He felt ..that since the land directly across and down the street had been used in the same manner that this would be in line with what was desired for the area. He felt that most people objected to the area being cut up into small lots with each house blocking the others view of the peaks in back. He also noted that Holiday Inn is a well known National Hotel Chain and that they do a good fob whereever they go. He also noted that the Aspen area was looking for a convention facility and that the Holiday Inn people had planned to have such a facility along with their proposed hotel. The map was examined by the County Commissioners and others to make themselves familiar with the area involved and how much land would be affected by the rezoning. Mr. Bishop asked what would be the problem in planning to include the whole tract as far as Maroon creek. The plan does include the whole 11 acres but not that now subdivided. The option is on a 5 acre tract but may need the extra for swimming pool, tennis courts ect for expansion. Mr. Reynolds explained that that part of the triangle which was left after the 5 acres would be buildable in any case because of the setbacks. Mr. Hunter Hogan of Norfolk Virginia, with Holiday Inn said they had been coming here to ski for several years and found there was no place for drive in type accomodations. When they optioned the land they were not awareofthe zoning codes and setback requirements and they will probaboy be negotiating for more of the property. Mr. Stanton asked for any more comments. Mr. Hogan then mentioned that they would like some indication so that they can go ahead with their plans. They would like to be ready with their facility by August of next year for conventions in the fall. Question was asked who owns the tract back of this and how far was the tract in question from Maroon Creek. Mr. Moore owns the property directly in back. Maroon Creek is approximately 500' from the tract in question. Mr. Stanton asked for further questions. None. He explained that the Planning commission would tak the matter under consideration. Hearing was Ad~aurned. Next Item of Hearing was the Janss Colorado Corporation, Snowmass at Aspen rezoning request. Notice of Public Hearing was read including requests: (Map included in zoning request) Mr. Vidal made his presentation explainnig why changes were needed. He explained each area and the plan for the area showing the business area Page 3 August 5, 1968 Joint Public Hearing joined to West Village by a bridge over the ski lifts and runs; explained how the whole plan was geared to pedestrian traffic; explained why the tourist area was shown close to the ski runs etc. Questions were asked regarding parking. He showed slides showing the elevations from all exposures. He explained that they would provide 1173 parking spaces with access road with less than 12~ grade as provided in West Village. Dr. Baxter commented that this looks like the spot zoning everyone talks about. Why couldn't the area be zoned all to business for instance and awaywith the spots of tourist scattered around. Vidal explained that if it were zoned business they would not have control of the plan if it were done that way. They could have any type business any place they wanted it. They want the business center and to taper to the next lower which is tourist for Motel and Condominium type operations. He feels that this is done this way because of the number of types of zoning provided under the present zoning. The Commissioners and Mr. Stanton agreed that they hope the studies now being done will change that soon. Mr. Sardy asked how they could tell whether or not this zoning is right. Mr. Vidal explained that they had learned form the mistakes made on the first plan and they hope to correct some of their mistakes in the new plan. In the proposed Tourist ( to be~changed from R-30) he explained that the area was not suitable for single family dwellings because of the steep sites, and that they would probably plan a stepped type pedestrian village for that area but not soon. Mr. Vidal asked that he also show the slides and explain the zoning to the planning and zoning commission at some later date. Mr. Stanton said this could be arranged. The Commission asked Cronin and Stanton to inspect the site with Mason. John Huebinger Subdivision "Sunny Acres" was approved. Meeting was adjourned. Respectfully submitted Edgar Stanton PITKIN COUNTY PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING WITH COUNTY COMMISSIONERS August 5, 1968 Present were: J. Baxter, T. Sandy, Bishop and Stanton. The first item of business was acceptance of the Uniform Housing Code as a part of the County Building Code. The notice of public hearing was read. Mr. Stanton then asked Mr. Reynolds, County Building Inspector to explain what the Uniform Housing Code covered. He explained that it was pretty much the same as the Uniform Building Code except it set out things concerning sanitation, occupancy requirements and fire codes a. little more so that they can be enforced to eliminate undesirable types of housing. Mr. Stanton explai-ed that no decisions would be given at this meeting , that this was only a Public Hearing to hear the pros and cons of any question. The Commissions will make their decissions based on the hearing and then make recommendation to the Commissioners. Next Item of Business: Mr. Sandy felt that it should be noted that the hearing was moved from the courtroom to the commissioners room because of the number of people present. It Bras therefore made a part of therecord that the Public Hearing was recessed from the County Courtroom and moved to the County Commissioners room for the Public Hearing. Mr. Stanton read the Public Hearing Notice of Mr. Iselin of rezoning for eleven acres on Highway 82 West. He then asked Mr. Iselin and Mr. Moore for their presentation. June 29 meeting contd. A representative of Mr. Crosby asked for consideration for the sign at Aspen Shadows Lodge. The Board of Adjustment indicated to him at the meeting that he should file an appeal with the Building Inspectors office. The Board considered at some length the need for industrial zoning on the outskirts of Aspen and at the same time considered the plans of Mr. vanOrden as of the airport ranch for which Mr. vanOrden is requesting a Business classification. Planning and Zoning Minutes June 29, 1968 Present were Bishop, Pedersen, Woodward, ~ Stanton James Snyder Subdivision was considered and approved with the nota that any __ new Subdivisions should require the following under the signature of the j County Commissioner' ~ This approvel does not extend to utilities, sewage disposal, roads ~ or any otherservice facility. Access from public roads will be restricted to the places indicated hereon. The Janss Corporation presented Subdivision plat for Woodrun #3 which was approved. Consideration was given to a temporary sign plan in the Snowmass area for identifying the various subdivision areas. These signs to be 6 square feet in area dnd of temporary nature, being removed when the subdivisions are completely sold. The Chairman was also authorized to sign an approval form for the Aspen Sanitation District improvement plan. There was further discussion on the public hearing concerning Charles Crosby's request for a zoning change. No action was taken. I understand that you and one of the other commissioners attended the hearing and regret that I did not have the opportunity to personally meet you and discuss our problem . Being an Aspen enthusiast, and recognizing the need for a modern hole? with enough space and facilities to accommodate convention business, my associ- ates and I felt that we were fortunate in being able to obtain the holiday Inn franchise and had hoped to be able to open for business by November, 1969. Unfo.tunately, our franchise is only good for nine months from the time it was issued wi-~ich was in June of this year. The requirements are that we commence construction prior to the expiration of the nine months . I 'nave been advised that the comrnissior~ers plan to have a land use study made from Castle Creek to the airport which certainly makes sense for orderly planning. I realize that studies of this nature take a little time but am hopeful that we can know something prior to the expiration of our option or. January 10, 1969. We have requested are extension of the option from Mr. Iselin but have not received a favorable reply to our request. We originally preferred his site as it would leave room for expansion should the Holiday Inn operation prove to be the success that we hope for. Since it is doubtful that we v~rill have tl-:e necessary zoning on the Iselin site, we have been negotiating for the Fredl Phifer site but under- stand that due to a change in zoning after the preliminary plans were drawn for the people that lost the Holiday Inn franchise, the plan (which appeared to be 7 ~ t ONE COMMERCIAL PLACE e NORFOLK, VA. 23510 Page Two tiTr. We sincerely believe that the Holiday Inn whic:~ we want to erect, with ample meeting and convention facilities, would prove to be a real asset and be com- patible with the high ideals and quality of operation that the commissioners desire to have for Pitkin County.
