Recorded at plat book 3; page 2 in the Pitkin County records, From: R-15 Residential To: AR-2 Accommodations and Recreation Purpose: Apartments and multiple family dwellings WHEREAS, Luke Anthony has filed an application to rezone a parcel of land, approximately 207 acres in size, from R-15 Residential to AR-2 Accommodations and Recreation, and WHEREAS, a joint public hearing was scheduled for, advertised for and held on September 12, 1972'before the Pitkin County Planning and Zoning Commission and the Board of County Commissioners of Pitkin County, Colorado, and' WHEREAS, based on the evidence, testimony, letters and exhibits submitted and a study of the 1966 Aspen Area General Plan the Pitkin County Planning and Zoning Commission finds that: 1. Thus ' zoning regulations must be based'on "the General Plan but need not include all the provisions of the plan relating to land use. In 1972 the R-6 portion was rezoned to R-6 (PUD). The Top of Aspen property directly north o£ the applicant's land was denied AR-2 (PCJD) zoning in August of 1972 and a portion of that land (R-15) is presently being developed as a tennis club under a County,Board of Adjustment variance. The Smuggler Trailer Park west of the Anthony property is presently allowed in an R-15 zone under a Board of Adjustment variance. hOMMENT5: Even. though the 1966 Aspen Area General Plan recommends PlannngsCommissionnconsider~for the applicant's property primary tion should b'e given to the timing of and needyfor a change of zoning that would allow said land use and the resultant density increase. The following points should be evaluated in regard to the, timing and need for a zone change; 1. Pedestrian and vehicular access and circulation must be provided for in an area presently restricted by accuse transportation problems. An economically feasible solution should be 'effected prior to any further increase in density. 2. Although the Aspen Metropolitan Sanitation District has sewer mains in the vicinity and will allow hook-up to these lines. it is questionable, at best, in light of the Dstrictts urgenC attempt at expansion, that the existing facilities could handle development that can take place under existing zoning without the additional density increase (10 units to approximately 60+ units) that would result from the proposed zone change.
