pursuant to Section 4-2.2(a)2 of the Land Use Code.
SUMMARY': The Planning Office recommends .approval of the
applicant's request with conditions. The, Land "Use "'Code,.. allows
exemptions from the subdivision procedure fbr'lgt line adjustments
if the

Section 4-2.2(a)2 permits the Board to approve lot line adjustments

BACKGROUND
REQUESTd Barry and Sharon Siegel propose to subdivide'Lot 3 of the
Sunny Park North Subdivision in order to create 'an 8000 square foot
parcel for the purpose of developing three. affordable housing
units. The existing lot is located entirely within the `'
Aspen City limits. However, in order for the remainder.,,. of the
parent lot (Lot 3) to maintain the City's minimum lot area, the
Applicants are proposing to add land to lot 3 from the adjacent
Mascotte and 99 Lode parcel, which is located in the County. This
lot line adjustment is being processed as an exemption to the full
subdivision review process tilnder Section 4.2-2''(a) 2"of the Land
Use Code. `
The Applicants are also requesting.:...-.approval for rezoning,
subdivision and Special Review for open space and parking from tfie

Lot Line Adjustment
The applicants are requesting approval of a Subdivision Exemption
for a Lot Line Adjustment between a platted lot within the City of
Aspen and the unimproved Mascotte Lode ahd 99 Tode parcel located

area. The parcel sits atop a steep slope adjacent to Park Circle.
The property has been developed with a Ingle family home, which
the Siegel's currently occupy. The"existing home is located. at the
top of the slope, toward the rear of the lot. The home. on this lot
is currently accessed from Smuggler Mountain Road via an easement
that follows the salvation ditch. This easement does not show up
on the Applicants' Lot Line Adjustment Plat or subdivision P at
drawings.
The Siegels propose to subdivide an 8.,000 square foot parcel at
the front of trie lot; adjacent to"Park Circle. The new lot is to
be rezoned by the City to AH (Affordable Housing) and developed
with a fully deed restricted ~tripleic to provide housing for
employees of their company, 'A§pen`"electric..,
Section 4.2-2(a)2 of the Pitkin County. :Land Use Code establishes
a procedure and criteria for a lot line adjustmeht as a subdivision
exemption. A lot line adjustment can be exempt from the full
subdivision procedure when the following criteria are met:
1. The adjustment creates not more than the original number
of lots.
2. Tfie purpose or effect. of the lot line adjustment is not
the creation of a new lot or `parcel"for development or
resale purposes.
3. In the case of conforming lots or parcels, any resulting

lot or parcel shall conform to the minimum requirements
for area or width established `by the provisions of the
Code.
4. In the case of nonconforming lots, oh parcels, any
nonconforming lot or paresl shall: not ncrease,_in

With respect to items 1 and 2, the requested Iot line adjustment
will not'crehte more than the,ori~inal number of lots within the

and 99 Lode mining claims are owned by the County and have been
merged forming an 8.07 acre parcel, Strictly speaking, this parcel
is nonconforming with respect to lot area_ since it is located
primarily within the AF-l zoning district, which requires a l0 acre. '
minimum lot size (see attached zoning map). Howe'~er; staff is
investigating the possibility that the Mascotte Lode property may
have merged with the"adjacent Mollie Gibson Park property. If this
is the case then the doinbined area of these two properties would
more than satisfy the SO acre minimum lat size,.__
if the Mascotte and 99 Lode parcels have not merged with other
adjacent County-owned properties, the proposed lot line adjustment
would not meet criteria number 4 for exemption from the subdivision
regulations, since removing 8000s~gcta~e feet from the Mascotte Lode
parcel would technically increase its nonconformity. In this case,
the Applicant's request would' have to, go` through the full

Regarding criteria number 5, the Applicants are in the process of
preparing final plat drawings and subdivision documents that will
be reviewed by the City's engineering and legal staff. These
drawings should be reviewed. by the County 'Engineer and 'County
Attorney prior to recording.

to expand their house by 1508 square feet.
The Siegels have expressed the desire to,,,,mainta}n the right to add

property and the layout of the existing house, the only practical
way to expand is to extend the house in the direction of the

Applicants have provided a rough sketc'h' ~a£~acfiedj` showing the
possible future building envelope. The sketch shows the proposed
building envelope extending slightly into the Mascotte Lode parcel.
The area of the encroachment appears to be a small 'fraction of the

The Mascotte Lode parcel is considered part of the County's open
space inventory. It has been the County's intent to maintain this

I need your opinion regarding the legal status of several mining '
claim parcels at the base of Smuggler Mountain,'near the Sunny Park
North Subdivision. As I understand tha ~'oun~y policy regarding

merger; pardels that are d"ascribed" by metes Wand bounds and are
under common ownership are automatically merged. Specifically, I
would like to have you verify whether the four mining claim parcels
outlined on the attached"map are all owned by the County and if so
have they been merged?.
To give you some background, I am working on a lot line adjustment
request for the proposed Aspen Electric Subdivision. Briefly, the
owners' of Lot 3 of the Sunny Park North Subdivision wish to
subdivide their lot, which is located in the City. In order for
the remainder of7the pare y lgot (Lot property et y', mum

The issue is whether the lot line adjustment request can be
processed as an exemption to the subdivision regulation as allowed
under Section 4.2-2(a)2. As part of tTe application submission
materials we received a deed that describes the Mascotte Lode and
99 Lode mining claims as one"`parcel. However, this"parcel does not
meet the minimum lot area in the AF-1 zoning district and,
therefore the exam tion criteria would not be met. If t&~e C
owns other adjacent mining claims that have been merged witounty
Mascotte Lode and 99 Lode claims then the minimum lot size would
not be an issue.
The applicant's representative claims that the MoYlie Gibson and
Lone Pine claims are', also owned by the County and has provided me
with the attached copies of the plat map and Corresponding pages
of the Ptkin County Abstract of Mines book. Please have a`look at
this material and get back to me with your opihiofi by tuesday as
this item goes before the Planning and Zoning Commission on October
6th and the memo is due out on Wednesday September 30th.

13. It is anticipated that this proposed land use will cause ah
improvement over the current transportaton.situa"tion in the,Smuggl'er
Mountain area. This statement is based upon the circulation improvements
cited above and the modal diversion expected in the population increment
from the Midland Park developmen€. Certain deviations in bus 'system routes,
however, are necessary to reflect the closure of the. Gib son-Park Avenue
collector. Pedestrian travel to Aspen will be facilitated by the construc-
tion of the Riverside pedestrian trail which is expected by. 1977, The
Salvation bic cle and edestrian trail which transve
Y P ~ rses the subject property
will improve the recreational trail system, but have `little effect on
commuter traffic because of the indirect route it offers to employment
centers. ,
14. The Midland Park 'Subdivision, because it is designed for persons
with proven employment tenure in the Community, will have little marginal
effect upon public facilities and services. Property taxes will be assessed
and paid for all public and quasi-public districts in which the, subject
property lies.
The provision of water service from the City o£ Aspen consti-
tutes a logical extension of the City's Midland Avenue main. Furthermore',
service. to this site would not tend to leapfrog further development in the
arc's since the subject property is the last developable site with access
from bfidland Avenue.
The proposed land use would augment the City recreation prograre

The Aspen Electric Project is envisioned as a development by the
private sector which is responsive to communty'and neighborhood
concerns, while providing thoughtful employee units.
With the invaluable help"of Pitkin County, by creating a 24,000
sq.ft. lot with a lot line adjustment of open space next to the
Siegel' Sot `; ` we Fare "pr~sposinq a subdivision for an AH Zone. The
creation of the new larger lot will happen siiaotaniously with'the
land u`se approvals for the Aspen Electric Subdivision.. (Lot Line
Adjustment, figure 10 and County Intent Letter, exhibit H).
The creation of 3 (three), 100 ~ Deed Restricted Employee units
will help to fill the employee housing nee"`d`"in"Aspen and it is
housing a vironman which is disbursed it ppropr3:ate y scaled to the
neighborhood and affordable. ".~Yie'proposed units are to be 1 three
(3) bedroon ,2 bath unit w'hich'will becatagory 4 and 2, two (2)
