WHEI2E~S, Martin D. Siegel (hereinafter "Applicant") is the owner

on the attached Exhibit "A"; and
WHET2EAS, the Applicant has requested a two unit "lot split"
subdivision pu suant to Sections _4_-6(b) and 5-510(c) of the Pitkin
County Land Use Code; and
WHEREAS, the County Planning and Zoning Comm Sion (hereinafter
~' "Commission") did consider the evidence and testimony presented with
respect to this application at their regular meeting on Flarch 6,
1984, and_determned to recommend approval. ,
NOW, THEREFORE, BE IT RESOLVED by the Commission that it does

This application proposes a two,•unit .subd,ivision 4f Partin Siegel°s
7.62 acrd"s of vacant.. lane located adjacent to the Rec7 t.ountain v.ater
Tank along Hunter Creek EFoad; The application i~ made pursuant"to
the 500 density reduction "lot split" provisions of Sections a 6(b)
and 5-51'0 (c) of the Land Use Code. The proposal is eligible""f'or
the lot split by virtue of the fact that after density reduction
for steep slopes the tract is zoned for _8 ._5 "unit in the ~ 30 zone_
anaonditionwof units are proposed to be developed. Per Section ~-'0(}3)

,.approval must be a deed-restriction. to run., with the
land against any further development.
Legal access ,is provided by Hunger Creek P,oad p~hich traverses the
tract on the westerly side. Physical,. access to,the.two proposed
building sites is proposed through an adjacent tract owned by the
BLbI via,,a 16° ;easement.. Furthermore, a 20,ea~einent is proposed
across Lot 2 of- this proposed"subdivis; on in order to accesSmLot
,w.~
1. Since minimum Land Use Code requirements call, for jo° zccess
easements for the purpose of ingress/egress ands utilities to the
property, a condition of approval should require demonstration of
a 30' easement from Hunter Creek Road to each building site.
Accarding to the application, the access drye,•crosses some thirty
percent C30n) slopes which will result in road cut`s of tYiree to fige
(3 - 5) feet, These cuts will need to be re vegetated and stabilized.
The actual building envelopes are proposed for slopes less t?ian 30%.
Uniform Building Code requirements should be adequate to insure safe,
stable foundations.
Ivater is proposed to be provided by the City of Aspen's 4'ater Department.
According to Jim l~arkalunas, the City can provide service at such
time as the contracts are let for the proposed alternate (support)
pump station on Red_PSountan. Approval should be subject to the
receS.pt of a commitment for water seYVice' by tYie City.
Aspen Petro Sanitation will provide sewer service but noted some
difficul y in "finding a way down to the Hunter Creek line."
A conceptual utility extension plan was submitted as a past of this
application. There may be adverse visual,. impacts or other difficulties
associated with. utility extension since. the building envelopes are
surrounded by either steep slopes or private property. The utility
needs of; the subdivision are proposed to',be handled as follows:
1. Electrical service is already avzilable from an overhead
utility line which crosses one of the two building envelope's,
The applicant intends to slightly relocate the overhead
line, then extend service undergsound!to each building
envelope.
2. Gas and telephone service vain be e~.tended,underground
witF~in the access easement.
3. Water and sewer will be extended parallel to each other
directly up the hillside from Hunter Creek Road. The applicant
intends to address the stability of the impacted hillside
and the visual impact of the utility extension at Detailed
Submission.

At your Zast meeting, the Commission discussed the possibility of
processing a code amendment to create flexibility with respect to
the width of access easement `requirements. Specifically, cbitli respect
to the Siegel application, the Commission requested that that. resol`utioh
be drafted to provide the flexibility for new less-stringent access
requirements to be applicable in the event the code is amended prior
to Final Plat approval of this application.
The County Engineer's office cling°with the Planning Office and County
Attorney have been considering the appropriateness of such a code
amendment and concluded that"some limited flexibility with respect
to the width of access easements might be appropriate. However;
priateoto thinking at the present time, ~•re believe it caould be inappro-
provide such flexibility in the Siegel situ«tion due to
the fact that the proposed access drive caill cross slopes of 303
and greater. Considering the Engineering Office's conclusion in
this matter, the Planning Office decided that there would be no point
in drafting the Commission's GeneraY" Submission ap~rov'al recommend-
ation so a's to require less than a thirty foot (30') wide easement.

for various road expansions and access easements would,

The access road up the gully to the BLM property effectively
divides the applicant's land in two (2) from both a
topographical as well as a usage standpoint. As a result of
' the proposed road conveyances, the southerly most .parcel,,. of
applicant's property~wo`uld become totally separated from the
remainder and would take on a different character, being" ~'
subject to the impacts of ''more 'frequent t~af£i :°"'` `a
fine applicant applied for a subdivision of a
portion of this land approximately three (3} years ago and
was scored poorly at that time based"primariiy'on the factor

improvements program in progress and, by 1982, all
improvements that ?re contemplated to that road will have
been completed. ''
The applicant has a total of 8.62_acres_n an R-30.
zone with only one 'existing residence. The zoztiing would`
allow;a potential density of a total~af twelve {12) units.
The applicant requests a subdivision exemption to create
parcels for community facilities and to convey'approximately
thirty thousand, five hundreS (.30,500) square feet of land
• for roadway easements for both the Red Mountain Ranch Road
and the access road to the BLNt parcel and additiioria'1`operi '°'
space lands to the west of the Red Mountain Ranch road.
This conveyance would result in a loss of Iand~area "tq the ,, _;
applicant of the equivalent of a residential unit. In
addition, the proposed exemption would allow at this time

Dear Richard:
Enclosed please find an amended right-of-way
agreement entered into July 12,x1984, between the United
States of America, Licensor and Martin Siegel, Lincensee.
The purpose of the amendment is to authorize the full width
of the existing access road to allow for the burial of
utility lines and to extend, the size of the right-of-way to
thirty feet thereby complying with the requirements of the
Planning and Zoning Commission and County Commissioners. By
securing this extension we meet the code requirement of
thirty foot access. We also 'have met the requirement. of
general submission approval place upon u by the Board of
County Commissioners which stated that prior to the
recording of the Final Plat the applicant shall demonstrate
the availability of the thirty foot access edselnent'or
access melting code requirements for ingress and egress and
utilities to each building envelope from a public road along
the access drive which is proposed to the adjacent BLM
parcel. By the securing of this easerlent I believe we have
resolved the requirement of 'the Board of 'County
Commissioners I would therefore request that our detailed
and final approvals be combined so that we could
expeditiously move forward with an approval. Thank you very

Presented below is our rational for selecting the route and tie-in
locations for each utility.
Sewer:., Sewer shall be installed with a 4 foot- depth''; of bury' and

building envelope will -have an individual sewer tap and service line,

The sewer route has been selected because it is the only roue which
can provide gravity service to the building sites. Sewer `service in
the driveway `'would require the installation ot`"grinder'"pumps at the
residences which would pmip into a force main installed in the drive-
way. The force main would end at a point where the driveway 'lays'down-
hill to Eunter `Creek Road. It is our opinion that the" gravity flow
along the proposed route is a' better ~_Zd Hare tali"able"solution tdan
pumping up to the driveway. _

service line. A hydrant will be insCahed along the shared lot line as

I have completed my investi„ation of the two building envelopes
associated vr,th Lots` 1 and 2 of the Siegle property oii Red
T~:ountan, Pitkin County, Colorado: The property lies in the
upper central portion of the north half ,of ue_ctiorl 7 (projected)
T. 10 S., R. 84 ~~1, of the Aspen 72 minute quadran4le.
The two, building envelopes will'be treated as one„area since.
they are nearly contiguous and are topographically very similar.
The topography of the site consists of a. more or less linear
knoll trending approximately east-wrest. The long`axs of the
knoll, along which the building envelopes lie; slopes gently
to the v^iest. The land surface is dotted vrith sagebrush a.Yid
other native shrubs, and scattere3 granitic and sandstone`
boulders. There are two existing houses south. of the two
building envelopes. ',:., __ ,, ~,
The geology of the site consists of sandstones, siltstone ,
and shales of the red, hematite-cemented B7aroon Fcrmation
of Pennsylvanian-Permian age. There are outcrops near the
site which show that the bedding dips from ~+$ to $$ degrees ''
to the northvrest, There are no faults or folds in, the geologic
strata 1~rhich could affect development vrithiri the"designated
building envelopes.` There is a thin veneer, perhaps`10 to 1$
feet thick, of Quarternary age glacial moraine deposits of ~,
Glacier "C" consisting ofrunstratfied and unsorted silts,
sands,'gravels and boulders.
The two building envelopes are located in the most advantageous
portiorss" of the two proposed lots, As shovrn;~ neither"building

The applicable language of the Land Use Code states:
"In the event that two„or more contiguous. parcels of

An ambiguity exists in this language with respect to the_application
of this definition to parcels coming under single ownership prior
to the enactment of the definition oh May 14, 1979'. Since the

There are several items which need„clarification regarding this submittal:
1. The BLM granted a 16 foot easement, however, the applicant is proposing
a 20 foot easement.
2. It appears Siegel also owns adjacent property so that this may not necessarily
qualifyas a lot split.
3. The old Hunter Creek Wagon Road easement, held by the County, needs to
be shown on the plat.
4. please note the road. cut to the parcels was completed in 1982, no
revegetatioh has occurred to date.
It would be desirous if the applicant would grant a trail easement. (10 ft.) for
the trail from the County parking lot through Lot 2 where applicable per
existing location.
It would be of great public benefit if the applicant would pave the access
drive from Hunter Creek Road to the Water Department Building. The County
in cooperation with Mr. Brandman, constructed this access for the public in
1982. It would be an improvement to public safety and benefit if the
applicant would pave this access in consideration for its proposed use.

Dear ID1r. Eisenstein:
I have completed my investigation of the two building envelopes
associated with Lots 1 and Z of the Siegle property on Red
DZountan, Pitkin County, Colorado. The property lies in the
upper central portion of the north half of section '] (projected)
T. 10,5., R. 84 W, of the Aspen '72 minute quadrangle.
The two building envelopes will be treated as one area since
they are nearly contiguous and are topographically very'similar.
The topography of the site consists of a more ors less linear
knoll trending approximately east-west. The long axis of the
knoll, along which the building envelopes lie, slopes gently
to the west. The land surface is dotted with sagebrush and
other native shrubs, and'scatterec`1 granitic and'sandstone
....
boulders. There are two existing houses south of the two
building envelopes.
The geology of the. site consists of sandstones,'siltstones,
and shales of the red, hematite-cemented NSaroon~Formation
of Fennsy].vaniars-Permian age. There are outcrops near tFe
site which show that the bedding dips from 45 to 55 degrees
to tYe northwest: 'mliere are no Faults or folds in the geologic
strati. which could"affect"developmeii'~ within t$e designated
~...., .
building envelopes. There is a thin veneer, penhaps 10 to 15
feet thick, of Quarternary age glacial moraine, deposits of
Glacier "C°' consisting of unstratified-and unsorted silts,
sands, gravels and boulders. °
The two building envelopes are located in the most advantageous
portions of the two proposed lots.. As shown, neither building
envelope encroaches an the steep galley sidewall to the north.
Because of the unconsolidated nature of the morainal material,

the buildings should not come closer than 20, feet of the
" edge bf the gullet', unless the foundations can be i'oun~Ted
on the red sandstone bedrock, especially along the northern
sides of the houses, Natural drainage associated with these
envelopes Ys excellent but, because of the unconsolidated
nature of the glacial ma~erzal, soils engineering studies
should be conducted. at the site. specific level,, It is 'my
understanding. that domestic ti°~ater and,.N*aste disposal systems
are aYready in place. A rough access to the"twq envelopes
is already in place and should be adequate if it is properly
.finished. +;Care should be taken so that sloughing of the
.access road into the afore-mentioned w lley does not occur.

"....an established easement no less than twenty (20) feet
in width for ingress and egress on land`s w"£h a~slope of
less than 5% and no less than thirty (30) feet in width
for ingress and egress on lands wiEh a slope of more than
5% and more than five (5) dwelling units. An adequate road,

minimum of sixteen (16) feet for thirty (30) foot easement
plus all cut and fill slopes, ditches and a minimum. of a ten
(10) foot utility easement shall be within, the easemept`anc~ i

This change should meet the concerns, of P & Z, BOCC and clients. ,However
all must remember an easement not only confains a road, but cut and fill
slopes, ditches and room for utilities. ,
