition of an interest.
in land in the name of a husband and wife or 'other
persons in joint tenancy as tenants in common,
and any such interest shall be deemed for purposes
of this subsection (10) (i.e., for the purpose of
defining what is a subdivision)' as only one interest...."
Idential language was incorporated in the May 8, 1972 subdivision
regulations adopted by Ptkin County (Resolixtion 72-17) and is
maintained to date.
In 1974, S.B. 95 was adopted which expanded the definition of

correspondingly, amended in January of 1975. Finally, in April of
1976 the Land Use Code was adopted and provided, in Section 4.02.01,

This sequence of events, as applied•to the information supplied by
Moores, raises the following questions:
1. Did the interests_ of the Moores remain one interest by virtue
of the statutory provision that interests in common obtained
by husband and wife "be deemed...as only on'e interest"?
2. Would a present attempt to convey this interest to other than
a husband and wife as tenants in common be an "equivalent" to
Codeowithoutzsubdivow profiibte3'by Section 4-2.1 (a) of the

Pursuant to Section _30 28-101(10)(d), C.R.S. 1973,.
request is hereby made to exempt from the definition of
the terms "subdivision" and "subdivided land" the proposed
conveyance by Ken and Betty Moore of their respective
undivided one-half interest in the existing duplex structure
situated on Lot 23, Block 1, 'Mountain Malley Subdivision.,
Mr. and Mrs. Moore each own an undivided,"one-half „
interest together with the"exclusive right to use each
unit (Ken Moore has the exclusive right to use Unit A and
Betty`rioore the exclusive right to use 'Unit S) of the duplex
building. Mr. Moore proposes to convey his undivided one-
half interest together with the exclusive right to use Unit

Gentlemen:
Pursuant to Section 30-28-101(10)(d), C.R.S. 1973',
request is hereby made to exempt from the definition of
the terms "subdivision" and "subdivided land'" the proposed
conveyance by Ken and Betty Moore of their respective
undivided one-half interest in the existing duplex structure
situated on Lot 23, Block 1, Mountain Valley Subdivision.
Mr. and Mrs. Moore each own an undivided one-half
interest together with the exclusive right to use each
unit (:Ken Moore has the exclusive right to use Unit A and
Betty Moore the exclusive right to use Unit B) of the duplex
building. Mr. Moore proposes to convey his undivided one-
half interest together with the exclusive right to use Unit
A to James Bond, the existing tenant of that unit. Mrs.
Moore proposes to convey her undivided one-half interest
together with her exclusive right to use Unit B to Grafton
Smith and Phyllis Smith.
We submit that the foregoing conveyance is not a division
within the purposes of the definition of the term '°subdivision"

recorded in Book 275 at page 494 conveying Lot
23;
2. Deed dated May 2, 1973; between Kenneth N.C.B.
Moore and Betty Moore conveying an undivided
one-ha f interest in said Lot 23 together with
the exclusive right to use Unit B of the duplex
building, reserving to himself the exclusive
right to use Unit A of said duplex building, all
in accordance with the recorded Occupancy, Use
and Maintenance Agreement; and
3. The recorded Occupancy, Use and Maintenance
Agreement dated May 2, 1973; and
4. Opinion letter from County Attorney, Sandra M.
Stuller, dated September 4, 1980.
The respective co-tenancy interests of both Ken and
Betty Moore have been encumbered by separate deeds of trust
to First Colorado Corporation each in the amount of $43,500.00.
Both obligations were entered .into on the date of the
conveyance to Betty Moore, May 2, 1973. Since May, 1973,
both units have been rented long-term to local residents.
Over the last .few years, James. Bond, a local painter, and
Cornelia Gallaher have leased the duplex units. Recently,
Ken and Betty Moore decided to sell the duplex and offered
it to their tenants. Mr. Bond, as mentioned above, is a
proposed purchaser and has made arrangements with a couple
with whom he is acquainted to acquire the second unit in
the building.
As further .support for this exemption application it is
our contention, supported. by Ms. Stuller's opinion letter,
that the original co-tenancy and .separate. use arrangements
between Ken and Betty Moore established in May of 1973 did not
violate Pitkin County definition of subdivision in existance
at that time. I can assure you, that the 1973 arrangement was
not done to .evade the subdivision regulations, but simply to
establish their respective interest in the property for estate

planning purposes as well as to obtain separate loans on
the two units. What is proposed now is a continuation of
the existing co-tenancy arrangement. In other words, rather
than Ken and Betty Moore owning an undivided half interest
in the property together with the. exlusive right to use the
two units, James Bond and Mr. and Mrs. Smith would become co-
tenants, each as to an undivided one-half interest in Lot
23 together with the. exclusive right to use the two units.
To recognize this as an exemption would simply be to
recognize the "grandfather" nature of this arrangement,
having been initially established in 1973: Further, no
additional impacts or separate interests are created in
addition to those who presently exist.

Dear Chuck:
I have had an opportunity to review the documents you have
submitted and note that, while the Moores did provide for
exclusive use of the improverments, the. land itself has never
been parcelled (but retained by a husband and whife as`tenants
in common). The applicable statutory provision (in effect
since 1972) is 30-28-101(10)(c) which reads (in part):
11 (c) Unless the method of ,disposition is adopted for
the purpose of evading this part 1, the terms
'subdivision' and 'subdivided. land', as defined
in paragraph (a) of this subsection (1Q), sfiall
not apply to any division of land:...
(VII)i~hich is created by the acquisition of an interest
in land in the name of a husband and wife or other
persons in joint tenancy as tenants in common,
and any such interest shall be deemed for purposes
of this subsection (10) {i.e., for the purpose of
defining what is a subdivision) as only one interest...."
Identical language was incorporated in the May 8, 1972'subdivision
regulations adopted by Pitkin County (Resolution 72-17) and is
maintained to date.
In April of 1976, the Pitkin County Land Use Code was adopted and
provided, in Section 4. 02.Ol,that:
"In addition to those exemptions listed in the
definition of 'subdivision°` found`n"Section 12,
a duplex that is permitted by special review in
any zone district shall be exempted from the
subdivision procedures, except that condomihiumization
or its equivalent shall be considered a subdivision."

This language is now found in Section 4-2.1(a). I am aware of
no similar language in the County's regulations prior to 1976.
Given the above I think it fair to say that:
1. The 1973 arrangement may or may not have been done to evade
subdivision regulation (that I cannot evaluate given the
information supplied); but, in any event the tenancy in
common must, by the terms of the statute, "be deemed
(for purposes of subdivision review) as only one interest."
2. Any attempt to reconvey this "one" interest to two
separate purchasers in a method "equivalent" to
condominiumizaton would clearly be prohibited by Section
4-2.1(a) of the Pitkin County Land Use Code at this time.
