I believe that an agreement between wilk, KAJX and the county was signed to allow for this'izse pending 1041 approval. at the time, wilk wanted to make sure that the site could be used for other transmission-related purposes. i don't know if this issue was ' speicfically addressed within the 1041 approval. i do know that john dady had serious problems with allowing other transmission uses on', the site as y ' gn` y 'nterfere with the KJAX trasnsmi5sion. the would like si ifcantl i I'm sure one could find the 1041, approval and the agreement in the county files if one was interested in what was, actually approved and a~eed upon. p.s. i had breakfast today with dorothea and she. asked about this so i told her. Also, I recently came acrciss a coKSy, unsigned, of a letter from 1`im Whitsett to the attorney for Mountaintop Management,'from 5%4/93, indicating that the $OCC had denied fhe request for a transfer of interest from Rec. broadcasting to Mountaiintop, for fh'e'reasons stated in an enclosed memo from Dady-there.w~s no memo, and Mountaintop has always insisted we never responded to the transfer request from 1992 and 1993. Can . ... _. you research board minutes from march 93 back to 4r'~`/%92 to'see if there was a formal) board action? ,, finally, we do stilh have a joint use agreement on the site, which requires mutual consent far additio'naP users. a'nd, the provision on electric costs(which we don't currently pay at all) requires us to pay if we install additional equipment. which requires additional usage, and then we only pay for the additional usage.
