Pfister (hereinafter "Applicant") requesting Special Review approval to relocate a residence on his property (see Exhibit "A" for parcel description, attached hereto and incor- poc-ated by this reference) within the Scenic Foreground Overlay; and WHEREAS, the Commiss~or. conducted a :e?eting on March 18, 1986, at which time evidence and testimony were presented with respect to said application. NOW, THEREFORE, BE IT RESOLVED by the Commission that it does here by grant Special Review approval for the residence to be located within the Sce nic Foreground Overlay subject to the following conditions: 1. The residence s hall not exceed 17 feet from grade to the top of the roof. 2. MEMORANDUM T0: Pit kin County Planning and Zoning Commission FROM: Francis Krizmanich, Planning Office RE: Pfister Cabin Relocation - Scenic Foreground Overlay Special Review DATE: March 18,1986 REQUEST: Art Pfister is requesting scenic foreground overlay zone approval so that he can move an existing cabin on his ranch to a location behind the Pomegranate Lodge. APPLICANT: Arthur 0. Pfister ZONING: The property comprises approximately 600 acres and contains AF-1, AF-2, AF-SRI, and Scenic Foreground Overlay zoning designations. WATER: Proposed well or connection to City of Aspen Water System. SEWER: Proposed septic system or connection to City Sewer System. ACCESS: Access is by an existing driveway onto Highway 82 immediately west of the Maroon Creek Bridge (the Lazy Chair Ranch Road) . PROJECT DESCRIPTION: The applicant is requesting approval to relocate an existing cabin from the upper ranch (Buttermilk West area) to a location on the lower ranch behind the Pomegranate Inn. The cabin is one story and would not exceed 17 f eet in height. The cabin is approximately 700 square feet in size. The applicant plans on remodeling and adding additions so that the finished cabin will be approximately 1,700 square feet in size (see attached letters from Arthur O. Pfister) . MAJOR ISSOES AND CONCERPS I. Referral Agency Comments: 1. Environmental Health Department - In a memo dated February 7, 1986, Tom Dunlop has indicated that the proposed cabin can be serviced by public water and sewer and should be connected to these public systems rather than relying on private water and sewer systems. In addition, proposed fireplaces are required to m eet current County regulations regarding solid fuel burning devices. During construction, all debris should be hauled to a designated landfill. No open burning of construction waste on the site will be permitted. 2. Aspen Consolidated Sanitation District - Heiko Kuhn has indicated that the cabin can be provided sanitation service by the district. 3. County Planning Engineer - In a memo dated March 12, 1986, Tom Newland submitted the following comments: - The relocation will benefit access to the structure, and does not seem to block or alter drainage patterns on the surrounding agricultural lands, - The relocation will not visually impact the State Highway 82 Corridor, being located behind the Pomegranate Inn and a row of mature Cottonwood trees. II. Staff Comments: The proposed new location for the cabin is located within the Scenic Foreground Overlay zone. The criteria for development review within the Scenic Foreground Overlay are as follows: 1) Whether the development has utilized existing topography, such as dry ridges and hills, to screen buildings to the maximum extent possible. 2) Whether the development has been designed to compliment the natural topography of the land, including, whenever possible and appropriate, the utilization of innovative architectural techniques such as earth sheltered design and clustering of structures in the least visible portions of the site. Also, whether the development's height and bulk has been designed to avoid, to the maximum extent possible, the visibility of buildings from the highway. 3) Whether the development has avoided the location of uses on the highest ground or most visible sites from State Highway 82 . 4) Whether the development has been located outside of the designated Scenic Foreground, or on a suitable site at the greatest possible distance from State Highway 82. 5) Whether the development has been landscaped in accordance with the adopted State Highway 82 Corridor landscape guidelines and has preserved natural vegetation, to the maximum extent possible, including avoidance of irrigated meadows. 2 6) Whether the development's exterior lighting has been designed in such a manner that objectionable light sources will be incapable of being seen from State Highway 82. 7) Whether any landforms and earth moving techniques designed into the development are utilized as one of several methods to compliment and enhance development, rather than as the single device for screening development from view from the State Highway 82 Corridor. 8) Whether, in the case of non-residential development, the use has been located on a large site and has been designed so as to preserve the vast majority of the site as open space. 9) Whether the development has been designed so as to avoid, to the maximum extent possible, any ScenicViewplane identified on the adopted State Highway 82 Corridor Master Plan. The following staff analysis of this project is based on the above review criteria: 1. The existing topography should be used to screen the proposed residence by placing it on the lower (eastern) portion of the site rather than on top of the knolls found on the western edge of the property. This will tend to screen the residence from Tieback Road and the Pomegranate Inn as well as keeping the residence out of the main site line of the Pomegranate East Condominiums. 2. The applicant has indicated that the residence will not exceed 17 feet in height. This will minimize visual impacts. In addition, the site is not visible from Highway 82 because is it behind the Pomegranate Inn and the Pomegranate East Condominiums. 3. It is not clear from the site plan submitted that the house site is located off the highest ground on the site. The applicant should commit to locating the residence off of the highest portion of the site by defining a specific building envelope on the site plan. 4. The site is not visible from Highway 82. 5. The house site is located on the edge of horse pasture, however, a single residence in this location will have a minimal impact on the pasture. 6. The applicant has not proposed lighting standards. If lighting is planned it will be required to conform to County standards. Lighting should not create a problem because of the location behind (south of) the Pomegranate Inn and the natural screening of the site by mature 3 trees on the east and the topography on the western side of the site. 7. This proposal does not require berming or earthwork to screen it from Highway 82. 8. This criteria applies to non-residential development. 9. This proposal does not affect any scenic viewplanes identified in the adopted Highway 82 Corridor Master Plan. The applicant is using existing topography, vegetation and buildings (Pomegranate Inn and the Pomegranate East Condomin- iums) to hide the proposed residence from Highway 82 view- planes. In addition, the applicant has indicated that the finished building will not exceed 17 feet in height. The Planning staff's opinion is that this proposal represents a minimal impact to the scenic qualities of the Highway 82 Corridor and is, therefore, in conformance with the scenic foreground review criteria. Public water and sewer lines exist in close proximity to the site and the applicant should be required to connect to these public systems in conformance with County policies and regulations governing water and sewer system development. RECOMMENDATION: The Planning Office recommends that the Planning Commission grant special review approval for the cabin to be located in the Scenic Foreground Overlay Zone subject to the f ollowing conditions: 1. Dunlop, Director-~D Environmental Health Department DATE: February 7, 1986 RE: Pfister Cabin Relocation Special Review County Case No. 058A-85 (86) ---------------------------------------------------------------- The above mentioned submittal has been reviewed by this office for the following environmental concerns: SEWAGE DISPOSAL- It is a policy of the Environmental Health Department that buildings used for human use or habitation be served by a public sewage collection system if possible. In a letter to the Aspen/Pitkin Planning Office from Mr. Arthur Pfister, dated December 22, 1985, he offered the options of sewage service to the property either from a publ is collection system or by an onsite sewage disposal system. It will be the decision of this department that the property and dwelling under review be served by the sewage collection system under management of the Aspen Consolidated Sanitation District. It appears that this decision will not cause undue hardship to the applicant since it is implied in a letter dated December 31, 1985, by Mr. Pfister, to the Planning Office, that a public sewer collection line is already in place along the north property line of the Pomegranate Inn. It is also implied that the mentioned collection line can serve rlr. Pfister's property since his cabin will be located just south of the Inn. The only unknown at this time is the ability of N,r. Pfister to gain an easement to access the public sewer 1 ine. A confirmation letter f rom the Sanitation District granting the easement and tap will be necessary. WATER SDPPLY- As mentioned in the above discussion relative to sewer service, there is a similar policy of the Environmental Health Department that a building intended for use or 130 South Galena Street Aspen, Colorado 816'1'1 303/925-2020 Page Two Pfister Cabin Relocation Special Review February 7, 1986 habitation by humans should be served by a public water system if at all possible. This would be in lieu of a domestic water well intended for individual service. Referencing Mr. Pfister's letters dated December 22, 1985 and December 3, 1985 to the Planning Office, he states that there already exists a water service line "near the house site". He also states that he will serve the cabin with City water or a well. Based on department policy, it will be the decision of this office that the new dwelling site be served by domestic water from the City of Aspen water distribution system. AIR POLLUTION- It is apparent that the relocated cabin will have one solid fuel burning device. The applicant shall comply with Pitkin County Resolution 83-7 governing the design and installation of such devices, unless that law is amended, in which case the applicant must comply with whatever law is in effect when the building permit is obtained. Further, Pitkin County Resolution 85-14 allows the applicant the ability to apply for a variance whereby a second "dirty" solid fuel burning device for the house may be applied for. Specifically, Resolution 83-7 allows one "dirty" solid fuel burning device and unlimited numbers of "clean certified" solid fuel burning devices per building. During construction, all debris shall be hauled to a designated landfill. No open burning of construction waste on the site will be permitted.
