The result of that inspection was tha house at 560 Spruce St, was in no violation of the existing honing (R-SSj that time and that there were taw requirements that wnulc~ bring the ho`tise standards of the Pitkin County Building Code. Its usf letter a request on behalf of legalization of an existing the code threshold date late 1960' I have enclosed for 'your review a le~"£ter ff'61Yr' ~_n,~-~ tai"e previous owner as well as rent receipts which show that the ixnit existed prior to the required datelM''In addition conversations I have had with Patsy Newberry indicate the unit 'existed prior to 1981 No one seems to know exactly when the unit was actually YSuilt in the ~960~s or 1970ds but that 'is really not germane since it was clearly built prior to the effective date of the ordinance. The requirement that the unit be completed and in existence prior to June 8, 1981, is the only. requirement of ~ 3-8.13 (a) or (b) which cannot be waived. "'We meet "some of the other requirements and some of them we cannot meet. The unit contains three (3) bedrooms, and one (1) bath and has six hundred seventy five (675) square feet of living area. Since;. it is an existing unit we cannot meet'~he`fve hundred (500) square foot requirement. None of the houses in the Williams Addition meet the present 'FAR': I't is an R-6 neighborhood that now has an R-15 zoning and .16' F.A.R. Therefore the existing. unit clearly exceeds 'the F.A.R. The total F.A.R. of the building for the two (2) units (the employee unit and the existing unit) is one thousand two hundred sixteen (1,216) square feet. The present F.A.R. would only allow six hundred forty (640) square feet on a lot containing three thousand nine hundred eigf~ty (3,9'$0) square feet. ~. _~_ --~ ., .. ;. _... r l .. . Richard Grice July 17, 1984 Page 2 We are able to provide off-street parking of one space per bedroom. There are a total of four (4) bedrooms in the two units and we have four (4) parking spaces. The applicant is willing to place the following deed restrictions on the unit which covenants that shall run with the land: 1. The employee unit shall remain a rental unit. 2. The unit shall not be condomniumized. 3. The unit shall not be occupied by the owner and/or spouse and shall be limited to occupancy by not more than two_ (2) persons per bedrtSbm which includes children. 4. The unit shall be rented to people who qualify as employees of the community under such guidelines as may be from time to time established by said authority. 5. The unit shall be rented for, terms of not less than six (6) months. The subject unit was inspected in 1977 by the Building Department. There were two (2) violations that were found with the unit: (1D Lack of smoke detectors and (2) the railing needed to be reinforced. $oth of these problems were immediately corrected. The owner is of course willing to have an additional health and safety inspection done by the Building Department. Legalizing this unit has no impact on existing services or utilities since it is an existing structure with all services already connected and/or available.'
